Cyril))) Inessa, in my opinion, is a graphologist, not a handwriter ... And this, if my memory serves me, is a bit different things ... And the difference is the following ... In what situations can a handwriting examination be needed? First of all, the need for it arises when there are doubts about the authenticity of signatures on contracts, orders, wills and other documents, especially of a financial nature. Having a sufficient number of samples for comparison, the expert is highly likely to confirm or deny the involvement of the claimed person in the signature.
A handwriting specialist can not only identify a person, but also determine that the subject intentionally misrepresented his signature. It is possible that at the same time he tried to copy the stroke of another person, or maybe he wanted to make his own signature unrecognizable. In certain cases, the expert even manages to answer the question whether the copied signature was executed spontaneously, or if the forger trained to achieve maximum resemblance to the original. The study of signatures is a rather complicated procedure, because the size of the signatures is too small to judge the manner in which strokes and letters are characteristic of a particular person.
On the other hand, signatures are characterized by the stability of motor skills, signatures are constantly put under various documents even by those people who do not have the habit of frequent writing. Therefore, the establishment of the fact of a fake to an experienced expert is still quite capable. Text studies are performed less frequently than signature examinations, but research objects are more informative, which guarantees a sufficiently high reliability of the conclusions made by the handwriting specialist. The tasks that need to be solved through the examination of handwriting are diverse: sometimes, when examining a text, you just need to identify the identity of its executor, but more often the expert is asked questions regarding the conditions in which the text was written.
Unlike his colleagues who specialize in graphological testing, handwriting does not describe the nature or color of the eyes of the author of the manuscript. But he can verify that the subject has a fever or intoxication at the time of writing. An expert with a high degree of certainty is able to establish that the manuscript was prepared in poor lighting, in severe frost, in a room with high humidity.
A good expert has many opportunities to establish the circumstances of the creation of the text, but for this purpose it is necessary for the specialist to provide not only samples of manuscripts in the quantity indicated by him, but also a list of questions that the expert will look for answers during the study. Independently determine the range of tasks to be solved by the expert; the specialist is not required to take this customer into account. True, if the initiative to conduct an examination comes from a judge considering a case of fraud, financial fraud, extortion, tax evasion, or from an investigator investigating such crimes, then such customers are very well aware of the formal side of the expert investigation. Private orders for handwriting examinations are quite rare, but the potential client will not be insecure about the details of their implementation.
Despite the wide range of tasks solved by handwriting expertise, all of them in one way or another come down to preparing evidence for the investigation or trial. Examinations ordered out of court are also no exception, as the customer proposes to use the conclusions contained in the expert report sooner or later as arguments in a court dispute. If an out-of-court examination is ordered from the NP “Federation of Forensic Experts”, its specialists will certainly warn the client that the findings of such a study will not have legal force. So if it is important for the customer to be able to use an expert opinion as a document of evidentiary value, it is still better for him to first contact the competent authority with a request for an examination.
In order for the application to be positively considered by the court or the investigative department, it is advisable to attach a letter of guarantee certified by the leadership of NP “FSE” to it. Such a letter expresses consent to research, indicates the time and cost of completing the order, clarifies the name, position, length of service, educational level of the specialist responsible for the preparation of the examination certificate.
The opinion of the experts of this organization is trusted by many courts of Moscow, and more recently, regional judicial authorities. Therefore, the results of the handwriting examination with a 100% guarantee will be accepted by the court as evidence or a refutation of the guilt of the participant in the dispute. Handwriting examinations are considered to be the most important source of evidence used to assert violated rights, but this statement is true only when research is conducted by high-level professionals.
