According to the Ministry of Internal Affairs, there are about 25 thousand private security companies in Russia, of which a quarter have fewer than 10 employees, the remaining about 100 and units up to 1000. The undoubted blessing of this structure on the part of the Kremlin does not allow the approximately million-strong society of guards to compete with the Guard and the Ministry of Internal Affairs. There are undoubted advantages of these legislative changes: tightening control in the field of private security and detective activities, preventing people with a criminal past from providing such services, mandatory fingerprinting, expelling foreign citizens from the security sphere, and strengthening the criminal and administrative liability of PSC employees and detectives in the line of duty . Unfortunate detectives were doomed to take professional exams; now, “detectives with a diploma” are in use, and without the completion of a specialized educational institution they will not be able to engage in detective activities. You cannot use the equipment for monitoring, listening and scanning conversations for the performance of your duties. Use hidden cameras without the consent of the persons in respect of whom they are used. If violated, they face up to 7 years. С приходом к власти демократов наше общество и конкретно граждане получили много свобод: экономических, политических, личных. Если во времена союза обеспечение безопасности, ведение охранной и сыскной деятельности была только государственная прерогатива, то после все эти виды деятельности стали доступны простым гражданам и частным организациям.
Но по прошествии 18 лет счастливого демократического детства эти власти стали часть свобод забирать обратно незаметно, постепенно, скандально обосновывая каждый шаг.
Госкорпорация ФГУП «Охрана» стремиться монополизировать рынок охранных услуг, а частных детективов государство лишает средств их заработка – возможности применения аппаратуры прослушивания и ведения скрытого наблюдения. Говорят история движется по спирали и всё неуклонно повторяется, в 1917 году большевиками народу было даровано всё, земля, свобода, равенство, но по прошествии нескольких лет отобрано безвозвратно. По данным МВД в России насчитывается около 25 тыс. ЧОП из них четверть с количеством служащих менее 10 человек, остальные около 100 и единицы до 1000. Так было, я что будет теперь? Теперь по закону преимущества предприятия «Охрана» на рынке охранных услуг станут на много больше т.к. у частных охранников отбирают оружие, брать они его смогут в аренду у МВД, ужесточают условия получения лицензии, не дают возможности заработать на охране государственных и стратегических объектов. Так откуда корни? ФГУП – бывшая вневедомственная охрана, которая не смотря на тяготы частников остаётся наделена более благоприятными условиями деятельности и широкой сферой использования оружия. Несомненное благословление этой структура со стороны Кремля не дает возможности, примерно миллионному обществу охранников, конкурировать с «Охраной» и МВД. Есть несомненные плюсы этих изменений законодательства: усиление контроля в сфере частной охранной и детективной деятельности, недопущение к предоставлению таких услуг лиц имеющих криминальное прошлое, обязательное дактелоскопирование, исключение иностранных граждан из сферы охраны, усиление уголовной и административной ответственности сотрудников ЧОП и детективов при исполнении служебных обязанностей. Несчастных детективов обрекли на сдачу профессиональных экзаменов, теперь в ходу «сыщики с дипломом» и без окончания профильного учебного заведения сыскной деятельностью заниматься они не смогут. Нельзя использовать для исполнения своих обязанностей аппаратуру слежения, прослушивания и сканирования переговоров. Применять скрытые камеры без согласия на то лиц в отношении которых они применяются. При нарушении им грозит срок до 7 лет. Фактически частных сыщиков обрекли заведомо на нарушение закона, поскольку во многих случаях при ведении сыска без такой техники не обойтись. Данные услуги весьма востребованы, к примеру предприниматель в виду соблюдения коммерческой тайны или других личных обстоятельств, не пожелавший обращаться в милицию, нанимает сыщика для поиска в составе своего рабочего коллектива инсайдера – сотрудника посаженного конкурентами и детектив внедряется в предприятие, производит опросы, делает установку подозреваемого. Или же используется внедрение для коммерческой контрразведки при необходимости получения данных о предстоящей сделке и о партнерах в ней. Расследование мелких краж в частном предприятии, чтобы не поднимать «шума» вокруг организации тоже пользуются услугами “скрытых” агентов сыска. И несомненно самая популярная услуга – слежка за супругом или детьми для вполне понятных целей. Говорят на основании полученных сведений в результате скрытого наблюдения, не раз менялись завещания с миллионными наследствами. Часто детектив превращается в бухгалтера или “канцелярскую крысу “ проводя но несколько недель к кипах бумаг с целью поиска информации в газетах, служебных справках, архивных документах, ведь немало информации находится на виду, только надо знать где и как искать. Работа сыщиков это еще и розыск пропавших без вести родственников, партнёров, проверка состоятельности сделки, покупки, проверка на наличие слежки, прослушки, наличие съёма информации с компьютеров организации. При оказании таких услуг нередко требуется применение спецтехники, скрытого наблюдения с помощью скрытых камер и жучков. И сыскари всё равно их будут использовать технически обходя закон. Поскольку вмешиваться в личную жизнь нельзя, то при заключении договора, которого требует закон, достаточно вписать, что данная деятельность ведется для обеспечения собственной безопасности клиента или розыска пропавшего родственника. А что уж там попутно найдется, услышится или увидится – детали. Если нельзя пользоваться скрытыми камерами, то мобильными телефонами и мини камерами никто не запрещал, вот и будут попадать, при съёмке красивой панорамы парка, в объектив неожиданно появившиеся супруги с любовниками. А для применения скрытой камеры достаточно вывесить на видном месте табличку о ведении скрытого наблюдения – улыбнитесь! В таком случае не к чему придраться. На всякое действие найдется противодействие, те более у русских сыщиков. Возможно следующим ужесточением закона будет запрет на использование видеосъемки вообще и использование диктофонов. А чем черт не шутит, главное правильно обосновать и пролобировать в палатах парламента, народ у нас терпеливый и жутко доверчивый к власти.
