Reading about the exciting adventures of a private investigator, we have no idea that at some point we ourselves can become the protagonist of a "detective" story. Search for stolen property or missing relatives, a suspicion that someone from the company’s employees “gives” confidential information to competitors, doubts about the fidelity of the second half ... This is not a complete list of situations that Sherlock Holmes will help to understand. Often in his work, a private detective has to literally balance on the verge between light and shadow, plunging into the stormy ocean of human vices, passions and secrets. Mystery of Mr. "X"
The famous business woman, let's call her Svetlana, adored her only daughter - the beautiful and clever Inna. The girl’s whole life was planned according to notes: a prestigious school, a university in the UK, a happy marriage with a young man from a “good family” ... However, Inna “broke” this scheme, falling madly in love with a new friend she met at a party. Svetlana did not like the potential son-in-law at all: neither her education, nor her condition, and even her strange behavior. The young man washed his hands for half an hour, from palms to elbows. The mother’s heart was not at ease, and the woman took a desperate step - she turned to a private detective with a request to collect as much information as possible about her future son-in-law.
The secret of Mr. “X” stunned Svetlana: it turned out that the guy was wanted by the police in a fraud case. In addition, he had an initial stage of mental illness - this was what explained his panic fear of germs and a half-hour hand wash. Another surprise: “future son-in-law” was already married, obviously, he did not plan to marry Inna, but had the goal of simply pulling money from a rich girl. Svetlana did not dare to pour all this dirt on the head of her daughter in love - she simply “mentally” talked with the new moon, advising him to break off relations with Inna. Otherwise, both his wife and law enforcement agencies will learn the whole truth about him. The man, having weighed all the pros and cons, quickly disappeared. Inna, after a little heat, subsequently met a guy really worthy of her hand and heart.
Car romance
The marriage of Vasily, the owner of a popular chain of stores, and his wife Lydia was very happy. Despite the fact that it was not possible to spend a lot of time with the family, the businessman sincerely believed his soul mate and he never had the slightest suspicion of her infidelity. And here from his acquaintances Vasily was surprised to hear that Lydia was leaving home somewhere for a rather long time every evening, and this had been going on for several months. For all interrogations of the concerned husband, the wife either laughed off, or simply was silent. In the end, this mystery began to get on the nerves of the businessman and he asked a private detective to find out where and with whom his missus was spending time. The truth was unexpected: a woman decided to surprise her husband and secretly from him ... attended a driver’s course. She wanted to triumph behind the wheel and unexpectedly demonstrate her brilliant driving skills. This story could well have a happy ending, but the "mysterious" wife gave her an unexpected continuation. After the detective investigation ended, Lydia ... fell in love with a driving instructor, got divorced and married him. The history of private detective work begins in France. When a hundred years ago, there was a surge in the growth of commercial fraud, the services of detectives became the need of the century. Realizing the full potential and range of detectives' capabilities, people began to address them with more serious problems (loss of expensive things, disappearance of relatives and friends, the search for criminals, family secrets), the solution of which required certain skills and abilities. All the affairs that were entrusted to the detectives were carried out quickly, efficiently and for a small fee.
Ukrainian scenario of private detective work
The history of Ukrainian detectives began after the collapse of the USSR. Now in Ukraine there are many private detective agencies. However, due to the lack of legislative regulation of their status, unaddressed at the state level of their clear rights and obligations, many modern Sherlock Holmes are not able to legalize their activities. However, for the past ten years they still promise to legitimize it, but so far - to no avail. Consequently, modern Holmes, numerous detective bureaus and single detectives operate semi-legally. Although this does not prevent the cash services market from developing rapidly.
Legalization of this activity will also allow using private detectives to solve crimes for which law enforcement agencies have “no time” or which are “unpromising”, and thus reduce the overall crime rate in Ukraine.
Now, detectives, acting under the law and faithfully paying taxes, are forced to disguise their activities. For example, some detective agencies are engaged in publishing and conduct investigative journalism to obtain information. After all, the journalist’s ID gives the detective more rights and authority to collect information. Detective agencies are also registered as consulting companies, advisory firms, security agencies or law firms.
From a legal point of view, in Ukraine, again, due to the lack of relevant legislation, we can say that it is not detective activity in general that is prohibited, but some of its elements. Namely, Art. 32 of the Constitution of Ukraine prohibits any interference in the personal and family life of citizens of Ukraine and does not allow the use of confidential information about a person without his consent.
A gap in the legislation regarding the elements of detective work has a significant impact on the lawyer's rights to collect evidence in criminal proceedings, which are now extremely limited. According to Art. 16-1 of the Code of Criminal Procedure of Ukraine, one of the principles of criminal procedure is adversarial proceedings in cases. At first glance, this principle of competition provides equal opportunities for all participants in the process: both on the defense and prosecution sides.
However, is this so in practice? I think that every lawyer will confirm that the prosecution and the defense side come to court with different “starting” opportunities for evidence in the case. The task of a lawyer very often comes down to the refutation of the prosecution and its arguments, providing doubt through a logically constructed link of reflection. However, in order for the defender to be able to fully perform his tasks, he must have a sufficient body of evidence justifying his client. And this can only be achieved by significantly expanding the rights of a lawyer at the stage of pre-trial investigation to collect evidence. Here, the lawyer, like a private detective, encounters the aforementioned Art. 32 of the Constitution of Ukraine.
In total, private detectives could have helped the lawyer, as well as law enforcement officials, to ensure the full collection of evidence and during the implementation of operational-search activities. By the way, this is how lawyers work in many countries of the world: Germany, France, the USA and Canada, where detectives have legal status. They have special tokens, like police officers, which give their owners the right to collect information for the investigation of certain crimes. In addition, private detectives significantly increase the percentage of solved crimes.
Different situations happen in life, but private detectives are always ready to help and do their job honestly, responsibly and professionally.
