A criminal investigation into the smuggling of mobile phones in Euroset has been resumed, said lawyer Marat Fayzulin. This is the case in which the former co-owner of the company Evgeny Chichvarkin was previously a witness. In January 2012, the case was dismissed due to the decriminalization of the article “smuggling”. According to Fayzulin, the decision to terminate the criminal case was canceled due to the lack of calculation of outstanding customs payments and the uncertainty of the fate of material evidence. The defense attorney considers these grounds for the reopening of the case and criminal prosecution of persons brought under an article that is already decriminalized illegal.
In the smuggling case, the accused are considered the executive director of the brokerage company that supplied mobile phones, including Euroset, Alexei Shirokov, as well as the head of the brokerage company located in Monaco, Yakov Ardashnikov. Earlier, several people had already been convicted in this case, including the former deputy head of the Sheremetyevo customs. Fayzulin recalled that Shirokov is still under recognizance not to leave, Ardashnikov also remains in Monaco under recognizance not to leave, and the extradition procedure continues against him.
The smuggling case was opened in 2005. Commenting on the termination of the criminal case in January, Chichvarkin noted that the companies never returned the evidence - $ 70 million phones. He expressed confidence that the case was opened in order to "steal these evidence." He added that he was not going to return to Russia, since the security forces who had opened the Euroset case were at large and “could open any other case at any other time.”

Возобновлено расследование уголовного дела о контрабанде мобильных телефонов в «Евросети», заявил адвокат Марат Файзулин. Это дело, по которому ранее свидетелем проходил бывший совладелец компании Евгений Чичваркин. В январе 2012 г. дело прекратили в связи с декриминализацией статьи «контрабанда». По словам Файзулина, постановление о прекращении уголовного дела было отменено из-за отсутствия расчета неуплаченных таможенных платежей и неопределения судьбы вещественных доказательств. Защитник считает незаконными эти основания для возобновления дела и уголовного преследования лиц, привлеченных по статье, которая уже декриминализована.
По делу о контрабанде обвиняемыми считаются исполнительный директор брокерской компании, поставлявшей мобильные телефоны, в том числе и «Евросети», Алексей Широков, а также находящийся в Монако руководитель брокерской компании Яков Ардашников. Ранее по этому делу уже были осуждены несколько человек, в том числе бывший замначальник шереметьевской таможни. Файзулин напомнил, что Широков по-прежнему находится под подпиской о невыезде, Ардашников остается в Монако также под подпиской о невыезде, и против него продолжается процедура экстрадиции.
Дело о контрабанде было возбуждено в 2005 г. Комментируя в январе прекращения уголовного дела, Чичваркин отметил, что улики — телефоны на $70 млн — компании так и не вернули. Он выразил уверенность, что дело было открыто для того, чтобы «украсть эти улики».
