The Federal Antimonopoly Service (FAS Russia) Home Credit and Finance Bank LLC fined 100 thousand rubles for illegally sending SMS messages from the HomeCredit number advertising the bank's services.
Earlier, the FAS Russia Commission recognized the bank as a violation of the legislation on advertising when sending advertising SMS messages about new financial products, various promotions and offers, opening new offices. Without the consent of the subscriber, the distribution of SMS advertising is illegal.
The website of the Federal Antimonopoly Service recalls that in accordance with Part 1 of Article 18 of Federal Law dated 13.03.2006 No. 38-ФЗ “On Advertising” (hereinafter the Federal Law “On Advertising”) the distribution of advertising on telecommunication networks, including through the use of telephone, facsimile, mobile radiotelephone communication is allowed only with the prior consent of the subscriber or addressee to receive advertising.
At the same time, advertising is recognized as distributed without the prior consent of the subscriber or addressee, unless the advertising distributor proves that such consent was obtained.
In accordance with part 6 of article 38 of the Federal law “On advertising”, the advertising distributor is responsible for violating the requirements established by part 1 of article 18 of the Federal law “On advertising”.
Russians can appeal to the FAS with a complaint about receiving SMS - advertising, for which they did not give consent, the following must be attached to the complaint:
• a photo of the phone’s display with the message text, an e-mail printout, or an audio recording of the call;
• certified detailed statement from the telecom operator, confirming the receipt of an SMS-message, call.
In this case, it is necessary to pay attention to the contract for the provision of communication services. In many cases, it already contains consent to receive any SMS advertisement.

Без согласия абонента на получение SMS-рекламы - рассылка карается штрафом

На 100 тысяч рублей оштрафовала Федеральная антимонопольная служба (ФАС России) ООО «Хоум Кредит энд Финанс Банк» за незаконную рассылку SMS-сообщений от номера «HomeCredit» с рекламой услуг банка.
Ранее Комиссия ФАС России признала банк нарушившим законодательство о рекламе при рассылке рекламных SMS-сообщений о новых финансовых продуктах, различных акциях и предложениях, открытии новых офисов. Без согласия абонента распространение SMS-рекламы незаконно.
Сайт Федеральной антимонопольной службы напоминает, что в соответствии с частью 1 статьи 18 Федерального закона от 13.03.2006 № 38-ФЗ «О рекламе» (далее Федеральный закон «О рекламе») распространение рекламы по сетям электросвязи, в том числе посредством использования телефонной, факсимильной, подвижной радиотелефонной связи, допускается только при условии предварительного согласия абонента или адресата на получение рекламы.
При этом реклама признается распространенной без предварительного согласия абонента или адресата, если рекламораспространитель не докажет, что такое согласие было получено.
В соответствии с частью 6 статьи 38 Федерального закона «О рекламе» рекламораспространитель несет ответственность за нарушение требований, установленных частью 1 статьи 18 Федерального закона «О рекламе».
Россияне могут обратиться в ФАС с жалобой на получение SMS – рекламы, согласие на которое не давали, к самой жалобе необходимо приложить:
• фотографию дисплея телефона с текстом сообщения, распечатку электронной почты или аудиозапись звонка;
• заверенную детализированную выписку от оператора связи, подтверждающую поступление SMS-сообщения, звонка.
При этом, необходимо обратить внимание на договор по оказанию услуг связи. Во многих случаях в нем уже содержится согласие на получение любой SMS-рекламы.
