Thank you for allowing such a high rostrum.

Let's move on to the report.

The new criminal procedural legislation and the science of criminal procedural law have substantially changed the whole concept of criminal proceedings, which is aimed at implementing the principle of adversarial and equal rights of the parties.

From these positions, as well as taking into account the requirements of international organizations, it should be noted that there is a need to consolidate other legal means in the law aimed at protecting the legitimate interests of participants in the criminal process. As one of them, it is proposed to regulate in the Code of Criminal Procedure of the Russian Federation the collection by a private detective of information on a criminal case on a contractual basis with participants in the criminal process (paragraph 7 of part 2 of article 3 of the Law of the Russian Federation of March 11, 1992 "On private detective and security activities in Russian Federation").

Let us turn to the experience of detective work abroad. Private investigation has become widespread in the United States, Britain, Germany, Italy, Canada, France, Japan and other countries. In a number of countries, detectives are actively involved in the investigation of crimes, up to the production of individual investigative actions.

For example, in the United States, every citizen can hire a private detective to investigate any case. At the same time, a private detective can carry out non-procedural actions that could serve as the basis for bringing a person to criminal liability. Non-procedural actions are understood as follows: obtaining explanations from victims of the crime, eyewitnesses, as well as other persons who may be involved in the process as its participants; collection of items that can be used as evidence; requesting documents.

In some US states, private detectives are allowed to arrest suspects in a crime, search, seize, and use electronic surveillance. Moreover, the detective, acting without a court order, must be sure that the person detained by him has committed a crime. Otherwise, the court may fine him for a large sum of money for unjustified detention. The arrest procedure has one more peculiarity: a private detective, as a rule, does not have the right to interrogate the arrested person, but must transfer it to a police officer or judge.

In Germany, detectives and private detective agencies are involved in detective activities, with individual detective activity being given priority. Detectives are engaged in a private investigation of mainly crimes of an economic nature.

In the UK, a private detective usually works in conjunction with solicitor lawyers. Such cooperation is very productive and beneficial to the client and both parties. Solicitor, choosing a detective, sets before him

certain tasks as he leads the investigation. Detectives prosecute on the same grounds as the police. A detective has wide rights to investigate up to the arrest of a person who commits or has committed a crime, punishable by imprisonment for a term of at least 5 years.

Having collected enough information, the detective and the solicitor make a statement of charge on behalf of the customer. This means that the magistrate is informed of a crime in connection with which an order to summon a person to court is required.

As you can see, in foreign countries, private investigations are actively assisting state bodies in the fight against crime. At the same time, the state encourages the activity of private detective structures and detectives, regulates it legislatively and grants them extensive rights.

It seems that more than a century of experience in France, the USA, Great Britain and other countries in creating procedural conditions for detective work can be useful for Russia, which has historical, legal and factual conditions for this activity. However, this does not mean that today it is necessary to provide the Russian private investigators with the powers possessed by their foreign colleagues. As practice shows, blind copying often leads to negative results.

At various stages of the development of Russia, the state changed its attitude to private detective work - from complete denial to legislative authorization of the possibility of collecting information in favor of a participant in a criminal process on a contractual basis.

The law on private detective work in Russia was adopted twenty-four years ago. However, it is practically impossible to implement it, since the Criminal Procedure Code of the Russian Federation does not regulate this activity, and among some law enforcement officials there is an opinion that the detective’s participation in the collection of information on a criminal case will impede his investigation and may turn into a parallel investigation.

It seems that there are no grounds for such fears, since the detective’s activities should be carried out within the framework of the law and be aimed at obtaining objective information, which, subject to the stipulated criminal procedure conditions, can be converted into evidence in a criminal case. The process of checking the information collected by the detective and converting it into criminal procedural evidence requires legislative regulation in the Code of Criminal Procedure of the Russian Federation.

A number of participants in the criminal process (victim, suspect, accused, civil defendant, etc.) are entitled to collect and represent

written documents and objects for their inclusion in a criminal case as evidence. The CPC (Article 86), granting them this right, does not determine the methods of collecting and presenting documents and objects. Therefore, in cases where they themselves do not have the opportunity, for one reason or another, to collect documents and objects to protect their rights and interests, they can turn to a private investigator for help by concluding an agreement with him.

A private investigator, under an agreement with a participant in the process, can collect information for him, in particular, establish eyewitnesses to the crime, the location of objects and documents that can be attached to the criminal case as evidence.

In addition, by collecting information, the investigator can directly perceive facts and circumstances relevant to the criminal case, about which he can testify as a witness.

The information collected by the detective, not only can be of importance at the stage of investigation, but also serve as the basis for initiating a criminal case. An investigator may become irreplaceable when preparing materials on private prosecution cases.

It should be noted that he can collect information for both the prosecution and the defense, equalizing the rights of the parties.

The foregoing clearly demonstrates that the participation of a private investigator in a criminal process not only does not contradict its basic principles, but, on the contrary, serves as one of the guarantees for the realization by participants of criminal proceedings of their rights, contributes to solving problems and achieving the goals of justice.

The collection of information on a criminal case by a private investigator can be carried out only by a person having such a status. A private investigator is a citizen of the Russian Federation who works in a detective organization or who has received a license to carry out detective activities in the manner prescribed by law and registered as an individual entrepreneur.

To be recognized as a private investigator, it is necessary to obtain a license for non-state (private) detective activity. The licensing procedure is regulated by the Federal Law "On the Licensing of Certain Types of Activities", which entered into force on February 11, 2002.

The law establishes to whom a license for private detective activity is not issued:

- not reached twenty one years;

- registered with the health authorities regarding a mental illness;

- having a criminal record for committing an intentional crime;

- who have been charged with a crime (until the issue of guilt is resolved in the manner prescribed by law);

- dismissed from the civil service, from the judicial, prosecutorial and other law enforcement agencies on grounds of discrediting them;

- Former law enforcement officials who exercised control over private security and detective activities, if not a year has passed from the day of their dismissal.

The legality of private detective activity is ensured by legal restrictions that can be conditionally divided into five categories:

1) prohibitions on committing actions that threaten the rights and freedoms of man and citizen, since some of them are similar to the actions of subjects of criminal procedure and operational search activity:

- collection of information related to personal life, political and religious beliefs of individuals;

- video and audio recording, photo and film shooting in service and other premises without the written consent of the relevant officials or private individuals;

- actions encroaching on the rights and freedoms of citizens;

- actions that endanger the life, health, honor, dignity and property of citizens;

2) prohibitions to conceal from law enforcement information about impending or committed crimes;

3) bans on the actions of a private investigator contrary to the interests of his client:

- falsification of materials or misrepresentation of a client;

- disclosure of the collected information, its use for any purpose contrary to the interests of its client or in the interests of third parties;

4) prohibitions on actions of a certain nature:

- impersonating a law enforcement officer;

- transfer of your license for use by others;

5) prohibitions on engaging in other activities. Private detective activity should be the main activity of the detective, i.e. he must deal with it constantly and receive income precisely for providing detective services to clients. The ban on combining detective activity with the public service or elective paid position in public associations is specifically stipulated.

The Law regulating private detective activity (part 1 of article 5) provides an exhaustive list of methods for collecting information used in private detective activity: oral questioning of citizens and officials (with their consent), inquiries, study of objects and documents (with consent of their owners), external inspection of buildings, premises and other objects, monitoring to obtain the necessary information in order to provide services.

The information collected by a private investigator must meet certain conditions.

Firstly, the information relevant to establishing the circumstances to be proved must be relevant to the criminal case, in which an agreement was concluded with the participant in the process.

Secondly, contain an indication of the source of this information or item. If in the materials submitted by the private investigator, the information received by him is communicated impersonally, without indicating the source, it cannot be used in evidence.

Thirdly, it should be possible to verify the legality of their receipt: whether the specified type of private detective activity, as a result of which the information was received, is included in the list established by the Law of March 11, 1992 (paragraph 7 of Part 2 of Article 3); whether there were grounds for a private investigative action, in particular whether the established procedure for obtaining information was followed; whether measures were taken to collect information by an authorized person - a private detective organization or a private investigator.

Fourthly, the information received must contain data allowing them to be verified in the manner prescribed by the criminal procedure legislation.

After transferring this information to the process participant, he or she can transfer the report and other items and documents to the person conducting the criminal proceedings. In this case, a request for certain procedural actions may be filed.

Given the above, it seems appropriate to introduce an article in the Code of Criminal Procedure on a private investigator, his rights and obligations. In particular, to provide him with the right to conclude an agreement on the collection of information with participants in the criminal process referred to in parts 2 and 3 of art. 86 Code of Criminal Procedure. As a duty of the private investigator, indicate the need to inform the investigator (interrogator) about this within 24 hours from the moment of conclusion of the contract with the participant in the criminal process. In this case, indicate in the notification with which of the participants in the criminal process the contract and the subject of the contract are concluded.

Cognition of the circumstances of the crime can be carried out not only by representatives of state law enforcement agencies, but also by private detectives by collecting information on criminal cases on a contractual basis with participants in the process.

Such a right was granted to them by the Law of the Russian Federation “On Private Detective and Security Activities in the Russian Federation”, adopted on March 12, 1992. However, it is still practically impossible to realize this right for a private investigator, since until now in the criminal procedure

the code has not made the necessary amendments regarding its participation in the criminal process. At present, it is a convenient opportunity to fill this gap and make appropriate amendments to the draft Criminal Procedure Code. We will try to determine the nature and content of these additions.

First of all, it should be clarified what is the legal status of a private investigator in criminal proceedings. It seems that he can not be attributed to the number of participants in the criminal process, since he does not perform any of the procedural functions (criminal prosecution, defense, resolution of the case) and has no personal interest. He renders a service of collecting information on a criminal case to one of the participants in the process and acts within the framework of the agreement concluded with him and the requirements of the law “On Private Detective and Security Activities”. At the same time, he enters into certain criminal procedural relations with the person conducting the inquiry, the investigator, the prosecutor, or the court in whose proceedings the case is located, since the law obliges him to notify these persons in writing within 24 hours after concluding the contract with the participant in the process . Therefore, a private investigator should be attributed to the number of persons participating in the criminal process. These include witnesses, experts, witnesses, specialists, etc. However, unlike these individuals, a private detective is involved in the criminal process, as a rule, not at the initiative of law enforcement agencies, but on the basis of an agreement with a participant in the process.

Based on the foregoing, it is advisable to make the following addendum to the general part of the criminal procedure code (to the article containing explanations of certain items used in the code): “Private detective is a citizen of the Russian Federation legally engaged in detective work and has concluded an agreement to collect information in a criminal case with a criminal trial participant. ”

With which of the participants in the process is a private investigator entitled to conclude an agreement to collect information on a criminal case?

In the theory of the criminal process, all participants in the process are combined into two groups. The first includes state bodies and officials who carry out the proceedings and are vested with authority. These are: the body of inquiry, the investigator, the prosecutor, the judge and the court. The second group consists of citizens who defend their own or represented personal or public interests in criminal proceedings. It includes: the suspect, the accused, the defense counsel, the victim,

civil plaintiff, civil defendant and representatives of the victim. Civil plaintiff and civil defendant.

A private investigator has the right to conclude an agreement on the collection of information on a criminal case only with participants in the process included in the second group. This is due to the presence of all these participants in the common law process - to submit evidence. They can exercise this right in two ways - to personally detect them and transfer them to the preliminary investigation bodies and to the court, or turn to a private detective with a request to collect information that can be used as evidence in a criminal case.

In order for a private detective to exercise the right to conclude an agreement with the indicated participants in the process, an additional right should be introduced into the relevant articles of the new Code of Criminal Procedure defining their rights - conclude an agreement with a private detective to collect information on the criminal case.

Information provided by a private detective may be primarily associated with evidence and, under certain conditions, may become the content of one or another type of evidence. For example, a private investigator may establish eyewitnesses to a crime, the location of documents and objects that may subsequently be attached to a criminal case as evidence; during the inspection, observation, directly perceive facts and circumstances relevant to the case, which can be testified as a witness. The nature of this information is determined by the procedural position of the participant in the process, who entered into an agreement with a private detective, as well as the features of the procedural function performed by him, his legitimate interests. So, for example, the suspect, the accused and the defense counsel carry out the defense function in the criminal process. Hence it is quite natural that this circumstance will determine the nature of the information collected by a private detective. According to their content, they will be aimed at acquitting the suspect and the accused or mitigating their responsibility. Conversely, the victim's procedural activities are closely related to the function of criminal prosecution, and the efforts of the civil plaintiff and civil defendant are aimed at satisfying their civil law requirements related to the commission of the crime. These circumstances will determine the content of information collected at the initiative of these participants in the process. Therefore, a private detective can collect information, both in the interests of criminal prosecution, and defense.

The information collected by a private detective can also serve as a basis for investigative actions (interrogation of eyewitnesses of a crime identified by the detective, searches, seizures, etc.), as well as for applications by the participants of the process to challenge a judge, prosecutor, person conducting an inquiry, expert, translator, or to make well-founded complaints.

When collecting information on a criminal case, a private detective is not entitled to carry out investigative actions provided for in the Code of Criminal Procedure. For this purpose, the Law “On Private Detective and Security Activities” allows oral questioning of citizens and officials (with their consent), inquiries, examination of documents and objects (with the written consent of their owners). External inspection of buildings, premises and other objects, observation to obtain the necessary information. During the production of these actions, a private investigator is allowed to use video and audio recordings, film and photography, technical and other means that do not harm the life and health of citizens and the environment.

The information received by the private detective in agreement with the participant in the process can be transferred to him by the investigator, the person conducting the inquiry, the judge, or the participant in the process himself can do this, exercising his right to present evidence. Considering that the current criminal procedure law (Article 70 of the Code of Criminal Procedure) does not name a private investigator among those who have the right to present evidence, this gap should be eliminated in the new Code of Criminal Procedure and should be granted such a right.

The participation of a private detective in a criminal process by collecting information on a criminal case requires the solution of a number of procedural issues. First, before concluding an agreement on the collection of information on a criminal case, a private detective must make sure that the citizen is recognized as a participant in the process (suspect, accused, defense attorney, victim, civil plaintiff, civil defendant, representative).

For each of the indicated persons, the procedure for recognizing a participant in the process is defined by the criminal procedure law.

A suspect as a participant in the process appears from the moment of compiling a protocol for the detention of a suspect in a crime or

Decisions of the preliminary investigation body on the selection of a preventive measure in the form of detention pending indictment.

To recognize a person as a defendant, a reasoned decision of the investigator, the person conducting the inquiry, the investigator, and the prosecutor is necessary. On recognition of a person as a victim, civil plaintiff or civil defendant, the preliminary investigation bodies shall issue a ruling, and the court shall issue a ruling.

The basis for the participation of a lawyer as a defender is a warrant of legal advice. Relevant documents must have representatives of the victim, civil plaintiff and civil defendant.

Considering that a private detective must have this information before concluding an agreement with a participant in the process for collecting information on a criminal case, the criminal procedure code should specify the right of the detective to receive such information, and the preliminary investigation bodies and the court must be obliged to provide him such information.

Secondly, in the new Code of Criminal Procedure, it is necessary to duplicate the obligation of the private investigator, established by Section 3 of the Law “On Private Detective and Security Activities,” to notify the person conducting the inquiry in writing, the investigator, the prosecutor, or court in which the criminal case is being processed. In this case, the requirements for such a notification should be determined. Should a private detective report only the fact of the conclusion of the contract or the nature of the information that he must collect in accordance with this contract, is he obliged to inform the preliminary investigation authorities about the information received.

It seems that the written notice should indicate with which of the participants in the process a contract has been concluded and what is the subject of the contract. At the same time, we consider it inappropriate to require a private investigator to copy a contract or an explanation of how he will collect information on a criminal case in the interests of the client. This issue is subject to regulation of the law "On private detective and security activities."

Thirdly, it also requires legislative permission and the question of the possibility and necessity of interrogating a private detective as

witness. When deciding it, one should proceed from the general fundamental provisions on the status of a witness and the special provision of a private investigator that arises from his contractual obligations to a client, the violation of which may entail undesirable civil consequences for him.

The proposed amendments to the new Code of Criminal Procedure are not comprehensive in view of the lack of development of this issue. However, their introduction will be quite enough for the institution of participation of a private detective in the criminal process to “work” and the norms of two federal laws - “On Private Detective and Security Activities” and the Code of Criminal Procedure to be brought into line.

Given the constitutional provision that everyone has the right to protect their rights and freedoms by all means not prohibited by law, the participation of a private investigator in the criminal process will only increase the possibility of citizens having real access to justice. His participation may become one of the forms of additional protection of the rights and legitimate interests of citizens and organizations.

Перейдём к докладу.

Новое уголовно-процессуальное законодательство и наука уголовно-процессуального права существенно изменили всю концепцию уголовного судопроизводства, которая направлена на реализацию принципа состязательности и равноправия сторон.

С этих позиций, а также с учетом требований международных организаций следует констатировать, что назрела необходимость закрепления в законе иных правовых средств, направленных на защиту законных интересов участников уголовного процесса. В качестве одного из них предлагается регламентировать в УПК РФ сбор частным детективом сведений по уголовному делу на договорной основе с участниками уголовного процесса (п. 7 ч. 2 ст. 3 Закона РФ от 11 марта 1992 г. "О частной детективной и охранной деятельности в Российской Федерации").

Обратимся к опыту детективной деятельности за рубежом. Частный сыск получил широкое распространение в США, Великобритании, Германии, Италии, Канаде, Франции, Японии и других странах. В ряде стран детективы активно участвуют в расследовании преступлений, вплоть до производства отдельных следственных действий.

Например, в США каждый гражданин может нанять частного детектива для расследования любого дела. При этом частный детектив может производить непроцессуальные действия, которые могли бы послужить основанием для привлечения лица к уголовной ответственности. Под непроцессуальными действиями понимаются: получение объяснений у пострадавших от преступления, очевидцев, а также других лиц, которые могут быть привлечены к процессу в качестве его участников; собирание предметов, которые могут быть использованы в качестве вещественных доказательств; истребование документов.

В некоторых штатах США частным детективам разрешено производство арестов подозреваемых в совершении преступления, обыски, выемки, использование средств электронного наблюдения. Причем детектив, действуя без судебного ордера, должен быть уверенным, что задержанное им лицо совершило преступление. В противном случае за необоснованное задержание суд может оштрафовать его на крупную денежную сумму. В процедуре ареста есть еще одна особенность: частный детектив, как правило, не имеет права допрашивать арестованного, а должен передать его сотруднику полиции или судье.

В Германии сыскной деятельностью занимаются детективы и частные детективные агентства, причем приоритет отдается индивидуальной сыскной деятельности. Детективы занимаются частным расследованием в основном преступлений экономического характера.

В Великобритании частный детектив, как правило, работает совместно с адвокатами - солиситорами. Такая кооперация очень продуктивна и выгодна клиенту и обеим сторонам. Солиситор, выбрав детектива, ставит перед ним

определенные задачи, поскольку он руководит расследованием. Детективы осуществляют уголовное преследование на тех же основаниях, что и полиция. Детектив обладает широкими правами по расследованию вплоть до ареста лица, совершающего или совершившего преступление, влекущее наказание в виде лишения свободы на срок не менее 5 лет.

Собрав достаточно информации, детектив и солиситор делают от имени заказчика заявление об обвинении. Это означает, что магистрат ставят в известность о преступлении, в связи с которым требуется приказ о вызове лица в суд.

Как видим, в зарубежных государствах частный сыск оказывает активное содействие государственным органам в борьбе с преступностью. Государство при этом поощряет деятельность частных детективных структур и детективов, законодательно ее регулирует и предоставляет им обширные права.

Представляется, что более чем столетний опыт Франции, США, Великобритании и других стран в создании процессуальных условий для детективной деятельности может быть полезен и для России, имеющей для этой деятельности исторические, юридические и фактические условия. Однако это не означает, что уже сегодня следует предоставить российским частным сыщикам полномочия, которыми обладают их зарубежные коллеги. Как показывает практика, слепое копирование нередко приводит к негативным результатам.

На различных этапах развития России государство меняло отношение к частной детективной деятельности - от полного отрицания до законодательного разрешения возможности сбора сведений в пользу участника уголовного процесса на договорной основе.

Закон о частной детективной деятельности в России принят двадцать четыре года назад. Однако реализовать его практически невозможно, поскольку УПК Российской Федерации эту деятельность не регулирует, а среди некоторых работников правоохранительных органов бытует мнение, что участие детектива в сборе сведений по уголовному делу будет препятствовать его расследованию и может превратиться в параллельное следствие.

Представляется, что для такого рода опасений оснований нет, поскольку деятельность детектива должна осуществляться в рамках закона и быть направлена на получение объективной информации, которая при соблюдении предусмотренных уголовно-процессуальных условий может быть преобразована в доказательства по уголовному делу. Процесс проверки собранной детективом информации и преобразования ее в уголовно-процессуальные доказательства требует законодательного регулирования в УПК РФ.

Ряд участников уголовного процесса (потерпевший, подозреваемый, обвиняемый, гражданский ответчик и др.) вправе собирать и представлять

письменные документы и предметы для их приобщения к уголовному делу в качестве доказательств. УПК (ст. 86), предоставляя им это право, не определяет способы собирания и представления документов и предметов. Поэтому в тех случаях, когда они сами не имеют возможности в силу тех или иных причин собрать для защиты своих прав и интересов документы и предметы, то могут обратиться за помощью к частному сыщику, заключив с ним договор.

Частный сыщик по договору с участником процесса может собрать для него информацию, в частности установить очевидцев преступления, место нахождения предметов и документов, которые могут быть приобщены к уголовному делу в качестве доказательств.

Кроме того, собирая сведения, сыщик может непосредственно воспринимать факты и обстоятельства, имеющие значение для уголовного дела, о которых может дать показания на допросе в качестве свидетеля.

Сведения, собранные сыщиком, не только могут иметь значение в стадии расследования, но и послужить основанием для возбуждения уголовного дела. Незаменимым сыщик может стать при подготовке материалов по делам частного обвинения.

Следует заметить, что он может собирать сведения как для стороны обвинения, так и защиты, уравнивая права сторон.

Изложенное наглядно свидетельствует, что участие частного сыщика в уголовном процессе не только не противоречит его основным принципам, но, наоборот, служит одной из гарантий реализации участниками уголовного судопроизводства их прав, способствует решению задач и достижению целей правосудия.

Сбор сведений по уголовному делу частным сыщиком может производиться только лицом, имеющим такой статус. Частным сыщиком является гражданин Российской Федерации, работающий в сыскной организации или получивший в установленном законом порядке лицензию на осуществление сыскной деятельности и зарегистрированный в качестве индивидуального предпринимателя.

Для признания частным сыщиком необходимо получить лицензию на негосударственную (частную) сыскную деятельность. Порядок лицензирования регулируется Федеральным законом "О лицензировании отдельных видов деятельности", вступившим в силу с 11 февраля 2002 г.

Законом установлено, кому лицензия на частную сыскную деятельность не выдается:

- не достигшим двадцати одного года;

- состоящим на учете в органах здравоохранения по поводу психического заболевания;

- имеющим судимость за совершение умышленного преступления;

- которым предъявлено обвинение в совершении преступления (до разрешения вопроса о виновности в установленном законом порядке);

- уволенным с государственной службы, из судебных, прокурорских и иных правоохранительных органов по компрометирующим их основаниям;

- бывшим работникам правоохранительных органов, осуществлявшим контроль за частной охранной и сыскной деятельностью, если со дня их увольнения не прошел год.

Законность частной сыскной деятельности обеспечивается правовыми ограничениями, которые можно условно разбить на пять категорий:

1) запреты на совершение действий, ставящих под угрозу права и свободы человека и гражданина, поскольку некоторые из них сходны с действиями субъектов уголовно-процессуальной и оперативно-розыскной деятельности:

- сбор сведений, связанных с личной жизнью, с политическими и религиозными убеждениями отдельных лиц;

- осуществление видео- и аудиозаписи, фото- и киносъемки в служебных и иных помещениях без письменного согласия на то соответствующих должностных или частных лиц;

- действия, посягающие на права и свободы граждан;

- действия, ставящие под угрозу жизнь, здоровье, честь, достоинство и имущество граждан;

2) запреты скрывать от правоохранительных органов сведения о готовящихся или совершенных преступлениях;

3) запреты на действия частного сыщика вопреки интересам своего клиента:

- фальсификацию материалов или введение в заблуждение клиента;

- разглашение собранной информации, использование ее в каких-либо целях вопреки интересам своего клиента или в интересах третьих лиц;

4) запреты на действия определенного характера:

- выдачу себя за сотрудника правоохранительных органов;

- передачу своей лицензии для использования ее другими лицами;

5) запреты на занятие иной деятельностью. Частная сыскная деятельность должна быть у сыщика основным занятием, т.е. он должен заниматься ей постоянно и получать доходы именно за оказание сыскных услуг клиентам. Особо оговорен запрет на совмещение сыскной деятельности с государственной службой или выборной оплачиваемой должностью в общественных объединениях.

В Законе, регулирующем частную детективную деятельность (ч. 1 ст. 5), приведен исчерпывающий перечень методов сбора сведений, используемых в частной сыскной деятельности: устный опрос граждан и должностных лиц (с их согласия), наведение справок, изучение предметов и документов (с согласия их владельцев), внешний осмотр строений, помещений и других объектов, наблюдение для получения необходимой информации в целях оказания услуг.

Собранная частным сыщиком информация должна соответствовать определенным условиям.

Во-первых, сведения, имеющие значение для установления обстоятельств, подлежащих доказыванию, должны быть относимы к уголовному делу, по которому заключен договор с участником процесса.

Во-вторых, содержать указание на источник получения этой информации или предмета. Если в материалах, представленных частным сыщиком, полученная им информация сообщается обезличенно, без указания источника, она не может использоваться в доказывании.

В-третьих, должна существовать возможность проверить законность их получения: входит ли указанный вид частной сыскной деятельности, в результате которого получены сведения, в перечень, установленный Законом от 11 марта 1992 г. (п. 7 ч. 2 ст. 3); имелись ли основания для частного сыскного действия, в частности соблюден ли установленный порядок получения информации; проведены ли мероприятия по сбору сведений правомочным лицом - частной сыскной организацией или частным сыщиком.

В-четвертых, полученные сведения должны содержать данные, позволяющие проверить их в порядке, предусмотренном уголовно-процессуальным законодательством.

После передачи участнику процесса этой информации тот может передать отчет и другие предметы и документы лицу, осуществляющему производство по уголовному делу. При этом может быть заявлено ходатайство о проведении определенных процессуальных действий.

Учитывая изложенное, представляется целесообразным в УПК РФ ввести статью о частном сыщике, его правах и обязанностях. В частности, предоставить ему право заключения договора на сбор сведений с участниками уголовного процесса, указанных в ч. ч. 2 и 3 ст. 86 УПК. В качестве обязанности частного сыщика указать необходимость в течение суток с момента заключения договора с участником уголовного процесса сообщить об этом следователю (дознавателю). При этом в уведомлении указать, с кем из участников уголовного процесса заключен договор и предмет договора.

Познание обстоятельств совершенного преступления может осуществляться не только представителями государственных правоохранительных органов, но и частными детективами путем сбора сведений по уголовным делам на договорной основе с участниками процесса.

Такое право им предоставлено Законом РФ « О частной детективной и охранной деятельности в Российской Федерации», принятом 12 марта 1992 года. Однако реализовать это право частному детективу пока практически невозможно, так как до настоящего времени в уголовно-процессуальный

кодекс не внесены необходимые дополнения, касающиеся его участия в уголовном процессе. В настоящее время представляется удобный случай восполнить этот пробел и внести в подготавливаемый проект уголовно-процессуального кодекса соответствующие дополнения. Попытаемся определить характер и содержание этих дополнений.

Прежде всего, следует уяснить, каково правовое положение частного детектива в уголовном процессе. Представляется, что его нельзя отнести к числу участников уголовного процесса, так как он не выполняет ни одну из процессуальных функций (уголовного преследования, защиты, разрешения дела) и не имеет личного интереса. Он оказывает услугу по сбору сведений по уголовному делу одному из участников процесса и действует в рамках заключенного с ним договора и требований закона « О частной детективной и охранной деятельности». В то же время он вступает в определенные уголовно-процессуальные правоотношения с лицом, производящим дознание, следователем, прокурором или судом, в чьем производстве находится дело, так как закон обязывает его в течение суток после заключения договора с участником процесса письменно уведомить об этом указанных лиц. Поэтому частного детектива следует отнести к числу лиц, участвующих в уголовном процессе. К ним отнесены свидетели, эксперты, понятые, специалисты и т.п. Однако в отличие от указанных лиц частный детектив участвует в уголовном процессе, как правило, не по инициативе правоохранительных органов, а на основании договора с участником процесса.

С учетом изложенного, в общую часть уголовно-процессуального кодекса (в статью, содержащую разъяснения некоторых наименований, применяемых в кодексе) целесообразно внести следующее дополнение: «Частный детектив – гражданин Российской Федерации, занимающийся на законном основании детективной деятельностью, и заключивший договор на сбор сведений по уголовному делу с участником уголовного процесса».

С кем же из участников процесса частный детектив вправе заключить договор на сбор сведений по уголовному делу?

В теории уголовного процесса всех участников процесса объединяют в две группы. В первую входят государственные органы и должностные лица, которые осуществляют производство по делу и наделены властными полномочиями. Это: орган дознания, следователь, прокурор, судья и суд. Вторую группу составляют граждане, которые защищают в уголовном процессе свои или представляемые личные или общественные интересы. В нее входят: подозреваемый, обвиняемый, защитник, потерпевший,

гражданский истец, гражданский ответчик и представители потерпевшего. Гражданского истца и гражданского ответчика.

Частный детектив вправе заключить договор на сбор сведений по уголовному делу только с участниками процесса, входящими во вторую группу. Это обусловлено наличием у всех указанных участников процесса общего права – представлять доказательства. Указанное право они могут реализовать двояким образом - лично обнаружить их и передать в органы предварительного расследования и в суд или обратиться к частному детективу с просьбой собрать сведения, которые могут быть использованы в качестве доказательств по уголовному делу.

Для того, чтобы частный детектив мог реализовать право на заключение договора с указанными участниками процесса, в соответствующие статьи нового уголовно-процессуального кодекса, определяющие их права, следует внести дополнительное право – заключать договор с частным детективом на сбор сведений по уголовному делу.

Представляемые частным детективом сведения могут быть, прежде всего, связаны с доказательствами и при определенных условиях могут стать содержанием того или иного вида доказательств. Например, частный детектив может установить очевидцев преступления, места нахождения документов и предметов, которые в последующем могут быть приобщены к уголовному делу в качестве доказательств; в ходе осмотра, наблюдения непосредственно воспринимать факты и обстоятельства, имеющие значение для дела, о которых может дать показания на допросе в качестве свидетеля Характер этих сведений определяется процессуальным положением участника процесса, который заключил договор с частным детективом, а также особенностями выполняемой им процессуальной функции, его законными интересами. Так, например, подозреваемый, обвиняемый и защитник осуществляют в уголовном процессе функцию защиты. Отсюда вполне естественно, что этим обстоятельством будет определяться и характер сведений, собираемых частным детективом. По своему содержанию они будут направлены на оправдание подозреваемого и обвиняемого или смягчение их ответственности. И наоборот, процессуальная деятельность потерпевшего тесно связана с функцией уголовного преследования, а усилия гражданского истца и гражданского ответчика направлены на удовлетворение их гражданско-правовых требований, связанных с совершением преступления. Указанными обстоятельствами будет обусловлено содержание сведений, собираемых по инициативе этих участников процесса. Следовательно, частный детектив может собирать сведения, как в интересах уголовного преследования, так и защиты.

Собранные частным детективом сведения могут послужить также основанием для производства следственных действий ( допроса выявленных детективом очевидцев преступления, производства обысков, выемок и др.), а также для заявления участниками процесса ходатайств об отводе судьи, прокурора, лица, производящего дознание, эксперта, переводчика или для заявления обоснованных жалоб.

При сборе сведений по уголовному делу частный детектив не вправе производить предусмотренные уголовно-процессуальным кодексом следственные действия. В этих целях законом « О частной детективной и охранной деятельности» допускаются устный опрос граждан и должностных лиц (с их согласия), наведение справок, изучение документов и предметов (с письменного согласия их владельцев). Внешний осмотр строений, помещений и других объектов, наблюдение для получения необходимой информации. В ходе производства указанных действий частному детективу разрешается использовать видео- и аудиозапись, кино – и фотосъемку, технические и иные средства, не причиняющие вреда жизни и здоровью граждан и окружающей среде.

Полученные частным детективом сведения по согласованию с участником процесса могут быть переданы им следователю, лицу, производящему дознание, судье или же это может сделать непосредственно сам участник процесса, реализуя свое право на представление доказательств. Учитывая, что действующий уголовно-процессуальный закон (ст. 70 УПК), не называет частного детектива в числе лиц, имеющих право на представление доказательств, в новом уголовно-процессуальном кодексе этот пробел следует устранить и такое право ему предоставить.

Участие частного детектива в уголовном процессе путем сбора сведений по уголовному делу требует решения ряда процедурных вопросов. Во-первых, прежде чем заключить договор на сбор сведений по уголовному делу, частный детектив должен удостовериться в том, что данный гражданин признан участником процесса (подозреваемым, обвиняемым, защитником, потерпевшим, гражданским истцом, гражданским ответчиком, представителем).

Для каждого из указанных лиц уголовно-процессуальным законом определен порядок признания участником процесса.

Подозреваемый как участник процесса появляется с момента составления протокола задержания подозреваемого в совершении преступления или

постановления органа предварительного расследования об избрании меры пресечения в виде заключения под стражу до предъявления обвинения.

Для признания лица обвиняемым необходимо мотивированное постановление следователя, лица, производящего дознание, следователя, прокурора. О признании лица потерпевшим, гражданским истцом или гражданским ответчиком органы предварительного расследования выносят постановление, а суд – определение.

Основанием для участия адвоката в качестве защитника служит ордер юридической консультации. Соответствующие документы должны иметь представители потерпевшего, гражданского истца и гражданского ответчика.

Учитывая, что указанной информацией частный детектив должен располагать до заключения договора с участником процесса на сбор сведений по уголовному делу, то в уголовно-процессуальном кодексе должно быть прописано право детектива на получение такой информации, а на органы предварительного расследования и суд должна быть возложена обязанность предоставить ему такую информацию.

Во-вторых, в новом уголовно-процессуальном кодексе необходимо продублировать установленную статьей 3 закона «О частной детективной и охранной деятельности» обязанность частного детектива в течение суток с момента заключения контракта с участником процесса письменно уведомить об этом лицо, производящее дознание, следователя, прокурора или суд, в чьем производстве находится уголовное дело. При этом следует определить требования к такому уведомлению. Должен ли частный детектив сообщать только о факте заключения договора или же о характере сведений, которые он должен собирать в соответствии с этим договором, обязан ли он информировать органы предварительного следствия о полученной информации.

Представляется, что в письменном уведомлении должно быть указано, с кем из участников процесса заключен контракт и что является предметом договора. При этом полагаем нецелесообразным требовать от частного детектива копии договора или объяснения по поводу того, как он будет осуществлять сбор сведений по уголовному делу в интересах клиента. Этот вопрос является предметом регулирования закона « О частной детективной и охранной деятельности».

В-третьих, требует также законодательного разрешения и вопрос о возможности и необходимости допроса частного детектива в качестве

свидетеля. При его решении следует исходить из общих принципиальных положений о статусе свидетеля и тем особым положением частного детектива, которое вытекает из его договорных обязательств перед клиентом, нарушение которых может повлечь для него нежелательные гражданско-правовые последствия.

Предлагаемые дополнения в новый уголовно-процессуальный кодекс не носят всеобъемлющего характера в силу не разработанности данного вопроса. Однако и их внесения будет вполне достаточно для того, чтобы институт участия частного детектива в уголовном процессе « заработал» и нормы двух федеральных законов – «О частной детективной и охранной деятельности» и Уголовно-процессуального кодекса приведены в соответствие.

Учитывая конституционное положение о том, что каждый вправе защищать свои права и свободы всеми способами, не запрещенными законом, участие частного сыщика в уголовном процессе только повысит возможность реального доступа граждан к правосудию. Его участие может стать одной из форм дополнительного обеспечения защиты прав и законных интересов граждан и организаций.
