The requirement for the head of a private security company to have a private security guard certificate may be excluded. The list of requirements for the post of head of a private security organization can be reduced. The corresponding bill1, developed by deputies Andrei Svintsov and Alexander Kropachev, was submitted to the State Duma.
It is proposed to free the head of a private security organization from excessive workload. To this end, it is planned to exclude the requirement that the head of a private security organization have a private security guard certificate. The developers of the bill believe that such an certificate is necessary for an ordinary employee to acquire legal status, but not necessarily for the head of a private security organization.
Recall that now the heads of security organizations along with private security guards must renew their private security guard certificates in five years. Such an extension is allowed after further training (Article 11.1 of the Law of the Russian Federation of March 11, 1992 No. 2487-I "On Private Detective and Security Activities in the Russian Federation"). The head of a private security organization must undergo training, pass qualification exams and undergo periodic inspections on a par with private security guards. Conformity of the qualifications of the heads of private security organizations with the changing conditions of professional activity and the social environment should be confirmed at least once every five years within the framework of the advanced training program (Section 2 of the Typical Additional Professional Program for the Heads of Private Security Organizations - "Advanced Training Program for the Heads of Private Security Organizations) ", approved. By Order of the Ministry of Internal Affairs of Russia dated July 2, 2014 No. 442).
In turn, the requirements for higher education and further professional education under the continuing education program for heads of private security organizations are planned to be maintained (Article 15.1 of the Law of the Russian Federation of March 11, 1992 No. 2487-I "On Private Detective and Security Activities in the Russian Federation" )
As noted in the explanatory note to the document, its adoption will free the head of a private security organization from undergoing procedures for obtaining documents that are not necessary for his status in the performance of official duties.

Требование наличия у руководителя ЧОП удостоверения частного охранника могут исключить. Перечень требований к должности руководителя частной охранной организации могут сократить. Соответствующий законопроект1, разработанный депутатами Андреем Свинцовым и Александром Кропачевым, внесен в Госдуму.
Предлагается освободить руководителя частной охранной организации от излишней служебной нагрузки. Для этого планируется исключить требование наличия у руководителя частной охранной организации удостоверения частного охранника. Разработчики законопроекта считают, что такое удостоверение необходимо рядовому сотруднику для приобретения правового статуса, но необязательно для руководителя частной охранной организации.
Напомним, что сейчас руководители охранных организаций наравне с частными охранниками должны через пять лет продлевать свои удостоверения частного охранника. Такое продление допускается после повышения квалификации (ст. 11.1 Закона РФ от 11 марта 1992 г. № 2487-I "О частной детективной и охранной деятельности в Российской Федерации"). Руководитель частной охранной организации должен проходить профессиональную подготовку, сдавать квалификационные экзамены и проходить периодические проверки наравне с частными охранниками. Соответствие квалификации руководителей частных охранных организаций меняющимся условиям профессиональной деятельности и социальной среды должно подтверждаться не реже одного раза в пять лет в рамках прохождения программы повышения квалификации (п. 2 Типовой дополнительной профессиональной программы для руководителей частных охранных организаций – "Программа повышения квалификации руководителей частных охранных организаций", утв. Приказом МВД России от 2 июля 2014 г. № 442).
В свою очередь, требования наличия высшего образования и получения дополнительного профессионального образования по программе повышения квалификации руководителей частных охранных организаций планируется сохранить (ст. 15.1 Закона РФ от 11 марта 1992 г. № 2487-I "О частной детективной и охранной деятельности в Российской Федерации").
Как отмечается в пояснительной записке к документу, его принятие позволит освободить руководителя частной охранной организации от прохождения процедур получения необязательных для его статуса документов при исполнении должностных обязанностей.
