Private detectives told what may change after the adoption of the relevant law

Ukrainian detectives fear that the bill recommended by the relevant committee of the Verkhovna Rada on the legalization of private investigation will lead to their full control of the Ministry of Internal Affairs. The journalist Ksenia Tsivirko writes about this in the article " There is a profession, but there is no law. How do Ukrainian private detectives work without licenses" for 112.ua.

Initiative No. 3010 "On detective (investigative activity)" involves the legislative definition of the procedure for training detectives, issuing certificates, as well as the creation of a Commission to consider complaints against detectives.

"This should become a kind of analogue of the National Association of Lawyers of Ukraine and the qualification and Disciplinary Commission of the bar, which are under the administration of the Ministry of Justice," the article says. 112.ua.

According to the author, the settlement of the activities of Ukrainian detectives is a long-awaited event. Now the materials of a private investigation are not grounds for applying to the court: the customer must deal with the "skeletons" found in the cabinet at his own discretion.

However, private detectives are wary of the profile initiative, not wanting to fall under the influence of the Ministry of Internal Affairs. In their judgments about the high chances of being controlled by the agency, they refer to the experience of the adoption of bill No. 3726 in 2017.

Even now, police officers often turn to former colleagues for help. Finding a stolen car without the use of city and national video surveillance systems is not easy for a detective. However, the expert community, in particular the specialists of the public organization "All-Ukrainian Association of Private Detectives" (VACHD), are sure that dependence on the Ministry of Internal Affairs will be disastrous for private investigation.

Частные детективы рассказали, что может измениться после принятия профильного закона

Украинские детективы опасаются, что рекомендованный профильным комитетом ВРУ законопроект о легализации частного сыска приведет к полной их подконтрольности МВД. Об этом журналист Ксения Цивирко пишет в статье "Профессия есть, а закона нет. Как работают украинские частные детективы без лицензий" для 112.ua.

Инициатива № 3010 "О детективной (розыскной деятельности)" предполагает законодательное определение порядка обучения детективов, выдачи свидетельств, а также создание Комиссии по рассмотрению жалоб на сыщиков.

"Это должно стать своего рода аналогом Национальной ассоциации адвокатов Украины и квалификационно-дисциплинарной комиссии адвокатуры, которые находятся в сфере управления Министерства юстиции",- отмечается в статье 112.ua.

По словам автора, урегулирование деятельности украинских сыщиков – долгожданное событие. Сейчас материалы частного расследования не являются основанием для обращения в суд: разбираться с найденными в шкафу "скелетами" заказчик должен по собственному усмотрению.

Однако к профильной инициативе частные детективы относятся настороженно, не желая попасть под влияние МВД. В своих суждениях о высоких шансах подконтрольности ведомству они ссылаются на опыт принятия законопроекта № 3726 в 2017 году.

Полицейские и сейчас зачастую обращаются за помощью к бывшим коллегам. Разыскать угнанный автомобиль без использования городских и национальных систем видеонаблюдения детективу непросто. Однако экспертное сообщество, в частности специалисты общественной организации "Всеукраинская ассоциация частных детективов" (ВАЧД), уверены, что зависимость от МВД будет губительна для частного сыска.
