Strictly speaking, the legality of any detective work in Russia today is in question because of the legal paradox. The fact is that the investigator’s main tool - external monitoring or simply surveillance of a citizen - can be carried out only with his personal consent, moreover, in writing. But the severity of laws, as usual, is tempered by their failure to comply. Therefore, they are being watched on the street and at home, with and without consent.
Slippery methods of work of detectives often turn into a headache not only for the object of surveillance, but also for the customer. Konstantin started his business with a friend. At first, everything went well, the company got on its feet, there was a serious profit. But from some point on, the companion began to behave strangely. "Recently, some strange calls have begun, his absence is regular, business trips, that is, I did not understand what was happening," says entrepreneur Konstantin.
Konstantin suspected: the partner was cheating on him. To find out for sure, he turned to private detectives, instructing them to find out what caused the companion's strange behavior. Fears have not been confirmed. However, the unexpected happened: a friend identified the detectives and promised to contact the police if they did not call the customer.
In schools of private detectives, the rule applies: first of all, students are taught the legal fundamentals of the craft, they are told what can be done and what can never be done. But, having barely received a diploma, many forget this particular, most important part. "They listen to conversations, scan information and technical communication channels. But these people are not detectives, they are just homegrown criminals by law. They provide such services on the black market. But not a single detective does this," says the chairman of the school’s scientific and pedagogical council training of private detectives Alexander Kolyasinsky.
Svetlana has been engaged in private investigation for many years. He says that it is possible to fulfill the task, and not break the law. For example, every citizen has the right to install a video recorder on the car and, within the framework of guaranteed freedom of movement, follow any route. And the fact that another car constantly looms ahead is simply an accident.
An object exits the car for just a minute, without even closing it - a critical mistake. After a few seconds, a writing bookmark bug is already lying under the seat. And the detective is breathing in the back again. "The light is on, the video is on. We are going to shoot the object. We just have a key ring from the car, this does not cause any suspicion," says private detective Svetlana.
"A normal practicing detective who values his reputation, his honor, his freedom, in the end, will never do what these illegal detectives are doing," said the head of the detective agency Oleg Pytov.
However, the line between legality and illegality is very shaky here. As a rule, customers are not at all interested in the legality of methods. They need a result. Therefore, as such, the black and white market of detective agencies simply does not exist. “For the first half of 2011, we conducted 84 inspections of the activities of private detectives, as a result of which licenses were revoked from 73 private detectives,” says Dmitry Lazarev, deputy head of the public order department of the Ministry of Internal Affairs of Russia.
The reason is not difficult to understand: a detective who acts strictly within the law will simply be left without a clientele. Since the customer is willing to pay precisely for breaking the law. And if the service is in demand, there will always be those who provide it.

"В последнее время начались какие-то непонятные звонки, его отсутствие регулярное, командировки, то есть я не понимал, что происходит", - рассказывает предприниматель Константин.
Константин заподозрил: партнер обманывает его. Чтобы узнать наверняка, обратился к частным детективам, поручив им узнать, чем вызвано странное поведение компаньона. Опасения не подтвердились. Однако случилось непредвиденное: приятель вычислил сыщиков и пообещал обратиться в милицию, если те не назовут заказчика.
В школах частных детективов действует правило: первым делом слушателей обучают юридическим основам ремесла, рассказывают, что делать можно, а чего ни в коем случае нельзя. Но, едва получив диплом, многие забывают именно эту, самую важную часть. "Прослушивают разговоры, сканируют информацию и технические каналы связи. Но эти лица не детективы, а просто доморощенные преступники по законодательству. Они оказывают такие услуги на черном рынке. Но ни один детектив на это не идет", - говорит председатель научно-педагогического совета школы подготовки частных детективов Александр Колясинский.
Светлана занимается частным сыском уже много лет. Говорит, можно и задачу выполнить, и закон не нарушить. Например, каждый гражданин имеет право установить на машину видеорегистратор и в рамках гарантированной свободы передвижения следовать любым маршрутом. А то, что впереди постоянно маячит другой автомобиль, это просто случайность.
Объект выходит из машины буквально на минуту, даже не закрыв ее, - критическая ошибка. Через несколько секунд под сиденьем уже лежит пишущий жучок-закладка. А детектив снова дышит в спину. "Огонек горит, видеосъемка идет. Мы идем снимаем объект. У нас в руках просто брелочек от машины, это ни у кого не вызывает никакого подозрения", - рассказывает частный детектив Светлана.
"Нормальный практикующий детектив, который дорожит своей репутацией, своей честью, своей свободой, в конце концов, никогда не будет делать то, что делают вот эти нелегальные детективы", - уверен руководитель детективного агентства Олег Пытов.
Впрочем, грань между легальностью и нелегальностью здесь бывает очень зыбкой. Заказчиков, как правило, совершенно не интересует законность методов. Им нужен результат. Поэтому как такового черного и белого рынка детективных агентств попросту не существует. "За первое полугодие 2011 года нами проведено 84 проверки деятельности частных детективов, по результатам которых у 73 частных детективов отозваны лицензии", - рассказывает заместитель начальника управления ГУ охраны общественного порядка МВД России Дмитрий Лазарев.
Причину понять несложно: сыщик, который действует сугубо в рамках закона, попросту останется без клиентуры. Поскольку заказчик готов платить именно за нарушение закона. А если услуга востребована, всегда найдутся те, кто ее окажет.
