Role of private detectives to fire workers.​

Employers have the burden of proof to prove the justified termination of employment, for which they must offer the appropriate evidence at trial.

Article 47 of the LFT establishes the grounds for which an employer can justifiably dismiss a worker, without responsibility; However, in the event of a labor lawsuit, it is obliged to prove the worker's conduct and if it conforms to the assumptions of said numeral (art. 784, section IV, LFT).

Therefore, you must collect all the necessary evidence to establish that the dismissal is unjustified; This in practice becomes difficult, since the person will have to allocate time and personnel to carry out the necessary investigations, distracting himself from his main activities.

Faced with this situation, the doubt arises whether it is feasible or not to hire private investigators, in order to verify the causes of dismissal, and whether the evidence obtained by them is valid or not.

In a labor lawsuit, all kinds of evidence are admissible, as long as they are not contrary to morality and law, and especially: documentaries; the testimonials; the confessional; the experts; the means provided by scientific discoveries (photographs, audio and video recordings, different information and communication technologies, electronic mail), among others (art. 776, LFT).

Hiring a private detective implies establishing a professional service relationship, through which said subject, in exchange for a certain payment in money, will dedicate himself to collecting the evidence required by the employer. For example, to verify: theft of tools, supplies or information; gender violence; bullying or harassment; unfair competition; Documents forgery; poor labor performance or quality in the elaboration of products, in a malicious way; industrial espionage; unexcused absenteeism.

Although the LFT does not limit the source of obtaining the employer's evidence, and it also has the power to monitor and control, they must be collected legally, since article 776 of said ordinance provides that they will not be contrary to the law; that is, those that are collected in violation of fundamental rights or freedoms, will not be valid in the trial.

Consequently, the employer, among other requirements, must observe the following:

  • the investigation does not involve workplace harassment towards the employee
  • not misleading the worker
  • preserve the fundamental right of the worker to the protection of their privacy and personal data
  • not violate the collaborator's private communications
  • the investigation does not restrict rights (any) of the subordinate, and
  • is not a means of exerting control over union affairs
It should be noted that this form of obtaining evidence is not new, since in various countries the services of private detectives are used, and even in labor proceedings, their reports and their testimony are received after conducting the investigation.

Papel de detectives privados para despedir a trabajadores.​

Los patrones tienen la carga probatoria de acreditar la rescisión laboral justificada por lo que deben ofrecer en el juicio las pruebas idóneas.

El artículo 47 de la LFT establece las causales por las cuales un patrón puede despedir a un trabajador justificadamente, sin responsabilidad; sin embargo, en caso de un juicio laboral, está obligado a acreditar la conducta del trabajador y si esta se ajusta a los supuestos de dicho numeral (art. 784, fracc. IV, LFT).

Por ende, debe recabar todas las pruebas necesarias para hacer constar que el despido es injustificado; esto en la práctica se torna difícil, pues aquel tendrá que destinar tiempo y personal para hacer las pesquisas necesarias, distrayéndose de sus actividades principales.

Ante esta situación, surge la duda si es viable o no contratar investigadores privados, con el fin de comprobar las causales del despido, y si las pruebas obtenidas por estos son o no válidas.

En un juicio laboral, son admisibles todo tipo de pruebas, siempre que no sean contrarias a la moral y al derecho, y en especial: las documentales; las testimoniales; las confesionales; las periciales; los medios aportados por los descubrimientos por la ciencia (fotografías, grabaciones de audio y de video, distintas tecnologías de la información y la comunicación, correo electrónico), entre otras (art. 776, LFT).

Contratar a un detective privado, implica entablar una relación de servicios profesionales, a través de la cual, dicho sujeto, a cambio de un pago cierto en dinero, se dedicará a recabar las pruebas requeridas por el patrón. Por ejemplo, para comprobar: robos de herramientas, de suministros o de información; violencia de género; acoso u hostigamiento; competencia desleal; falsificación de documentos; bajo rendimiento laboral o de calidad en la elaboración de productos, de forma dolosa; espionaje industrial; absentismo injustificado.

Si bien la LFT no limita la fuente de la obtención de las pruebas del empleador, y además este tiene la facultad de vigilancia y control, aquellas deben ser recolectadas legalmente, pues el artículo 776 de dicho ordenamiento prevé que no serán contrarias al derecho; es decir aquellas que se recaben con violación a los derechos o libertades fundamentales, no serán válidas en el juicio.

En consecuencia, el empresario, entre otros requisitos, debe observar lo siguiente:

  • la investigación no implique acoso laboral hacia el empleado
  • no haber inducido al error al trabajador
  • preservar el derecho fundamental del trabajador a la protección de su intimidad y datos personales
  • no violar las comunicaciones privadas del colaborador
  • la pesquisa no restrinja derechos (cualquiera) del subordinado, y
  • no sea un medio para ejercer control sobre temas sindicales
Cabe precisar que esta forma de obtención de pruebas no es nueva, pues en diversos países se recurre a los servicios de los detectives privados, e inclusive en el juicio laboral se reciben los informes de estos y su testimonio tras realizar la investigación.
