11/23/2011 The State Duma adopted in the second and third final reading a law expanding the right of bailiffs to search for debtors, RIA Novosti reports.
In particular, the bill assumes that bailiffs will have the right to detain persons hiding from the court or investigation to transfer them to the police, as well as to attract debtors to search private detectives .
Prior to the adoption of the law "On Police," the authority to search for the debtor belonged to the Ministry of Internal Affairs.
The bill establishes that employees of internal affairs bodies are obliged to assist bailiffs in the course of enforcement proceedings, including in the search for the debtor, his property or the search for the child, as well as in the search for the respondent citizen in a civil case in the manner established by the joint regulatory legal act of the Ministry of Justice of Russia and the Ministry of Internal Affairs of the Russian Federation. According to the author of the adopted law, this is consistent with international practice.
In addition, the bill allows the use of private detectives to search for the debtor or child, which must be taken in accordance with the decision of the court. The involvement of a private detective will occur on a paid basis on the basis of an agreement with a recoverer.
“The participation of non-state actors in the search will increase the effectiveness of the search,” the explanatory note says.
Also, norms are introduced that oblige the credit institution servicing the debtor's accounts to immediately comply with the requirements for the recovery of funds and inform the collector or bailiff of this within three days.
The bill amends the Criminal Code, establishing liability for providing the bailiff with false information in the declaration of the property status of the debtor or for avoiding the provision of such information. Such a crime will be punished by a fine of up to 100 thousand rubles or by compulsory labor for a period of up to 180 hours.

23.11.2011 Госдума приняла во втором и третьем, окончательном, чтении закон, расширяющий право судебных приставов при поиске должников, передает РИА Новости.
В частности, законопроект предполагает, что судебные приставы получат право задерживать скрывающихся от суда или следствия лиц для передачи их полиции, а также привлекать к поискам должников частных детективов.
До принятия закона "О полиции" полномочия по поиску должника принадлежали МВД.
Законопроект устанавливает, что сотрудники органов внутренних дел обязаны оказывать содействие судебным приставам в ходе исполнительного производства, в том числе при розыске должника, его имущества или розыска ребенка, а также розыска гражданина-ответчика по гражданскому делу в порядке, установленном совместным нормативным правовым актом Минюста России и МВД РФ. По мнению автора принятого закона, это соответствует международной практике.
Кроме того, законопроект разрешает привлекать частных детективов для поиска должника или ребенка, которого должны забрать в соответствии с решением суда. Привлечение частного детектива будет происходить на платной основе на основании договора с взыскателем.
- Повышению результативности розыска будет способствовать участие в нем негосударственных субъектов, - говорится в пояснительной записке.
Также вводятся нормы, обязывающие кредитную организацию, осуществляющую обслуживание счетов должника, незамедлительно исполнять требования о взыскании денежных средств и в течение трех дней информировать об этом взыскателя или судебного пристава-исполнителя.
Законопроект вносит в УК поправки, устанавливающие ответственность за предоставление приставу заведомо ложных сведений в декларации об имущественном положении должника или за уклонение от предоставления таких сведений. Такое преступление будет наказываться штрафом в размере до 100 тысяч рублей либо обязательными работами на срок до 180 часов.
