Okhta Center opponents awaited in court
The consideration of the cassation appeal of the opponents of the Okhta Center, which was to be held in the City Court of St. Petersburg on July 19, was declared invalid and postponed until August 3.

Противников "Охта-центра" ждут в суде
Рассмотрение кассационной жалобы противников "Охта-центра", которое должно было состояться в Городском суде Санкт-Петербурга 19 июля, было признано не состоявшимся и перенесено на 3 августа.
С таким заявлением выступил лидер петербургского отделения "Яблока" Борис Вишневский.
Слушание не состоялась, так как другой заявитель жалобы просто не явился в Горсуд. Не явившимися оказались член петербургского регионального совета "Яблока" Михаил Амосов и адвокат противников "Охта-центра" Нина Поправко, пишет "Закс.ру".
Напомним, что ранее лидеры петербургского "Яблока" Михаил Амосов, Борис Вишневский, Максим Резник и Николай Рыбаков, а также активистка движения "Охтинская дуга" Анна Чернова просили Смольнинский суд Петербурга признать незаконным решение городского правительства о предоставлении разрешения на отклонение от предельных параметров разрешенного строительства ОАО "Общественно-деловой центр "Охта".

В начале июля суд отказал заявителям в удовлетворении их требований, после чего истцы подали жалобу в Городской суд.

"Решение о строительстве "Охта-центра" нарушало законодательство. Сейчас президент показывает исполнение закона, что, конечно, приветствуется. Все исторические виды, панорамы – памятники градостроительному искусству. Если высотные регламенты в Петербурге будут нарушены, мы получим то, что сейчас имеем в Москве, где виды безнадежно испорчены, - рассказал Роман Цеханский, член Экспертно-консультативного совета при главном архитекторе Москвы. – Нам не хотелось бы такого в Северной столице. Петербург должен быть привлекателен для туристов, ничего современное не должно «вылезать», портить панораму. Особенность и историческая ценность города охраняются законом. Если современное здание не будет отклоняться от расчетной единицы и нарушать высотных регламентов, почему бы его не построить даже в центре Петербурга? Мнение о том, что высота здания в 403 метра приемлема и красива, достаточно субъективно, которое недопустимо. Нужно действовать в рамках закона».

Артем Хромов, руководитель молодежной организации «Справедливая Россия» рассказал корреспонденту Finam.info: "Возмущения, которые адресованы в адрес Охта-центра, достаточно серьезные, и при его строительстве корректировки будут необходимы. Кроме того, международное сообщество в лице ЮНЕСКО заявляло о внесении определенных поправок, на что городские власти ответили согласием. Поэтому мне кажется, что все предложения будут учтены, иначе Петербург может лишиться своего статуса, что чревато ущербом как для города, так и для государства. Соответственно, гражданский протест должен привести к положительным результатам. Если жалобу отклонят, недовольство дойдет до более высших инстанций. Все-таки культурное наследие должно быть превыше финансовых интересов".

Артем Хромов добавил, что на судьбу строительства Охта-центра должна повлиять сессия комитета Всемирного наследия при ЮНЕСКО, которая будет проходить с 25 июля по 3 августа в Бразилии, где на повестку дня будет поставлен вопрос об историческом центре Санкт-Петербурга. За прошедший год идеологам возведения Охта-центра необходимо было скорректировать план возведения здания. Если вопрос не решен, город могут частично исключить из объекта Всемирного наследия ЮНЕСКО. Жители Петербурга сейчас находятся в напряжении, так как по некоторым данным идеологи из Северной столицы на мероприятие в Бразилию не поедут. К чему это приведет, станет ясно после 3 августа.

The government of St. Petersburg allowed its construction in September 2009. This was made possible thanks to the mechanism of deviation from the rules: developers can obtain permits for the construction of buildings of the height they need if they prove the feasibility of the project. Non-governmental organizations, the Ministry of Culture of the Russian Federation, Rosokhrankultura and UNESCO opposed the construction of a Gazprom Neft skyscraper on the right bank of the Neva.

In May, the presidential administration supported the position of UNESCO, which stated the need to consider alternative altitude options for the Okhta Center. The corresponding letter was sent to a number of departments, including the government of St. Petersburg. Городской суд Петербурга подтвердил законность строительства "Охта-центра"
Городской суд Санкт-Петербурга 3 августа утвердил решение Смольнинского районного суда по иску противников строительства небоскреба "Охта-центр". Истцы требовали признать незаконным постановление городских властей, которые, несмотря на правила землепользования и застройки, разрешили девелоперу отклониться от установленного высотного регламента. Об этом сообщает РИА Новости со ссылкой на одного из истцов - Николая Рыбакова.

По словам Рыбакова, пока суд огласил только резолютивную часть. Он также отметил, что судебное решение будет обжаловано в президиуме городского суда.

"Охта-центр", доминантой которого станет здание высотой 403 метра (при допустимых по правилам землепользования и застройки 100 метрах), планируется построить в непосредственной близости от исторического центра города. Правительство Петербурга разрешило его возведение в сентябре 2009 года. Это стало возможно благодаря механизму отклонения от правил: застройщики могут получить разрешения на строительство зданий нужной им высоты, если докажут целесообразность проекта. Против возведения небоскреба компании "Газпром нефть" на правом берегу Невы выступили общественные организации, Минкультуры РФ, Росохранкультура и ЮНЕСКО.

В мае администрация президента РФ поддержала позицию ЮНЕСКО, которая заявила о необходимости рассмотреть альтернативные варианты высотности "Охты-центра". Соответствующее письмо было направлено в ряд ведомств, в том числе в правительство Петербурга. Пресс-секретарь президента Наталья Тимакова заявила, что в письме не содержится указаний, какое решение должно быть принято, а напоминается о необходимости соблюдать международные обязательства России в области сохранения культурного наследия.

В конце июля Конституционный суд (КС) России постановил применять градостроительное законодательство в вопросе возведения 403-метрового небоскреба с учетом правовых норм о сохранении культурного наследия. Как сообщалось, этим определением суда должны будут руководствоваться другие судебные инстанции при рассмотрении жалоб на строительство здания. При этом КС не стал выносить каких-либо конкретных решений по поводу "Охты-центра", так как подобные вопросы не находятся в его юрисдикции.

В июле также стало известно, что ЮНЕСКО и власти Петербурга могут провести совместную экспертизу проекта высотки. Губернатор Валентина Матвиенко ранее заявляла, что решение о строительстве небоскреба будет принято только после проведения госэкспертизы РФ. В середине июля Главгосэкспертиза РФ вынесла положительное заключение по результатам инженерных изысканий на территории предполагаемого строительства "Охта-центра". В конце июля эксперты приступили к анализу архитектурной части проекта.
