An individual contract must be concluded with each employee of the internal affairs bodies, establishing the rights and obligations of both the police and law enforcement agencies. Approved by the Minister of Internal Affairs of Russia Rashid Nurgaliev, the approximate form of such an agreement was registered with the Ministry of Justice on January 31.
Before the reorganization of the police into the police, the form of an individual contract was determined only for the heads of units of the Ministry of Internal Affairs of Russia (GUVD, RUVD, departments, etc.). The Federal Law “On Service in the Internal Affairs Bodies of the Russian Federation ...”, which entered into force on January 1 of this year, provides for a contract system for all police officers. The legislators delegated the definition of the approximate form of such an agreement to the ministry itself.
According to the form approved by Rashid Nurgaliev, employees are obligated to be sworn in to faithfully fulfill official duties, orders and orders of managers, observe official discipline, established restrictions and prohibitions, not to disclose confidential information, etc. Also, the police officer undertakes at least a month for years to fulfill obligations not stipulated by his job description (provided that his salary is maintained), to inform the head of all changes in marital status, place of residence, etc. In addition, by signing a contract, the employee agrees with the so-called rotation - the possibility of transferring him to another equivalent position, including in another locality. Failure entails a demotion or dismissal for a policeman.
Depending on the status and other circumstances, the contract may be urgent or be concluded for an indefinite period, as well as provide for the obligation of a cadet (student) of a departmental university to enlist in the police after its completion, etc.
At the same time, the rights of the parties are not specified in the new form of the contract - the relevant provisions refer to current legislation, other regulations, job descriptions, etc. In particular, the agreement does not even determine the amount of monetary allowance, the composition of social guarantees, the grounds for termination, etc. . d.
The contract must be concluded in two copies - the first is transferred to the employee himself, the other is stored in his personal file.

С каждым работником органов внутренних дел должен заключаться индивидуальный контракт, устанавливающий права и обязанности как полицейского, так и правоохранительного ведомства. Утвержденная министром внутренних дел России Рашидом Нургалиевым примерная форма такого соглашения 31 января прошла регистрацию в Минюсте.
До реорганизации милиции в полицию форма индивидуального контракта была определена только для руководителей подразделений МВД России (ГУВД, РУВД, отделов и пр.). Федеральный закон «О службе в органах внутренних дел РФ...», вступивший в силу с 1 января этого года, предусматривает контрактную систему для всех полицейских. Определение примерной формы такого договора законодатели делегировали самому министерству.
Согласно утвержденному Рашидом Нургалиевым бланку, на сотрудников возлагается обязанность быть верными присяге, добросовестно выполнять служебные обязанности, приказы и распоряжения руководителей, соблюдать служебную дисциплину, установленные ограничения и запреты, не разглашать конфиденциальную информацию и т. д. Также полицейский обязуется не менее месяца в течение года выполнять не предусмотренные его должностной инструкцией обязанности (при условии сохранения жалованья), информировать руководителя обо всех изменениях в семейном положении, месте жительства и пр. Кроме того, подписывая контракт, сотрудник соглашается с так называемой ротацией – возможностью его перевода на иную равнозначную должность, в том числе в другую местность. Отказ влечет для полицейского понижение или увольнение.
В зависимости от статуса и иных обстоятельств контракт может быть срочным или заключаться на неопределенный период, а также предусматривать обязанность курсанта (слушателя) ведомственного вуза поступить на службу в полицию после его окончания и т. д.
При этом в новой форме контракта права сторон не конкретизируются – соответствующие положения ссылаются на действующее законодательство, иные нормативные акты, должностные инструкции и т. д. В частности, в соглашении не определен даже размер денежного довольствия, состав социальных гарантий, основания для расторжения и т. д.
