Senators submitted to the State Duma a bill on the transfer of the geodata to the police of missing people. This was reported by the Deputy Chairman of the Committee of the Council of the Federation on Constitutional Legislation and State Building Lyudmila Bokova.

According to the document, the Ministry of Internal Affairs will be able to receive information from mobile operators about the whereabouts of the missing person without a court order.
The authors of the draft law are a group of parliamentarians led by Federation Council speaker Valentina Matvienko. It included senators Andrei Klishas, Andrei Turchak, Lyudmila Bokova, Irina Geht and State Duma deputy Tatyana Kasaeva.
Amendments to the laws “On Communications” and “On Investigation Activities” establish that upon receipt of information about a missing person, a request for data on the location of his mobile phone will be made “without a court decision on the basis of a reasoned decision of one of the leaders” of the Ministry of Internal Affairs.
According to Bokova, the bill proposes in the Federal Law “On Communications” to include geolocation data to information about the communication services provided to the subscriber, securing the right of law enforcement agencies to receive this information, as well as provide for the right of the subscriber to transfer this data to third parties, for example, relatives and search engines.
In the Federal Law "On Operational Investigation Activities" it is proposed to establish that the receipt by law enforcement agencies of data about a subscriber without a court decision is allowed only to search for missing people. This should eliminate possible abuse.
In an explanatory note, the authors of the document provide information to the police that about 120,000 people disappear in Russia every year, 45,000 of whom are children. About 90% of those who disappeared upon disappearance carry a mobile phone with them, which remains on for the first two to three days from the start of the search.
The bill was prepared on behalf of the President of the Russian Federation of August 23, 2017. The document has already received positive conclusions from the expert and state legal departments of the president, the FSB, the Ministry of Internal Affairs and the Ministry of Communications.

Сенаторы внесли в Госдуму законопроект о передаче полиции геоданных пропавших без вести людей. Об этом сообщила зампредседателя Комитета Совета Федерации по конституционному законодательству и государственному строительству Людмила Бокова.

Согласно документу, МВД сможет получать от мобильных операторов сведения о местонахождении пропавшего человека без решения суда.
Авторы проекта закона – группа парламентариев, возглавляемая спикером Совета Федерации Валентиной Матвиенко. В нее вошли сенаторы Андрей Клишас, Андрей Турчак, Людмила Бокова, Ирина Гехт и депутат Госдумы Татьяна Касаева.
Поправки в законы «О связи» и «Об оперативно-розыскной деятельности» устанавливают, что при получении сведений о без вести пропавшем запрос данных о местоположении принадлежащего ему мобильного телефона будет производиться «без судебного решения на основании мотивированного постановления одного из руководителей» органов МВД.
По словам Боковой, законопроект предлагает в ФЗ «О связи» отнести геолокационные данные к сведениям об оказанных абоненту услугах связи, закрепив право правоохранительных органов на получение этой информации, а также предусмотреть право абонента передавать эти данные третьим лицам, например, родственникам и поисковикам.
В ФЗ «Об оперативно-розыскной деятельности» предлагается установить, что получение правоохранительными органами данных об абоненте без судебного решения допускается только для поиска пропавших людей. Это должно исключить возможные злоупотребления.
В пояснительной записке авторы документа приводят информацию полиции о том, что в России каждый год пропадает около 120 000 человек, 45 000 из которых — дети. Около 90% пропавших при исчезновении имеют при себе мобильный телефон, который остается включенным первые два-три дня с момента начала поисков.
