He noted that in many cases inspections of MIA operatives are uncontrolled and are accompanied by the largest number of complaints. In addition, according to the prosecutor general, it is they who are associated with serious violations of rights: the illegal seizure of documents and other property of businessmen.
Recently, Chaika signed an order to create a special department in the Prosecutor General to oversee the observance of the rights of entrepreneurs. The new department will consist of a unit for the supervision of the enforcement of laws on protecting the rights of entrepreneurs and a unit for the supervision of the legality of inspections of control bodies, and this will be supervised by the first deputy attorney general Alexander Buksman.
An Interior Ministry official told Vedomosti that prosecutorial supervision methods can hardly prevent police inspections if they are carried out, for example, on reports of an offense or crime. According to him, it is at the verification stage that police usually “agree” with businessmen to terminate it in a bribe.

Генеральный прокурор России Юрий Чайка считает необходимым наделить прокуроров правом согласования проверок бизнес-структур. «Считаю, что настало время рассмотреть вопрос о наделении прокурора правом согласования проверок бизнес-структур, в том числе проводимых и субъектами оперативно-розыскной деятельности», — сказал Чайка, выступая в среду в Совете Федерации.
Он отметил, что именно проверки оперативников МВД во многих случаях проходят бесконтрольно и сопровождаются наибольшим количеством жалоб. Кроме того, по данным генпрокурора, именно они сопряжены с серьезными нарушениями прав: незаконным изъятием документов и другого имущества коммерсантов.
Недавно Чайка подписал приказ о создании в Генпрокуратуре специального управления по надзору за соблюдением прав предпринимателей. Новое управление будет состоять из подразделения по надзору за исполнением законов о защите прав предпринимателей и подразделения по надзору за законностью проверок органов контроля, а курировать это направление будет первый заместитель генпрокурора Александр Буксман.
Сотрудник МВД рассказывал «Ведомостям», что методами прокурорского надзора едва ли можно помешать полицейским проверкам, если их проводят, например, по сообщениям о правонарушении или преступлении. По его словам, именно на стадии проверки полицейские обычно и «договариваются» с бизнесменами о ее прекращении за мзду.
