ПРОВЕРКА ПЕРСОНАЛА

Проверка персонала....Занимаемся этими вопросами достаточно длительное
время,оказывая услуги частного сыска....Свыше 15 лет....В основном оказываем
помощь в данном вопросе на абонентской основе предприятиям малого и микро-
бизнеса (численностью личного состава до 100 человек). Вот недавно обратился один
наш коллега-частный детектив, с вопросом об особенностях организации проведения
подобных мероприятий.....Долго рассказывал ему об этих особенностях,которые
показались ему интересными и о некоторых он не знал ....Исходя из того,что тема эта
может быть интересна не только ему, решил вот немного обобщить, так
сказать, имеющийся опыт организации подобной работы для того, что бы те
лица, которые занимаются проверкой персонала знали об особенностях данных
мероприятий, регламентированных, в числе других Законов, и Трудовым Кодексом
РФ.... А «особенностей» не мало.... Конечно лицам, которые постоянно, в силу
возложенных на них работодателем обязанностей (сотрудники кадровых
подразделений, служб безопасности предприятий), безусловно знают об этом... Однако
некоторым лицам, в том числе и частным детективам эти особенности могут быть и не
известны... Так в чем же особенности.... А особенности в следующем...
Как общеизвестно, проверкой персонала (кроме конечно лиц, которые являются
сотрудниками организаций, в которых осуществляется проверка-кадровики, служба
безопасности), могут заниматься только лицензированные частные детективы, в
соответствии со ст.3 Закона о частной детективной и охранной деятельности в
РФ, оказывающие подобную услугу на основании гражданско-правового договора с
предприятием, которому оказывается подобная услуга....
При этом следует учитывать тот фактор, что существуют определенные различия в
оказании услуг по сбору сведений относительно субъектов предпринимательской
деятельности (юридические лица или индивидуальные предприниматели) и сбором
сведений относительно физического лица-работника предприятия или
лица, претендующего на заключение трудового договора.... Тут дело как раз в том, что
деятельность по сбору сведений относительно субъектов предпринимательской
деятельности в принципе ничем не регламентирована и никаких фактических
ограничений не имеет.... А деятельность по сбору сведений относительно физического
лица-работника или лица, претендующего на получение работа четко регламентирована
нормами права - Трудовым Кодексом РФ и другими Законами, о которых будет указано
ниже.... Исходя из этого нужно как раз учитывать эти особенности... Наверное основной
особенностью в данном вопросе является тот фактор, что относительно субъектов
предпринимательской деятельности, при проведении его проверки никакого
разрешения от субъекта проверки на сбор и обработку сведений о нем не требуется.... И
проверка может быть осуществлена с использованием любых общедоступных
источников без ограничения.... При этом сам объект проверки-субъект
предпринимательской деятельности, не обязан предоставлять о себе проверяющему
лицу (естественно, если это лицо-не представитель исполнительной власти), какие либо
сведения о себе.....
В отличии от этого, объект проверки-физическое лицо (работник предприятия или
лицо, поступающее на работу), в соответствии с требованиями п.3 ч.1 ст.86 ТК РФ сам
предоставляет о себе работодателю различную информацию, необходимую для
заключения трудового договора с определенными ограничениями, естественно.... При
этом получать о работнике какие либо сведения из других источников возможно только
в случае, если их можно получить не от самого работника, а от третьей стороны....При
этом на получение подобных сведений работник должен дать письменное согласие в
определенной письменной форме, соответствующей требованиям п.4 ст.9 Закона «О
персональных данных».... Существует и еще много особенностей... Подробнее обо всем
этом будет указано ниже.... Говоря простым языком - работник сам должен предоставить
работодателю (конечно при необходимости и по требованию работодателя), например
сведения о судимости (работник может получить эти сведения в виде справки в МВД по
соответствующему запросу, составленному самим работником), сведения о наличии
кредитов (эти сведения может получить сам работник в виде выписки, выдаваемой по
запросу самого работника БКИ), ответить на вопросы составленной работодателем
анкеты и пр..... Таким образом в обязанность «проверяющего», в соответствии с
нормами права, в том числе и ТК РФ, в принципе входит не свободный сбор каких либо
сведений относительно работника, а проверка достоверности сведений, указанных о себе
самим работником в документах, оформляемых при поступлении на работу....
Итак, рассмотрим то, что есть по данной теме... (сам не писал, в связи с тем, что уже
существуют описанные другими лицами наработки).... Надеюсь, будет полезно...

«…..Информация о сотруднике, позволяющая оценить его личностные и деловые
качества, необходима каждому работодателю для построения трудовых отношений с
подчиненным. Однако к порядку сбора таких данных законодательство (и не только
трудовое) предъявляет довольно жесткие требования.
Согласно ст. 85 Трудового кодекса Российской Федерации (далее ТК РФ) персональные
данные – это информация, необходимая работодателю в связи с трудовыми
отношениями и касающаяся конкретного работника. В гл. 14 ТК РФ сформулированы
основные требования, предъявляемые законодателем к обработке персональных
данных, то есть к процессу их сбора, хранения, передачи или любого другого
использования.
В данном материале речь пойдет об их получении и проверке. Ведь именно с этими
процедурами работодателю в первую очередь приходится иметь дело при приеме нового
сотрудника, и с ними же связано большинство нарушений в сфере использования
личной информации.
Все сведения, которые работодатель вправе потребовать от сотрудника или соискателя,
должна иметь непосредственное отношение к трудовому процессу. Собирать данные о
личной, частной жизни гражданина (наличие судимостей, жилищные условия,
вероисповедание, подробные сведения о родственниках и т. п.) работодатели, без
письменного разрешения на их сбор соискателя или работника не полномочны.
Что же должен проверить кадровик у соискателя, чтобы понять, соответствует ли он
требованиям, предъявляемым к должности, на которую претендует? Прежде всего надо
удостовериться в наличии у будущего работника необходимых документов,
перечисленных в ст. 65 ТК РФ. К ним относятся:
• паспорт гражданина РФ или иной документ, удостоверяющий его личность;
• трудовая книжка (за исключением случаев, когда трудовой договор заключают
впервые или работник поступает на работу на условиях совместительства);
• страховое свидетельство государственного пенсионного страхования;
• документы воинского учета – для военнообязанных и лиц, подлежащих призыву на
военную службу;
• документ об образовании, о квалификации или о наличии специальных знаний – при
поступлении на работу, требующую специальной подготовки.
Приведенный перечень закрытый, но в некоторых случаях, предусмотренных
законодательством, при поступлении на работу необходимо предъявить
дополнительные документы. Так, работодатель вправе потребовать у подростка, не
достигшего возраста 18 лет, справку о состоянии его здоровья. Дело в том, что в
означенном случае закон допускает существование трудовых отношений только тогда,
когда состояние здоровья человека это позволяет и данный факт подтвержден в
установленном порядке медицинским заключением (ст. 213 ТК РФ).
Отдельным работодателям может понадобиться не совсем обычная информация,
например документ о прохождении обязательной государственной дактилоскопической
регистрации – для поступающих на службу в органы внутренних дел, внешней
разведки, федеральные органы налоговой полиции и налоговой службы (ст. 9
Федерального закона от 25.07.98 № 128-ФЗ «О государственной дактилоскопической
регистрации в Российской Федерации»).
Однако надо иметь в виду, что подобного рода бумаги работодатель вправе требовать
только в случаях, прямо предусмотренных федеральными законами, указами
Президента РФ и постановлениями Правительства РФ.
Примеров, когда персональные данные играют существенную роль при заключении
трудового договора и в процессе труда, великое множество. Процесс получения таких
сведений должен быть предельно корректным и осуществляться в строгих правовых
рамках.
Информация о личности содержится не только в документах, перечисленных в ст. 65
ТК РФ. Будущий работник может сообщить сведения о себе в устной форме, через
анкеты, резюме, другие недокументальные источники. Надо сказать, что ни резюме, ни
анкеты не имеют установленной формы (не являются документом в строгом смысле
этого слова). Представляют определенный интерес лишь изложенные в них сведения.
Добывая информацию о работнике, сотрудникам кадровых служб необходимо помнить
о том, что ТК РФ запрещает получать и обрабатывать персональные данные о
политических, религиозных и иных убеждениях человека, его частной жизни.
Информацию о частной жизни работника можно добывать только тогда, когда она
непосредственно связана с вопросами трудовых отношений. Кроме того, необходимо
наличие письменного согласия сотрудника на сбор таких сведений. Поэтому, если
соискатель не желает сообщать, например, страдают ли его родственники
алкоголизмом или наркоманией, заставить его выдать такую информацию вы не
можете. Если для работодателя это крайне важно, он должен получить от сотрудника
согласие на такие действия в письменной форме и приготовиться доказать в случае
судебного разбирательства, что, во-первых, согласие было добровольным, а во-вторых,
затребованные сведения непосредственно связаны с работой.
Как правило, работодатель при первом знакомстве с кандидатом на вакантную
должность просит его показать резюме. Чаще всего оно содержит биографические
данные человека, сведения об образовании и опыте работы (профессиональный
портрет соискателя). Как было сказано выше, резюме не является документом и его
предъявление при приеме на работу необязательно. А значит, отсутствие резюме не
влечет за собой никаких правовых последствий для соискателя. Тем более что
практически вся информация, обычно включаемая в резюме, доступна через другие
источники (предыдущие места работы отражены в трудовой книжке, а о карьерных
достижениях соискатель может сообщить устно или через анкету).
Общий принцип получения персональных данных, закрепленный в ст. 86 и 88 ТК РФ,
гласит, что все персональные данные работника следует получать у него самого.
Однако тут же приведена оговорка: если такую информацию можно раздобыть только
при помощи третьей стороны, то работника уведомляют об этом заранее и от него
непременно должно быть письменное согласие. Работодатель тогда сообщает работнику
о целях, предполагаемых источниках и способе получения персональных данных, а
также об их характере и о последствиях отказа работника дать письменное согласие на
их получение.
Сведения о работнике, предоставляемые третьей стороной, также могут быть
выражены в различных формах, но, как правило, это официальный документ,
выданный правомочным органом. В таком случае не только важна информация,
содержащаяся в документе, но и сам документ должен отвечать определенным
требованиям (печать организации, подпись надлежащего должностного лица и т. п.).
Примером получения персональных данных от третьих лиц служит справка из органов
загса об изменении фамилии в том случае, если работник не может подтвердить этот
факт каким-либо другим документом.
Какими способами проверяют информацию о работнике? Если подходить к решению
данной задачи только с точки зрения законности, то вариантов здесь не так уж и много.
Первый вариант состоит в том, чтобы, детально изучив записи в трудовой книжке,
сопоставить их с другими имеющимися данными о работнике. Практика работы
кадровиков свидетельствует о том, что большинство нестыковок в информации
бывают обнаружены при анализе записей в трудовой книжке (насколько правильно
записи сделаны, какие стоят печати, является ли сам бланк представленной трудовой
книжки подлинным и пр.). В случае каких-либо сомнений за разъяснением надо
обратиться непосредственно к самому работнику.
Второй вариант – направление официального запроса от имени организации-
работодателя в соответствующие органы и организации (например, паспортный стол,
военкомат, вуз и т. д.) с целью подтверждения сведений, указанных в личной карточке
формы № Т-2.
Если информация, представленная работником при заключении трудового договора,
основана на заведомо ложных сведениях или содержится в подложных документах,
работодатель имеет полное право расторгнуть с ним трудовой договор (п. 11 ст. 81 ТК
РФ).
Действующее законодательство предусматривает довольно суровую ответственность
для работодателя за нарушение норм о работе с персональными данными. Ст. 90 ТК РФ
звучит так: «Лица, виновные в нарушении норм, регулирующих получение, обработку
и защиту персональных данных работника, несут дисциплинарную,
административную, гражданско-правовую или уголовную ответственность в
соответствии с федеральными законами». А в Кодексе об административных
правонарушениях этой теме посвящена статья 13.11. В ней говорится, что нарушение
порядка сбора, хранения, использования или распространения информации о
гражданах наказывается штрафом.
Не обойден вопрос защиты персональных данных и в уголовном законодательстве. В
Уголовном кодексе РФ предусмотрены в этом плане две статьи: ст. 137 «Нарушение
неприкосновенности частной жизни» и ст. 138 «Нарушение тайны переписки,
телефонных переговоров, почтовых, телеграфных или иных сообщений».
Напрашивается вывод: в законодательном порядке персональные данные ваших
сотрудников защищены от посягательств довольно надежно и серьезно.
И в заключение коснемся вопроса, который не напрямую, но очень тесно связан с
получением и проверкой персональных данных. Речь идет об отказе в приеме на работу,
решение о котором работодатель зачастую принимает под влиянием информации,
полученной из представленных соискателем документов или других источников. Ст. 3
ТК РФ гласит: никто не может быть ограничен в трудовых правах в зависимости от
пола, расы, цвета кожи, национальности, языка, происхождения, имущественного
положения и т. п. Запрет на отказ в заключении трудового договора по тем же
основаниям содержится в ст. 64 ТК РФ. Поэтому, какими бы ни были истинные
причины негативного отношения работодателя к соискателю, нельзя класть их в основу
отказа (тем более письменного) в приеме на работу. В таких случаях необходимо найти
законную и приемлемую причину (нехватка опыта, недостаточная квалификация,
неподходящее образование и т. п.). Тем более что Верховный суд РФ в своем
постановлении от 17 марта 2004 года № 2 «О применении судами Российской
Федерации Трудового кодекса Российской Федерации» указал, что, если работодатель
отказал в приеме на работу по обстоятельствам, связанным с деловыми качествами
данного работника, такой отказ является обоснованным.....».

проверке сведений о сотруднике следует отнестись особо..
Мы не будем акцентировать внимание на требованиях статей Трудового Кодекса РФ
( ст.86,88),о которых говорилось выше. Обратим особое внимание на порядок
оформление заявления работника о даче своего согласия на обработку персональных
данных,которые возможно будут подвергаться проверке,регламентированного ст.9
Закона «О персональных данных»....Как видно из ч.4 данной статьи « В случаях,
предусмотренных федеральным законом, обработка персональных данных
осуществляется только с согласия в письменной форме субъекта персональных данных.
Равнозначным содержащему собственноручную подпись субъекта персональных
данных согласию в письменной форме на бумажном носителе признается согласие в
форме электронного документа, подписанного в соответствии с федеральным
законом электронной подписью. Согласие в письменной форме субъекта персональных
данных на обработку его персональных данных должно включать в себя, в частности:
1) фамилию, имя, отчество, адрес субъекта персональных данных, номер основного
документа, удостоверяющего его личность, сведения о дате выдачи указанного
документа и выдавшем его органе;
2) фамилию, имя, отчество, адрес представителя субъекта персональных данных, номер
основного документа, удостоверяющего его личность, сведения о дате выдачи
указанного документа и выдавшем его органе, реквизиты доверенности или иного
документа, подтверждающего полномочия этого представителя (при получении
согласия от представителя субъекта персональных данных);
3) наименование или фамилию, имя, отчество и адрес оператора, получающего согласие
субъекта персональных данных;
4) цель обработки персональных данных;
5) перечень персональных данных, на обработку которых дается согласие субъекта
персональных данных;
6) наименование или фамилию, имя, отчество и адрес лица, осуществляющего
обработку персональных данных по поручению оператора, если обработка будет
поручена такому лицу;
7) перечень действий с персональными данными, на совершение которых дается
согласие, общее описание используемых оператором способов обработки персональных
данных;
срок, в течение которого действует согласие субъекта персональных данных, а также
способ его отзыва, если иное не установлено федеральным законом;
9) подпись субъекта персональных данных.».
Исходя из содержания данной статьи следует,что,кроме других требований
,предъявляемых законодателем при составлении письменного согласия на обработку и
проверку персональных данных,в заявлении должны быть отражены такие важные
обстоятельства,как перечень персональных данных,на обработку которых дает
согласие субъект персональных данных,перечень действий с персональными
данными,на совершение которых дается согласие,общее описание используемых
оператором способов обработки персональных данных....
Как показывает практика некоторые лица,осуществляющие проверку сведений о
работнике игнорируют данные требования....А ведь исходя из них,при даче согласия на
обработку персональных данных работником, лицо-инициатор проверки (работодатель)
должен рассказать субъекту проверки о том, какие способы он будет применять при
проверке ( в том числе и перечень возможных информационных ресурсов,с помощью
которых она возможно будет осуществляться),а также полный перечень всех
персональных данных,указанных субъектом проверке о себе (в том числе и фактов
судимости,наличия долговых обязательств и пр.). Однако,некоторые «проверяльщики»
осуществляют проверку работника или соискателя без наличия правильно
оформленного согласия на обработку персональных данных,описанного
выше... Используют при этом способы сбора информации, применимые для проверки
юридических лиц или индивидуальных предпринимателей, что в принципе не
допустимо....
Как показывает практика, наиболее эффективно использование при проведении
проверок определенной формы документов, в которых соискатель сам отражает о себе
определенную информацию, подлежащую проверке....
Для этого существует разработанная и утвержденная Постановлением Госкомстата
РФ от 05.01.2004 года № 1 форма личной карточки работника по форме Т-2, применение
которой в настоящее время правда не обязательно, но рекомендуемое кадровикам и
службам безопасности предприятий. Данная форма содержит в себе графы к
заполнению сведениями, указанными о себе соискателем или работником, а именно-
ИНН, СНИЛС, ФИО, дата и место рождения, гражданство, знание иностранного
языка, образование (с указанием образовательных учреждений), наличие
после вузовского профессионального образования, профессия, стаж работы, состояние в
браке, состав семьи, сведения о паспорте, адрес места жительства, (фактический и по
месту регистрации), дата регистрации по месту жительства, номера контактных
телефонов, сведения о воинском учете, сведения о приеме и переводе на другую
работу, сведения об аттестации и повышении квалификации, профессиональной
подготовке, наградах и поощрениях, отпусках и социальных льготах. Кроме этого, с
целью осуществления проверки персонала, работодатели могут ввести в рамках
существующего в данной форме раздела «Х» следующую дополнительную
информацию, подлежащую проверке о физическом лице, которую соискатель или
работник может сообщить о себе работодателю (практикуется работодателями).
1.Сведения о наличии - отсутствии у него судимости (проверяется предоставлением
соискателем или работником соответствующей справки из МВД)
2.Сведения о наличии каких либо кредитных обязательств перед кредитными
негосударственными учреждениями (проверяется предоставлением соискателем или
работником документом из БКИ(бюро кредитных историй))
3.Сведения о наличии - отсутствии кредитных обязательств перед гражданами либо
иными юридическими лицами (наличие возбужденных исковых производств в
Арбитражных судах или судах общей юрисдикции ) (проверяется по сведениям,
размещенным на портале ГАС Правосудие)
4.Сведения о наличии-отсутствии возбужденных исполнительных производств в
УФССП (проверяется предоставлением соискателем справки из ФССП по месту
регистрации соискателя или работника)
5.Сведения о наличии-отсутствии возбужденных уголовных дел в отношении
соискателя или работника,решение по которым еще не принято в установленном
законом порядке . (могут быть проверены с использованием общедоступных интернет -
сервисов МВД РФ, УФСИН РФ, УФССП РФ, но не в полном объеме)
6.Возможно включение и иных вопросов, на которые соискатель или работник согласен
ответить (например, наличие сведений о нем в социальных сетях и пр.)
Для проверки некоторых категорий сведений, сообщенных о себе соискателем или
работником работодателю, в принципе можно использовать ряд общедоступных
интернет-ресурсов (сведения из которых в принципе не являются официальными и не
могут быть использованы работодателем, в соответствии с действующими нормами
трудового законодательства при принятии решения о «судьбе» потенциального
соискателя или работника, без предоставления соответствующих
документов,полученных надлежащим образом). Полученные подобным образом
сведения носят чисто информационный характер, на основании которых можно
истребовать от соискателя или работника надлежащим образом оформленные
документы. Правда, некоторые из этих ресурсов не позволяют полностью.
идентифицировать объект проверки.... Но все же могут быть применены для
таковой... Естественно с письменного согласия проверяемого, оформленного
надлежащим образом в соответствии с действующим законодательством ( ст.9 Закона
«О персональных данных»).... На проверку лица по данным сервисам, из
практики,уходит до часа рабочего времени....
