Rada refused to pass a law on private detective work.
People’s deputies did not support in the first reading the bill No. 1093 "On private detective (detective) activity." 151 people's deputies voted for the corresponding decision.
The bill proposes at the legislative level to regulate private detective (detective) activity as a set of non-governmental measures aimed at improving the mechanism for ensuring constitutional human rights and freedoms, protecting legal rights and interests of legal entities.
In particular, the document proposes to determine the legal status and organization and activities of private detective (detective) activity, their powers, guarantees of legal and social protection, interaction with law enforcement and local authorities, legal and physical persons, as well as the procedure for controlling it implementation.
The document determines that private detective (search activity) is the activity of private detectives or private detective enterprises authorized by the internal affairs bodies to provide detective services to customers (individuals and legal entities) on a contractual basis in order to protect their legal rights and interests.
"Private detective (search activity) is essentially entrepreneurial activity," the bill says.
According to the document, a private detective can be a citizen of Ukraine who has reached the age of 21, has a higher legal or special education, or who has undergone special training to engage in private detective (search) activities, has been working in operational or investigative units for at least 3 years, not consisting registered in health authorities in connection with a mental illness, alcoholism or drug addiction, has no criminal record and received, in the prescribed manner, a certificate of the right to engage in private detective (search) activities.
At the same time, a private detective cannot occupy a position in state authorities and local self-government, in law enforcement and judicial bodies.
The issuance of certificates of the right to engage in private detective (search) activities and permits for the registration of private detective enterprises, their associations and branches is carried out by the bodies of the Ministry of Internal Affairs of Ukraine.
The certificate is issued indefinitely within 10 days from the date of submission of documents for obtaining such a certificate.
Along with the certificate, the applicant is issued a private detective certificate.
"In the case of state registration of a private detective enterprise, a union of private detective enterprises and their branches, in addition to the documents that are provided for by the first part of this article, an additional permission is submitted from the relevant body of the Ministry of Internal Affairs of Ukraine to conduct state registration of a private detective enterprise (associations, branches). in the absence of such permission, a legal entity cannot use the words "detective agency", "detective bureau", "detective society", "detective company", "detective enterprise" in its name, the bill says.
A private detective has the right to purchase special means of active defense, namely traumatic weapons of domestic production and cartridges for him; stun guns; spray cans and other special equipment with tear and irritant drugs.
Supervision of compliance with the law in private detective (search) activities is carried out by the Prosecutor General of Ukraine and prosecutors subordinate to him.

Рада отказалась принять закон о частной детективной деятельности.
Народные депутаты не поддержали в первом чтении законопроект № 1093 "О частной детективной (сыскной) деятельности". За соответствующее решение проголосовали 151 нардеп.
Законопроект предлагает на законодательном уровне урегулировать частную детективную (сыскную) деятельность как комплекс негосударственных мероприятий, направленных на совершенствование механизма обеспечения конституционных прав и свобод человека, защиты законных прав и интересов юридических лиц.
В частности, документ предлагает определить правовой статус и порядок организации и деятельности субъектов частной детективной (сыскной) деятельности, их полномочия, гарантии правовой и социальной защиты, взаимодействие с правоохранительными органами и органами местного самоуправления, юридическими и физическими лицами, а также порядок контроля за ее осуществлением.
Документом определяется, что частная детективная (розыскная деятельность) - это разрешенная органами внутренних дел деятельность частных детективов или частных детективных предприятий по предоставлению заказчикам (физическим и юридическим лицам) на платной договорной основе детективных услуг с целью защиты их законных прав и интересов.
"Частная детективная (розыскная деятельность) является по своей сути предпринимательской деятельностью", - говорится в законопроекте.
Согласно документу, частным детективом может быть гражданин Украины, достигший 21 года, имеющий высшее юридическое или специальное образование или который прошел специальную подготовку для занятия частной детективной (розыскной) деятельностью имеет стаж работы в оперативных или следственных подразделениях не менее 3-х лет, не состоящий на учете в органах здравоохранения в связи с психическим заболеванием, алкоголизмом или наркоманией, не имеет судимости и получивший в установленном порядке свидетельство о праве занятия частной детективной (розыскной) деятельностью.
Вместе с тем, частный детектив не может занимать должность в органах государственной власти и местного самоуправления, в правоохранительных и судебных органах.
Выдача свидетельств о праве занятия частной детективной (розыскной) деятельностью и разрешений на регистрацию частных детективных предприятий, их объединений и филиалов осуществляется органами Министерства внутренних дел Украины.
Свидетельство выдается бессрочно в течение 10 дней со дня подачи документов для получения такого свидетельства.
Одновременно со свидетельством заявителю выдается удостоверение частного детектива.
"В случае государственной регистрации частного детективного предприятия, объединения частных детективных предприятий и их филиалов, кроме документов, которые предусмотрены частью первой этой статьи, дополнительно представляется разрешение соответствующего органа Министерства внутренних дел Украины на проведение государственной регистрации частного детективного предприятия (объединения, филиалы). При отсутствии такого разрешения юридическое лицо не может использовать в своем названии слова "детективное агентство", "детективное бюро", "детективное общество", "детективная фирма", "детективное предприятие", - говорится в законопроекте.
Частный детектив имеет право на приобретение специальных средств активной обороны, а именно травматического оружия отечественного производства и патронов к нему; электрошокеров; баллончиков и других спецсредств с препаратами слезоточивого и раздражающего действия.
Надзор за соблюдением законности в частной детективной (розыскной) деятельности осуществляется Генеральным прокурором Украины и подчиненными ему прокурорами.
