1. Decree of the President of the Russian Federation of May 3, 2018.
2. Interaction of non-state security structures.
In 2017, there were some problems with the registration and renewal of licenses of private detectives. These problems were caused by legislative uncertainty regarding the body, which should carry out licensing of our activities and control over compliance with the legislation in this area. The uncertainty was caused by the fact that the functions for licensing the NPV were not transferred to the Russian Guard, which structurally included the unit of the Ministry of Internal Affairs, which monitors and licenses private security activities. In this regard, the Ministry of Internal Affairs did not find a structural unit that would license the activities of private detectives. However, this problem was solved at the level of local authorities of the Ministry of Internal Affairs (Republic, oblast), which, in principle, even in the absence of a regulatory framework, tried to help in issuing and renewing licenses for NPV, “negotiating” with the Russian Guard that documents for issuing and renewing licenses were accepted by Rosguard officers, and the license itself was signed and executed by officers of the Ministry of Internal Affairs in the regions.
However, this uncertainty was eliminated in connection with the Federal Law No. 391 ФЗ “On Amending Certain Legislative Acts of the Russian Federation” adopted on December 05, 2017, in accordance with Article 1 of which the authority to issue and extend a license for private detective activity was transferred to the Russian Guard .
In order to bring the legal norms in terms of control over licensing of private detective activities in connection with the adoption of the above Law, the President of the Russian Federation signed Decree of May 3, 2018 No. 190 “On Recognizing Clauses 22 and 42 of Clause 11 of the Regulation on the Ministry of the Interior as invalid Of the Russian Federation and subparagraphs 13 and 26 of paragraph 13 of the Model Regulation on the territorial body of the Ministry of Internal Affairs of the Russian Federation for a constituent entity of the Russian Federation, approved by Decree of the President of the Russian Federation of December 21, 2016 N 699 ”in accordance with which from the authority of the Ministry of Internal Affairs of Russia and its territorial bodies control and licensing in the field of private detective (detective) activity is excluded.
In connection with the adoption of these normative acts, the situation regarding the issuance and extension of licenses for private detective activity has now stabilized due to the legislative settlement of the issue of which executive authority will deal with private detective activity. Such a body currently clearly defines the division of the Russian Guard, which is engaged in licensing of private security activities.
Colleagues, I am a representative of the Private Investigation Association, have been in our union for a little over a year and I want to tell you about our organization and its possibilities for more fruitful cooperation.
Our Association today has been operating for almost 10 years, and is the largest in the post-Soviet space with a claim to world leadership.
