However, many entrepreneurs believe that it is much more profitable to use the achievements of a competing company obtained illegally. Therefore, confidential information about the activities of companies has recently become a hot commodity. The scale of industrial espionage today has reached such a scale that every serious company is forced to have a department that protects its secrets and collects information about competitors. Special departments of business intelligence are engaged in the collection of classified information about competitors, sources of supplies of raw materials, contracts being prepared, financial condition, working methods and business relations of a competitor, i.e. everything that determines the economic development of a competing structure.
The owner of a private detective agency, Mr. Axel Samulovits (secretive name is Detective Stern), talks about investigation methods based on unconventional investigative and counterintelligence activities aimed at protecting the entrepreneur's production interests.
The detective is not a family therapist
Many are interested in whether it is possible to get a detective specialty at a state university and what are the requirements for registering a private detective agency. The law does not provide for special education or special requirements, the fulfillment of which is necessary for the opening of private detective activity. Anyone who feels the strength, has the necessary financial and intellectual potential and does not have entries in the police register can register his own detective agency at the Office for Registration of Private Entrepreneurship. “My personal advantage is my previous professional experience,” says Detective Stern. - In the past, I worked in the investigation department of the Lufthansa company. Однако, полагают многие предприниматели, гораздо выгоднее использовать достижения конкурирующей компании, полученные незаконным образом. Поэтому конфиденциальная информация о деятельности компаний стала в последнее время ходовым товаром. Масштаб промышленного шпионажа сегодня достиг такого размаха, что каждая серьезная фирма вынуждена иметь отдел, обеспечивающий защиту своих секретов и занимающийся сбором информации о конкурентах. Специальные отделы бизнес-разведки, занимаются сбором секретных сведений о конкурентах, источниках поставок сырья, готовящихся контрактах, финансовом состоянии, методах работы и деловых связях конкурента, т.е. всё, что определяет экономическое развитие конкурирующей структуры.
О способах расследования, основанных на нетрадиционной следственной и контрразведывательной деятельности, направленной на защиту производственных интересов предпринимателя, рассказывает владелец частного детективного агентства господин Аксель Самуловиц (конспиративное имя — детектив Штерн).
Детектив — не семейный психотерапевт
Многих интересует, можно ли получить в государственном вузе специальность детектива и каковы требования регистрации частного детективного агентства. Закон не предусматривает специального образования или особых требований, выполнение которых необходимо для открытия частной сыскной деятельности. Каждый, кто чувствует в себе силы, обладает необходимым финансовым и интеллектуальным потенциалом и не имеет записей в полицейском регистре, может оформить в Ведомстве по регистрации частной предпринимательской деятельности собственное детективное агентство. «Мое личное преимущество заключается в предыдущем профессиональном опыте, — говорит детектив Штерн. – В прошлом я работал в отделе расследования компании Люфтганза. Это позволило мне накопить бесценный опыт, необходимый в моей сегодняшней частносыскной деятельности». Как рассказал г-н Штерн, не все частные детективные агентства оказывают услуги широкого профиля, это требует значительных материальных затрат, большого числа наемных сотрудников, работающих в различных профессиональных направлениях. Например, слежка за неверным супругом (супругой) или выявление сотрудника, подозреваемого в предательстве собственного предприятия, имеют существенные отличия и осуществляются по-разному. «Поскольку промышленный шпионаж нередко наносит более значительный ущерб, чем супружеская измена, мое агентство специализируется только на расследовании правонарушений в производственной сфере», — добавил детектив.
Подобному профильному выбору есть логичное объяснение. Все перипетии семейной жизни обычно связаны с эмоциональным состоянием клиента, а если заинтересованное лицо — женщина, дело не обходится без слез и излишней драматизации. Исходя из этого, при семейных расследованиях нужны, прежде всего, психоаналитики и психологи, а не детективы. «С такими клиентами очень тяжело работать, — признается детектив. — Поэтому, когда в процессе расследования выясняется, что причиной снижения финансового оборота у предприятия оказывается любовница бизнес-партнера моего клиента, моя дальнейшая работа прекращается».
Цели промышленного шпионажа
С целью повышения финансового оборота, расширения круга клиентов и партнеров, а также увеличения прибыли владельцы предприятий, не отягощенные мыслями о противозаконных деяниях, порой прибегают к простейшим приемам — краже производственных секретов конкурентов. Такие сомнительные методы ведения бизнеса разрушают обусловленную законом систему взаимоотношений предприятий между собой и, следовательно, экономический фундамент государства. Руководители предприятий и организаций страдают от подобных действий намного больше, чем потребители. В то же время, сбор информации о конкурентах, если он легитимен, считается законным. Например, анализ прессы, анализ рекламы с оценкой прибыли фирмы-конкурента с точностью до 10-15 процентов, наружное видеонаблюдение за офисом для определения числа сотрудников и выяснения круга лиц, входящих в высшее звено фирмы, криминалом не являются. Если же используются способы сбора информации, нарушающие закон, можно говорить о промышленном шпионаже. Это — перехват договоров или контрактов, переманивание наиболее ценных специалистов, внедрение на конкурирующее предприятие шпиона. Полученная таким образом информация позволяет «обставить» не слишком предусмотрительного конкурента, используя его же достижения.
Частный детектив не имеет права наказывать
Частноразведывательные мероприятия направлены как на сохранность секретов фирмы, так и на разоблачение сотрудников, не гнушающихся денежным вознаграждением за передачу чужих производственных секретов или за продажу своих собственных. Вряд ли следственный отдел прокуратуры или полиции возьмется за дело о гипотетическом нанесении ущерба предприятию за счет таких же гипотетических подозреваемых. Дефицит персонала в государственных правоохранительных структурах — серьезная проблема развитых стран, не говоря уже о том, что многие методы частного расследования связаны с длительным наблюдением и многочасовой аналитической работой, что не могут себе позволить государственные органы. Поэтому и возникли частные детективные агентства, оказывающие предприятиям реальную помощь. Для обеспечения безопасности предпринимательства частный детектив использует несертифицированные, но и не нарушающие закон сыскные мероприятия. В его компетенцию не входит предъявление обвинения, установление степени вины, задержание подозреваемого или оценка меры наказания. Цель работы сыщика — добыть и систематизировать информацию для заказчика, который поступает с ней по собственному усмотрению, не нарушая при этом общепринятых норм морали и права, иначе он сам становится преступником. Положение потерпевшего не дает права развязать себе руки и применять самосуд или незаконные меры административного воздействия, аргументируя это «правом справедливой мести».
В конечном итоге, если добытые сыщиком сведения позволяют заказчику убедиться в нарушении его сотрудником производственной этики, он может применить меры, соответствующие уставу предприятия и не противоречащие гражданскому и уголовному кодексам.
Уметь сливаться с окружающей средой
Один из методов сбора информации заключается в тщательном наблюдении за объектом слежки. Кроме обычного преследования машины сотрудника фирмы, используют устройства навигационного слежения GPS, прикрепляемые к днищу автомобиля, и, наконец, результативный, но требующий высокого профессионализма прием: слежка за конкретным человеком. Устанавливается, с кем он встречается, при каких обстоятельствах и в каких условиях, о чем разговаривает. Детектив обязан быть незаметным, иметь естественное поведение и неброскую внешность. Достаточно недели фото- видеонаблюдения и становится понятным, почему дела ранее прочно стоящей на ногах фирмы пошли вниз: начальник ли отдела реализации продукции продал конкурентам клиентскую базу данных, или начальник маркетингового отдела попался на личном компромате и «сдает» конкурентам актуальные ноу-хау, а недавно принятый на фирму кризисный менеджер оказался шпионом конкурента. Фото и видеонаблюдения, как и любой процесс внедрения в частную жизнь другого человека, оговорены законом: детектив на правах частной инициативы имеет право фотографировать или записывать на видео действия постороннего человека только в общественных местах, но с запрещением публикации фотографий. Аудиозапись, произведенная тайно, без согласия объекта прослушивания, трактуется как «Нарушение конфиденциальности слова» — § 201 УК ФРГ.
Но как понять, о чем ведет беседу объект наблюдения? В этом случае на помощь приходит знание «языка тела». Радушно улыбающийся предприниматель, разговаривающий с клиентом с гордо поднятой головой — добился успеха. Презрительно сложенные на груди руки подчеркивают, что клиенту вряд ли придется рассчитывать на искренность. Внезапные же и резкие телодвижения, сильные взмахи руками указывают на возникшее в разговоре напряжение и возможную опасность для одного из собеседников. Правильно понимаемый язык тела предоставит профессионалу намного больше информации, чем непрофессионалу — видео- и аудиоинформация.

Сыщику, ведущему расследование, необходимо получить конфиденциальные сведения о совладельце предприятия, работающем, по словам заказчика, на конкурента. Но как установить контакт с сотрудником высшего звена предприятия?
Представиться: «Здравствуйте, я — детектив Штерн. Собираю информацию о вашем шефе»? На этом задание можно считать проваленным. В этом случае необходимо мастерство перевоплощения, позволяющее провести так называемое «скрытое интервью». Для общения на приватном уровне с незнакомым человеком необходимо войти к нему доверие. Как? Это и есть главный вопрос. Самый выигрышный вариант: представиться независимым сотрудником консалтинговой фирмы в области маркетинга — ни к чему не обязывающая должность, допускающая беседу по широкому кругу вопросов. А далее, располагающие к общению разговоры об огромной конкуренции, не всегда оптимальных и грамотных методах руководства предприятием могут направить разговор в желаемое русло. При этом ваш собеседник, всегда чем-то недовольный, постепенно раскроет карты и выложит необходимую информацию о своем начальнике. Заметьте: разговор крутится вокруг темы «маркетинг», а не о личности шефа! Не исключено, что собеседник предоставит сыщику список уволенных сотрудников, нуждающихся в помощи при поиске рабочего места: обиженному человеку всегда есть что рассказать.
Ведение разговора в нужном ключе — высший пилотаж, основанный на знаниях основ психологии, на владении темой и умении продемонстрировать искренний интерес к собеседнику: кто слушает — тот получает информацию.
Все сведения, полученные детективом в ходе расследования, добываются только в интересах клиента и предназначены исключительно для его пользы. Они передаются заказчику в конфиденциальной обстановке и под страхом судебного наказания запрещены для оглашения третьим лицам.

Специальные отделы бизнес-разведки, занимаются сбором секретных сведений о конкурентах, источниках поставок сырья, готовящихся контрактах, финансовом состоянии, методах работы и деловых связях конкурента, т.е. всё, что определяет экономическое развитие конкурирующей структуры.
О способах расследования, основанных на нетрадиционной следственной и контрразведывательной деятельности, направленной на защиту производственных интересов предпринимателя, рассказывает владелец частного детективного агентства господин Аксель Самуловиц (конспиративное имя — детектив Штерн).
Детектив — не семейный психотерапевт
Многих интересует, можно ли получить в государственном вузе специальность детектива и каковы требования регистрации частного детективного агентства. Закон не предусматривает специального образования или особых требований, выполнение которых необходимо для открытия частной сыскной деятельности. Каждый, кто чувствует в себе силы, обладает необходимым финансовым и интеллектуальным потенциалом и не имеет записей в полицейском регистре, может оформить в Ведомстве по регистрации частной предпринимательской деятельности собственное детективное агентство. «Мое личное преимущество заключается в предыдущем профессиональном опыте, — говорит детектив Штерн. – В прошлом я работал в отделе расследования компании Люфтганза. Это позволило мне накопить бесценный опыт, необходимый в моей сегодняшней частносыскной деятельности». Как рассказал г-н Штерн, не все частные детективные агентства оказывают услуги широкого профиля, это требует значительных материальных затрат, большого числа наемных сотрудников, работающих в различных профессиональных направлениях. Например, слежка за неверным супругом (супругой) или выявление сотрудника, подозреваемого в предательстве собственного предприятия, имеют существенные отличия и осуществляются по-разному. «Поскольку промышленный шпионаж нередко наносит более значительный ущерб, чем супружеская измена, мое агентство специализируется только на расследовании правонарушений в производственной сфере», — добавил детектив.
Подобному профильному выбору есть логичное объяснение. Все перипетии семейной жизни обычно связаны с эмоциональным состоянием клиента, а если заинтересованное лицо — женщина, дело не обходится без слез и излишней драматизации. Исходя из этого, при семейных расследованиях нужны, прежде всего, психоаналитики и психологи, а не детективы. «С такими клиентами очень тяжело работать, — признается детектив. — Поэтому, когда в процессе расследования выясняется, что причиной снижения финансового оборота у предприятия оказывается любовница бизнес-партнера моего клиента, моя дальнейшая работа прекращается».
Цели промышленного шпионажа
С целью повышения финансового оборота, расширения круга клиентов и партнеров, а также увеличения прибыли владельцы предприятий, не отягощенные мыслями о противозаконных деяниях, порой прибегают к простейшим приемам — краже производственных секретов конкурентов. Такие сомнительные методы ведения бизнеса разрушают обусловленную законом систему взаимоотношений предприятий между собой и, следовательно, экономический фундамент государства. Руководители предприятий и организаций страдают от подобных действий намного больше, чем потребители. В то же время, сбор информации о конкурентах, если он легитимен, считается законным. Например, анализ прессы, анализ рекламы с оценкой прибыли фирмы-конкурента с точностью до 10-15 процентов, наружное видеонаблюдение за офисом для определения числа сотрудников и выяснения круга лиц, входящих в высшее звено фирмы, криминалом не являются. Если же используются способы сбора информации, нарушающие закон, можно говорить о промышленном шпионаже. Это — перехват договоров или контрактов, переманивание наиболее ценных специалистов, внедрение на конкурирующее предприятие шпиона. Полученная таким образом информация позволяет «обставить» не слишком предусмотрительного конкурента, используя его же достижения.
Частный детектив не имеет права наказывать
Частноразведывательные мероприятия направлены как на сохранность секретов фирмы, так и на разоблачение сотрудников, не гнушающихся денежным вознаграждением за передачу чужих производственных секретов или за продажу своих собственных. Вряд ли следственный отдел прокуратуры или полиции возьмется за дело о гипотетическом нанесении ущерба предприятию за счет таких же гипотетических подозреваемых. Дефицит персонала в государственных правоохранительных структурах — серьезная проблема развитых стран, не говоря уже о том, что многие методы частного расследования связаны с длительным наблюдением и многочасовой аналитической работой, что не могут себе позволить государственные органы. Поэтому и возникли частные детективные агентства, оказывающие предприятиям реальную помощь. Для обеспечения безопасности предпринимательства частный детектив использует несертифицированные, но и не нарушающие закон сыскные мероприятия. В его компетенцию не входит предъявление обвинения, установление степени вины, задержание подозреваемого или оценка меры наказания. Цель работы сыщика — добыть и систематизировать информацию для заказчика, который поступает с ней по собственному усмотрению, не нарушая при этом общепринятых норм морали и права, иначе он сам становится преступником. Положение потерпевшего не дает права развязать себе руки и применять самосуд или незаконные меры административного воздействия, аргументируя это «правом справедливой мести».
В конечном итоге, если добытые сыщиком сведения позволяют заказчику убедиться в нарушении его сотрудником производственной этики, он может применить меры, соответствующие уставу предприятия и не противоречащие гражданскому и уголовному кодексам.
Уметь сливаться с окружающей средой
Один из методов сбора информации заключается в тщательном наблюдении за объектом слежки. Кроме обычного преследования машины сотрудника фирмы, используют устройства навигационного слежения GPS, прикрепляемые к днищу автомобиля, и, наконец, результативный, но требующий высокого профессионализма прием: слежка за конкретным человеком. Устанавливается, с кем он встречается, при каких обстоятельствах и в каких условиях, о чем разговаривает. Детектив обязан быть незаметным, иметь естественное поведение и неброскую внешность. Достаточно недели фото- видеонаблюдения и становится понятным, почему дела ранее прочно стоящей на ногах фирмы пошли вниз: начальник ли отдела реализации продукции продал конкурентам клиентскую базу данных, или начальник маркетингового отдела попался на личном компромате и «сдает» конкурентам актуальные ноу-хау, а недавно принятый на фирму кризисный менеджер оказался шпионом конкурента. Фото и видеонаблюдения, как и любой процесс внедрения в частную жизнь другого человека, оговорены законом: детектив на правах частной инициативы имеет право фотографировать или записывать на видео действия постороннего человека только в общественных местах, но с запрещением публикации фотографий. Аудиозапись, произведенная тайно, без согласия объекта прослушивания, трактуется как «Нарушение конфиденциальности слова» — § 201 УК ФРГ.
Но как понять, о чем ведет беседу объект наблюдения? В этом случае на помощь приходит знание «языка тела». Радушно улыбающийся предприниматель, разговаривающий с клиентом с гордо поднятой головой — добился успеха. Презрительно сложенные на груди руки подчеркивают, что клиенту вряд ли придется рассчитывать на искренность. Внезапные же и резкие телодвижения, сильные взмахи руками указывают на возникшее в разговоре напряжение и возможную опасность для одного из собеседников. Правильно понимаемый язык тела предоставит профессионалу намного больше информации, чем непрофессионалу — видео- и аудиоинформация.
Перевоплощение по Станиславскому
Сыщику, ведущему расследование, необходимо получить конфиденциальные сведения о совладельце предприятия, работающем, по словам заказчика, на конкурента. Но как установить контакт с сотрудником высшего звена предприятия?
Представиться: «Здравствуйте, я — детектив Штерн. Собираю информацию о вашем шефе»? На этом задание можно считать проваленным. В этом случае необходимо мастерство перевоплощения, позволяющее провести так называемое «скрытое интервью». Для общения на приватном уровне с незнакомым человеком необходимо войти к нему доверие. Как? Это и есть главный вопрос. Самый выигрышный вариант: представиться независимым сотрудником консалтинговой фирмы в области маркетинга — ни к чему не обязывающая должность, допускающая беседу по широкому кругу вопросов. А далее, располагающие к общению разговоры об огромной конкуренции, не всегда оптимальных и грамотных методах руководства предприятием могут направить разговор в желаемое русло. При этом ваш собеседник, всегда чем-то недовольный, постепенно раскроет карты и выложит необходимую информацию о своем начальнике. Заметьте: разговор крутится вокруг темы «маркетинг», а не о личности шефа! Не исключено, что собеседник предоставит сыщику список уволенных сотрудников, нуждающихся в помощи при поиске рабочего места: обиженному человеку всегда есть что рассказать.
Ведение разговора в нужном ключе — высший пилотаж, основанный на знаниях основ психологии, на владении темой и умении продемонстрировать искренний интерес к собеседнику: кто слушает — тот получает информацию.
Все сведения, полученные детективом в ходе расследования, добываются только в интересах клиента и предназначены исключительно для его пользы. Они передаются заказчику в конфиденциальной обстановке и под страхом судебного наказания запрещены для оглашения третьим лицам.
