Star attorney Sergey Zhorin , who has more than 20 years of experience in resolving family disputes, in an exclusive interview with 5-tv.ru outlined the possible reasons tragedies in Bashkiria.
On December 26, a resident of Ufa, having learned from his wife about treason, left in an unknown direction in a car with his one-year-old daughter and six-year-old son. When the woman found the man's farewell note, she tried to call him. At that time, his mobile phone was already disconnected. Suspecting something was wrong, a resident of the Bashkir capital turned to law enforcement agencies. A few hours later, the bodies of two children and the head of the family with signs of gas poisoning were found in a car that was parked in the middle of a field in the Davlekanovsky district of the republic.
Sergei Zhorin noted that in this particular case the problem is much deeper and broader than it might initially seem. The lawyer in no way justifies the actions of a resident of Ufa, who made the decision to commit a crime, being, presumably, in an inadequate state. The lawyer emphasized that it is important to understand here what served as the so-called trigger and to try to protect the Russians, faced with such family troubles, from rash actions.

In Russia, unlike other countries, the adjudication of a court on a particular family issue does not directly depend on the degree of guilt of the husband or wife in the upcoming divorce. Our compatriots do not know about this and sincerely wonder why the judge does not take into account the many years of betrayal, the presence of a second family and children on the side. People are sure that such acts of partners are immoral and regard them as betrayal.
The fact that the court has no interest in family squabbles disappoints Russians, who have seen enough of such trials in Western films. It clearly demonstrates the practice that private detectives are involved in divorce proceedings, who present photos and videos of betrayals as evidence. Sergei Zhorin once again drew the attention of citizens to the fact that in our country such things have absolutely no meaning.
" I think this is unfair, because very often wives sincerely hope that they will live with their husbands all their lives. Women put their hearts and souls into creating comfort, raising children, and equipping their everyday life. They do not expect that everything will then have to be divided. Husbands most often exchange wives for young ones. It turns out that for several years the man has a different family in parallel and has children, the property is registered in the name of mothers, drivers and relatives. The court absolutely does not in any way investigate, through whose fault the family broke up, that the spouse behaved honestly and conscientiously towards her husband. This, in my opinion, is wrong, but legal! All that the court is interested in is irreparable contradictions due to which it is impossible to save the family. ", - states Sergei Zhorin.
The lawyer also drew attention to the fact that, despite the norms stipulated in family law on equal rights and obligations of both parents in relation to the child, in reality this is not entirely true. Russian courts leave children with their fathers only in exceptional cases. 99% of decisions about the child's further place of residence are made upon divorce in favor of the mother, and in most cases this is quite justified.
" In my practice, there have been times when the father is a respectable person who leads a healthy lifestyle, and the mother abuses alcohol and drugs. At the same time, a woman in a state of remission is absolutely adequate, and then she breaks down and goes all out. Despite this, the court in most cases leaves the child with the mother, since she is allegedly cured and everything is fine with her. This is wildness too ", - the lawyer notes.
Sergei Zhorin believes that the courts are afraid to go beyond the established practice due to possible suspicions of corruption. Although in some cases, it is obvious that the child will be much better with the father. The guardianship authorities also take the position of mothers, despite the equal rights of both parents.
Speaking about the Bashkir tragedy, Sergei Zhorin predicted how events might develop if the head of the family did not commit a crime. In the event of a divorce against the background of his wife's betrayal, a resident of Ufa would have to give her at least half of the jointly acquired property. The court would determine the place of residence of both children with their mother, and the man, in fact, would be thrown out of the family.
" There was a family, suddenly mom decided that dad was no longer needed, she was fine with another, and she had sex with him at a corporate party, and her husband went out. If they have the only housing, then a woman with children remains in it, and a man is looking for something for himself and pays alimony. From the point of view of fairness, this is an ambiguous situation. ", - Sergei Zhorin is sure.
The lawyer is confident that the glaring incident that happened the other day should serve as an impetus for the Russian legislative authorities to bring the law enforcement practice in the country to justice. Sergei Zhorin pointed out that it is high time in Russia to get away from formalism in resolving family disputes.

26 декабря житель Уфы, узнав от супруги об измене, уехал в неизвестном направлении на машине с годовалой дочерью и шестилетним сыном. Когда женщина нашла прощальную записку мужчины, она попыталась с ним созвониться. На тот момент его мобильный телефон уже был отключен. Заподозрив неладное, жительница башкирской столицы обратилась в правоохранительные органы. Спустя несколько часов, тела двоих детей и главы семейства с признаками отравления газами были найдены в автомобиле, который стоял посреди поля в Давлекановском районе республики.
Сергей Жорин отметил, что в конкретном случае проблема стоит гораздо глубже и шире, чем может изначально показаться. Юрист ни в коей мере не оправдывает действия жителя Уфы, который принял решение пойти на преступление, находясь, предположительно в неадекватном состоянии. Адвокат подчеркнул — здесь важно разобраться, что послужило так называемым триггером и постараться уберечь россиян, столкнувшихся с подобными семейными неурядицами, от необдуманных действий.
По словам Сергея Жорина, на страшные и трагические поступки людей толкает ощущение несправедливости. За свою практику адвокат выслушал немало доводов наших соотечественников, касающихся семейных проблем. Люди очень часто испытывают стресс и разочарование, что приводит к их психической неуравновешенности.
Как правило, клиенты юриста, в основном женщины, часами рассказывают об изменах мужей, их грубости и несправедливом отношении к себе. В определенный момент Сергей Жорин прерывает повествование о наболевшем и обращает внимание, что данные обстоятельства для суда не имеют никакого юридического значения, в том числе и в спорах по разделу имущества, а также для определения дальнейшего места жительства детей.

Там наглядно демонстрируется практика, что в бракоразводных процессах участвуют частные детективы, которые представляют в качестве доказательств фото и видеозаписи измен. Сергей Жорин еще раз обратил внимание граждан, что в нашей стране подобные вещи не имеют ровным счетом никакого значения.
«Я считаю это несправедливым, потому что очень часто жены искренне надеются, что всю жизнь проживут со своими мужьями. Женщины вкладывают сердце и душу в создание уюта, воспитание детей, обустраивают быт. Они не рассчитывают, что все потом придется делить. Мужья чаще всего меняют жен на молодых. Выясняется, что на протяжении нескольких лет у мужчины параллельно другая семья и есть дети, имущество оформлено на мам, водителей и родственников. Суд абсолютно никаким образом не исследует, по чьей вине распалась семья, что супруга честно и добросовестно вела себя по отношению к мужу. Это, на мой взгляд, неправильно, но законно! Все, что суд интересует, это неустранимые противоречия из-за которых сохранить семью невозможно», — констатирует Сергей Жорин.

Несмотря на это, суд в большинстве случаев оставляет ребенка с матерью, так как она якобы вылечилась и с ней все в порядке. Это тоже дикость», — отмечает адвокат.

Хотя в некоторых случаях, очевидно, что ребенку будет намного лучше с отцом. Органы опеки также занимают позицию матерей, несмотря на равные права обоих родителей.
