Inspection fraud will be criminalized
The Ministry of Economy has prepared a large-scale reform of inspection. Now the amendments are sent to the government, after which they will be submitted to the State Duma, informs Kommersant.
The amendments will affect several laws at once. The Code of Administrative Offenses is proposed to supplement liability for the management of transport, the maintenance of which has not been carried out or it has become known on the maintenance of vehicles that the transport does not meet safety requirements. The fine is supposed to be set at 800 rubles. MOT is now evaluating tinting, cracks on the glass, the presence of a warning triangle, and so on - only about 68 parameters.
At the same time, it is proposed to identify the violation, including without stopping the car, but with the help of cameras. The car will be checked by the Unified Automated Vehicle Inspection Information System (EAISTO). It is also proposed to provide insurers with recourse claims to car owners who have not passed MOT if an accident occurred due to a technical malfunction of the car.
Sanctions for maintenance operators are much stricter. Now the process of inspection of the car is proposed to be recorded on video, and the results themselves will be necessarily recorded in electronic form, with the electronic signature of an expert. In case of violations, experts face a fine of up to 10,000 rubles. These include admitting the machine to move without undergoing maintenance.
Moreover, if deliberately false information is deliberately entered into the database, then criminal liability will come: from forced labor to a prison term of up to two years, if the act was committed by a group of persons by prior agreement.
The activities of maintenance operators will be controlled by Rostransnadzor. At the same time, EAISTO is planning to transfer from the Ministry of Internal Affairs to the Russian Union of Auto Insurers, many experts already evaluate this decision as controversial. It is also reported that the project will be finalized, as part of the recourse claims raises questions.

За мошенничество с техосмотром введут уголовную ответственность
Министерство экономики подготовило проведение масштабной реформы техосмотров. Сейчас поправки направлены в правительство, после чего их внесут в Госдуму, сообщает «Коммерсантъ».
Поправки коснутся сразу нескольких законов. КоАП предлагают дополнить ответственностью за управление транспортом, ТО которого не проведен или на ТО стало известно, что транспорт не соответствует требованиям безопасности. Штраф предполагается установить на уровне 800 руб. ТО сейчас оценивает тонировку, трещины на стеклах, наличие знака аварийной остановки и так далее – всего около 68 параметров.
При этом нарушение предлагается выявлять, в том числе без остановки авто, а с помощью камер. Машину будут проверять по Единой автоматизированной информационной системе техосмотра (ЕАИСТО). Предлагается также наделить страховщиков обращаться с регрессными исками к автовладельцам, которые не прошли ТО, если ДТП произошло из-за технической неисправности авто.
Гораздо строже вводятся санкции для операторов ТО. Теперь процесс осмотра авто предлагается записывать на видео, а сами результаты ТО будут обязательно фиксироваться в электронном виде, с электронной подписью эксперта. В случае нарушений экспертам грозит штраф до 10 000 руб., к ним относится допуск машины к движению без прохождения ТО.
При этом, если в базу умышленно будут вноситься заведомо недостоверные сведения, то наступит уже уголовная ответственность: от принудительных работ до тюремного срока до двух лет, если деяние было совершено группой лиц по предварительному сговору.
Деятельность операторов ТО будет контролировать Ространснадзор. При этом ЕАИСТО планируют передать из МВД Российскому союзу автостраховщиков, многие эксперты уже оценивают такое решение спорным. Сообщается также, что проект будет доработан, так как часть с регрессными исками вызывает вопросы.
