Дело по факту принуждения к совершению сделки (ст. 179 УК) было возбуждено следственным управлением при УВД Юго-Западного округа Москвы в марте, рассказал «Ведомостям» адвокат миноритариев Павел Чугунов. Заявление в полицию несколько месяцев назад подала заместитель гендиректора «Энергострима» Татьяна Бондарева, подтвердил представитель холдинга. По его словам, «группа миноритариев предложила руководству “Энергострима” выкупить их доли <...> в сбытовых компаниях холдинга по цене, в 8 раз превышающей рыночную», а получив отказ, в течение двух лет «шантажировала менеджмент холдинга и размещала в интернете информацию, порочащую деловую репутацию компании, не гнушаясь личными оскорблениями в адрес руководства холдинга».
На прошлой неделе миноритарии сбытовых компаний «Энергострима» обратились с открытым письмом к руководителям Минэнерго, ФСФР и ряда других ведомств, а также премьеру Владимиру Путину, где выражали недовольство «творческим отношением» руководства холдинга к отражению прибыли в отчетности. По данным РСБУ за 2011 г. 13 компаний группы «Энергострим», их суммарная чистая прибыль составила 158 млн руб. при обороте в 138 млрд руб., т. е. чистая рентабельность равна 0,11% от оборота против 1–4% в среднем по сектору. При этом плата за управление, которая взимается холдингом, может в десятки и даже сотни раз превышать чистую прибыль сбытов: так, в «Ивэнергосбыте» она составила 207,6 млн руб. при 1000 руб. чистого убытка, а в «Орелэнергосбыте»– 164 млн руб. при 10 млн чистой прибыли. Также акционеры недовольны тем, что совокупная кредиторская задолженность сбытов достигла 62 млрд руб. и продолжает расти, а при снижении лимитов кредитования существенно возрастает вероятность банкротства не только единичных компаний, но и всей группы. Представитель «Энергострима» отказался комментировать эту информацию.
