Dear colleagues, the topic of my presentation is the interaction of private detectives and lawyers with the support of real estate transactions.
The relevance of this topic is due to the fact that during the crisis period the number of fraudulent and dishonest actions, including in the secondary real estate market, increases significantly.
The main risks (the use of the consequences of the invalidity of the transaction, the forced occupation of the acquired residential premises, etc.) are borne by the buyers of real estate. However, at present, risks are also increasing for other participants in the real estate market - notaries and realtors. This is due to the fact that the law introduced the property liability of notaries for the legality of certified real estate transactions. A similar responsibility of realtors will appear, obviously, in the near future, after the adoption of the law governing real estate activities.
To reduce such risks, a thorough analysis of the “legal history” of the acquired property is required.
In turn, to conduct an analysis, it is necessary to collect detailed information about the property, its owners and persons who could potentially challenge the transaction or present any other requirements related to the acquired property to the buyer of the property.
The collection of such information, in my opinion, may become one of the sought-after areas for the provision of detective services. From the point of view of the Federal Law "On Private Detective and Security Activities" such services can be attributed to the collection of information about business negotiations.
According to the experience of our bureau, when accompanying real estate transactions, the need for the services of private detectives may arise in the following cases:
- to obtain information about persons previously residing in the acquired apartment. The presence of such information allows, for example, to identify the risk that during the privatization of an apartment in the early 90s the rights of minors who were registered in this apartment were violated, did not participate in privatization and could potentially restore their violated rights in court and recognize void all subsequent transactions with the apartment;
- to search for contact details of previous property owners, their spouses. In the course of our work, we repeatedly faced the need to find out from one of the previous owners that he had actually signed a contract for the sale of an object several years ago or issued a power of attorney to conclude such an agreement. We also had a need to establish contact with the spouse of one of the owners in order to receive from her additional confirmation that the property was sold at the time with her consent;
- in establishing the circle of heirs whose inheritance rights could be violated. If the property was inherited, then there is always a risk that one of the heirs did not know about the opening of the inheritance, as a result did not receive its share, and will dispute the inheritance section in court without its participation.
- to identify various negative characteristics of the property, including criminogenic ones - you must admit that it is extremely unpleasant after moving to a new apartment to find that there is a drug counter nearby, which the seller of the apartment “tactfully” kept quiet, or unexpectedly meet a rowdy neighbor.
Thus, the support of real estate transactions is a field for the joint work of detectives, lawyers, notaries. And I invite you, colleagues, to work together in this direction.

Уважаемые коллеги, тема моего выступления – взаимодействие частных детективов и юристов при сопровождении сделок с недвижимостью.
Актуальность этой темы вызвана тем, что в период кризиса значительно увеличивается количество мошеннических и недобросовестных действий, в том числе на вторичном рынке недвижимости.
Основные риски (применение последствий недействительности сделки, принудительное вселение в приобретенное жилое помещение и др.) при этом несут покупатели недвижимости. Однако в настоящее время увеличиваются риски и у других участников рынка недвижимости – у нотариусов и риелторов. Это связано с тем, что законом введена имущественная ответственность нотариусов за правомерность удостоверяемых сделок с недвижимостью. Аналогичная ответственность риелторов появится, очевидно, в ближайшее время, после принятия закона, регламентирующего риелторскую деятельность.
Для снижения таких рисков необходим тщательный анализ «юридической истории» приобретаемого объекта недвижимости.
В свою очередь, для проведения анализа необходимо собрать подробную информацию об объекте недвижимости, о его собственниках и лицах, которые потенциально могут оспорить сделку или предъявить покупателю недвижимости какие-либо иные требования, связанные с приобретенным объектом.
Сбор такой информации, на мой взгляд, может стать одним из востребованных направлений оказания детективных услуг. С точки зрения ФЗ «О частной детективной и охранной деятельности» такие услуги можно отнести к сбору информации о деловых переговорах.
По опыту нашего бюро, при сопровождении сделок с недвижимостью потребность в услугах частных детективов может возникнуть в следующих случаях:
- для получения информации о лицах, ранее проживавших в приобретаемой квартире. Наличие такой информации позволяет, например, выявить риск того, что в ходе приватизации квартиры в начале 90-х годов были нарушены права несовершеннолетних, которые были зарегистрированы в этой квартире, не участвовали в приватизации и потенциально могут в судебном порядке восстановить свои нарушенные права и признать недействительными все последующие сделки с квартирой;
- для поиска контактных данных предыдущих собственников недвижимости, их супругов. В ходе работы мы неоднократно сталкивались с необходимостью выяснить у одного из предыдущих собственников, что он действительно несколько лет назад подписывал договор о продаже объекта или выдавал доверенность на заключение такого договора. Также у нас возникала необходимость установить контакт с супругой одного из собственников, чтобы получить от нее дополнительное подтверждение того, что имущество в свое время продавалось с ее согласия;
- при установлении круга наследников, чьи права на наследство могли быть нарушены. Если объект недвижимости переходил по наследству, то всегда существует риск того, что кто-то из наследников не знал об открытии наследства, в результате не получил свою долю, и будет оспаривать в суде раздел наследства без своего участия.
- для выявления различных негативных характеристик объекта недвижимости, в том числе криминогенных – согласитесь, крайне неприятно после переезда в новую квартиру обнаружить, что рядом расположен наркопритон, о котором продавец квартиры «тактично» умолчал, или неожиданно познакомиться с соседом-дебоширом.
Таким образом, сопровождение сделок с недвижимостью – это поле для совместной работы детективов, юристов, нотариусов. И я приглашаю вас, коллеги, к совместной работе в этом направлении.
