The draft federal contract system (FCC) bill introduced by the government provides for a simplified procedure for spending budget funds in the fourth quarter of each year. About this in the issue of April 25 the newspaper Vedomosti writes, which managed to get acquainted with the document.
According to the bill on the FCC, during the last three months of each year, officials can make public procurements through requests for proposals. This form involves posting on the government procurement portal an application for the required product for three days. During this time, officials will receive offers from suppliers, after which they will choose the one they like best in price and quality.
According to the FCC, during the year state customers can use the request for proposals in cases where the competitive or auction procedure has failed. The Federal Antimonopoly Service, which considers it to be corrupt and requires replacing with mini-auctions, traditionally opposes the use of this form of public procurement.
According to the current legislation on public procurement, officials can buy most of the goods and services only through tender or auction procedures. The selection criteria for the supplier for both the tender and the auction are strictly regulated. In addition, officials can use the quotation request procedure, the only criterion of which is price, but the use of this scheme is limited.
The bill on the FCC was introduced to the government in April. Prior to that, he already got into the government in late autumn 2011, but was sent for revision. Then the document, developed by the Ministry of Economic Development, was criticized by the FAS and other departments. Antitrust monitors claimed that the bill was not viable and contained many corruption loopholes.
According to the newspaper Kommersant, the bill has now been approved and sent for examination to the state legal department. About 40 amendments have already been received to the document prepared by the Ministry of Economic Development, of which 25 were submitted by the FAS, and the rest by the Ministry of Finance and the Ministry of Health and Social Development.

Законопроект о "Федеральной контрактной системе" (ФКС), внесенный в правительство, предусматривает упрощенную процедуру расходования бюджетных средств в четвертом квартале каждого года. Об этом в номере от 25 апреля пишет газета "Ведомости", которой удалось ознакомиться с документом.
Согласно законопроекту о ФКС, в течение последних трех месяцев каждого года чиновники могут совершать государственные закупки с помощью запросов предложений. Эта форма подразумевает размещение на портале государственных закупок заявки о требуемом товаре на три дня. В течение этого времени чиновники будут получать предложения от поставщиков, после чего выберут наиболее понравившееся по цене и качеству.
Согласно ФКС, в течение года государственные заказчики могут использовать запрос предложений в тех случаях, когда конкурсная или аукционная процедура провалилась. Против использования такой формы госзакупок традиционно выступает Федеральная антимонопольная служба, которая считает ее коррупционной и требует заменить на мини-аукционы.
Согласно действующему законодательству о госзакупках, чиновники могут покупать большинство товаров и услуг только с помощью процедур конкурса или аукциона. Критерии отбора поставщика как для конкурса, так и для аукциона жестко регламентированы. Кроме того, чиновники могут использовать процедуру запроса котировок, единственным критерием которой является цена, но применение этой схемы ограничено.
Законопроект о ФКС был внесен в правительство в апреле. До этого он уже попадал в правительство в конце осени 2011 года, но был отправлен на доработку. Тогда документ, разработанный Минэкономразвития, подвергся критике со стороны ФАС и других ведомств. Антимонопольщики утверждали, что законопроект нежизнеспособен и содержит много коррупционных лазеек.
Как пишет газета "Коммерсантъ", в настоящее время законопроект одобрен и направлена на экспертизу в государственно-правовое управление. К подготовленному Минэкономразвития документу поступило уже около 40 поправок, из них 25 внесла ФАС, а остальные - Минфин и Минздравсоцразвития.
