Responsibility for collecting privacy information can mitigate . Responsibility for collecting privacy information may be mitigated. The corresponding bill was developed by the Ministry of Communications of Russia.
The ministry believes that in Art. 137 of the Criminal Code of the Russian Federation, which provides for punishment for the illegal collection and dissemination of information constituting personal or family secrets, amendments must be made. Criminal punishment should be imposed only for the dissemination of information that entailed the infliction of physical, moral or property damage.
The responsibility for the simple collection of information, as the Ministry of Communications of Russia believes, should be assigned solely according to Ch. 13 Administrative Code, devoted to administrative offenses in the field of communications and information.
Recall Art. 137 of the Criminal Code of the Russian Federation provides for a fine of up to 200 thousand rubles, compulsory labor for up to 360 hours, correctional labor for up to one year, forced labor for up to two years, arrest for up to four months or imprisonment for up to two years. If the offender used his official position, the fine is increased to 300 thousand rubles, and the term of imprisonment is up to four years. If the information was disseminated through the media or the Internet and concerns a person under 16 years of age, the fine can be up to 350 thousand rubles, and the term of imprisonment is up to five years.

Ответственность за сбор сведений о частной жизни могут смягчить. Ответственность за сбор сведений о частной жизни, возможно, будет смягчена. Соответствующий законопроект разработало Минкомсвязи России.
В министерстве считают, что в ст. 137 УК РФ, предусматривающую наказание за незаконный сбор и распространение сведений, составляющих личную или семейную тайну, должны быть внесены изменения. Уголовное наказание должно назначаться только за распространение информации, повлекшее нанесение физического, морального или имущественного вреда.
Ответственность за простой сбор информации, как полагают в Минкомсвязи России, следует назначать исключительно по гл. 13 КоАП РФ, посвященной административным правонарушениям в области связи и информации.
Напомним, ст. 137 УК РФ предусматривает наказание в виде штрафа в размере до 200 тыс. руб., обязательных работ на срок до 360 часов, исправительных работ на срок до одного года, принудительных работ сроком до двух лет, ареста на срок до четырех месяцев либо лишения свободы на срок до двух лет. Если преступник использовал служебное положение, штраф увеличивается до 300 тыс. руб., а срок лишения свободы – до четырех лет. Если информация распространялась через СМИ или Интернет и касается лица младше 16 лет, штраф может составить до 350 тыс. руб., а срок лишения свободы – до пяти лет.
