The Ministry of Justice said: on September 20, an order will come into force that will determine the order of interaction between law enforcement agencies and the FSSP to search for debtors and their property.
The joint order of the Ministry of Justice and the Ministry of Internal Affairs determines the behavior of police officers when they assist the bailiffs in the course of enforcement proceedings, including in the search for the debtor, his property, as well as in the search for the respondent citizen on the basis of a judicial act in a civil case.
For example, employees of the State traffic inspectorate will inform debtors who are stopped at the wheel that their car is wanted at the request of the FSSP. After that, they will collect information about the driver’s place of residence and the parking space of the car. In addition, the bailiffs will team up with the traffic police to identify the debtors' wanted vehicles in the traffic stream. Employees of the Ministry of Internal Affairs will also assist the bailiffs in evicting the debtor, vacating the non-residential premises, land, demolishing the building, building or structure or their individual structures.
The territorial bodies of the FSSP and the Ministry of Internal Affairs will organize an exchange of information, which, if technically possible, will be carried out using a single system of interagency electronic interaction, and if this is not possible, by exchanging documents on paper.

Вступает в силу новый порядок розыска должников

Минюст сообщил: 20 сентября вступает в силу приказ, который определит порядок взаимодействия правоохранительных органов и ФССП по поиску должников и их имущества.
Совместный приказ Минюста и МВД определяет порядок поведения сотрудников полиции, когда те оказывают содействие приставам в ходе исполнительного производства, в том числе при розыске должника, его имущества, а также при розыске гражданина-ответчика на основании судебного акта по гражданскому делу.
Например, сотрудники Госавтоинспекции будут сообщать остановленным за рулем должникам о том, что их автомобиль находится в розыске по запросу ФССП. После этого они соберут информацию о месте жительства водителя и парковочном месте автомобиля. Кроме того, судебные приставы объединятся с сотрудниками ГАИ для выявления в транспортном потоке разыскиваемых транспортных средств должников. Сотрудники МВД также окажут приставам содействие при выселении должника, освобождении нежилого помещения, земельного участка, при сносе строения, здания или сооружения либо их отдельных конструкций.
Территориальные органы ФССП и МВД организуют обмен информацией, который при наличии технической возможности будет осуществляться с использованием единой системы межведомственного электронного взаимодействия, а в случае отсутствия такой возможности – путем обмена документами на бумажном носителе.
