Vimpelcom received a fine of 23.8 million rubles, Megafon 26.9 million rubles, MTS 41.6 million rubles, SMARTS 1.07 million rubles. This is 1% of the annual revenue of the Tatarstan branches of operators for 2010 (according to the Administrative Code of the Russian Federation, the agency could apply a fine of 1 to 15% of the company's annual revenue from the main activity).
In 2010, OFAS recognized the operators as violating paragraph 1 of Part 1 of Art. 11 of the Federal Law "On Protection of Competition", as it revealed that companies set higher tariffs for calls to landlines compared to tariffs for calls to cell phones. The Office refers to paragraph 33 of RF Government Resolution No. 328 of 2005, according to which telecom operators can differentiate tariffs only depending on the time of day and calendar days. “Such a policy discriminates against the work of fixed-line telecom operators, since it is more profitable for a subscriber to call on a cell phone,” Ivan Shcherbakov, after the hearing of the case, explained the UFAS deputy director for RT.
The operators have already tried to challenge the OFAS decision in the Tatarstan arbitration, but in January the court sided with the OFAS. Now the case is being considered in the 11th Arbitration Court of Appeal in Samara.
“This case may become a precedent for Russia. So far, no such cases have been filed in any region, but if the courts confirm the legality of the UFAS decision on the Republic of Tatarstan, according to the judicial practice, such decisions can be made throughout Russia, ”Shcherbakov told Vedomosti.

Сегодня татарстанское УФАС назначило штрафы сотовым операторам по делу об установлении разных тарифов на звонки на мобильные и стационарные устройства. «Вымпелком» получил штраф в 23,8 млн руб., «Мегафон» — 26,9 млн руб., МТС — 41,6 млн руб., СМАРТС — 1,07 млн руб. Это 1% от годовой суммы выручки татарстанских филиалов операторов за 2010 г. (согласно Административному кодексу РФ, ведомство могло применить штраф на сумму от 1 до 15% годовой выручки компании от основного вида деятельности).
В 2010 г. УФАС признало операторов нарушившими п. 1 ч. 1 ст. 11 ФЗ «О защите конкуренции», поскольку выявило, что компании установили более высокие тарифы для звонков на стационарные телефоны по сравнению с тарифами на звонки на сотовые телефоны. Эти тарифы в 2010 г. отличались в несколько раз, при том что технически соединение сотовых операторов со стационарными не отличается по стоимости от соединения с сотовыми. Например, звонок с «Билайна» по тарифу «Монстр общения» со второй минуты разговора на сотовые составлял 0,95 руб., на стационарные — 2,95 руб.
Ведомство ссылается на п. 33 постановления правительства РФ № 328 от 2005 г., согласно которому операторы связи могут дифференцировать тарифы только в зависимости от времени суток и календарных дней. «Такая политика дискриминирует работу операторов фиксированной связи, поскольку абоненту выгоднее звонить на сотовый телефон», — пояснил после слушания дела замруководителя УФАС по РТ Иван Щербаков.
Операторы уже пытались оспорить решение УФАС в татарстанском арбитраже, но в январе суд встал на сторону УФАС. Сейчас дело рассматривается в 11-м арбитражном апелляционном суде в Самаре.
«Это дело может стать прецедентным для России. Пока ни в одном регионе подобных дел не было, но, если суды подтвердят законность решения УФАС по РТ, согласно судебной практике подобные решения могут быть приняты и по всей России», — сказал «Ведомостям» Щербаков.
