It is proposed to legislatively consolidate the list of rights of a private detective. The powers of private detectives can be expanded. The corresponding bill1, developed by deputies Vitaliy Zolochevsky and Alexander Kropachev, was submitted to the State Duma.
It is proposed to consolidate the list of rights of private detectives in the law. So, the following rights are planned to be included in the number of detective rights when carrying out detective activities:
to interrogate, with their consent, persons allegedly possessing information related to the subject of the service provided by the detective;
research objects and study documents with the written consent of their owners;
carry out an external inspection of buildings, structures, structures, premises, terrain, vehicles and other objects to obtain the necessary information;
to carry out surveillance to obtain information for the purpose of investigation, including using technical means, with the exception of special technical means intended for secretly obtaining information;
take actions to consolidate (fix) the traces of the event;
collect information necessary to perform the service provided, including requesting certificates, specifications and other documents from state authorities and local governments, public associations, and other organizations. It is planned to oblige the indicated bodies and organizations to issue to the detective the documents requested by him or their copies;
collect and submit objects and documents that may be recognized as material and other evidence;
engage on a contractual basis experts to clarify issues related to the provision of detective services;
to record (including using technical and other means) information related to the provided detective service, while observing state and other secrets protected by the legislation of the Russian Federation;
to use, in cases and in the manner established by the Government of the Russian Federation, video and audio recordings, film and photography, technical and other means that do not harm the life and health of citizens and the environment.
Now, private detectives are allowed in the course of detective work to verbally interview citizens and officials with their consent, make inquiries, study objects and documents, conduct an external examination of buildings, premises and other objects, observe for the necessary information. Also, when conducting private detective activities, the use of video and audio recordings, film and photography, technical and other means that do not harm the life and health of citizens and the environment (Article 5 of the Law of the Russian Federation of March 11, 1992 No. 2487-I " On private detective and security activities in the Russian Federation ").
The draft law retains the powers contained in the current edition of the specified article, and also takes into account the rights of the detective, enshrined in art. 21 of the Model Law "On non-state (private) security activities and non-state (private) detective activities", adopted on June 16, 2003 at the Plenary meeting of the Inter-Parliamentary Assembly of the CIS member states.
The authors of the bill justify the need to introduce the proposed changes by the absence in the legislation in the field of investigation of regulation of the rights of a private detective. Such a gap, according to the deputies, does not allow to clearly distinguish between private detective and operative-search activities. "This leads in practice to a violation of the rights and legitimate interests of citizens, creates difficulties in providing detective services, creating a civilized market for these services, and creates difficulties for government bodies to exercise effective control (supervision) over this type of activity, since in the current situation in practice it’s quite difficult to distinguish between the detective’s legal actions and illegal, "the parliamentarians emphasize.
As noted in the explanatory note to the document, its adoption will ultimately contribute to the formation of a civilized market of detective services based on Russian legislation.
Recall, recently, the authors of the bill developed a bill aimed at expanding the list of services provided by private detectives for search purposes. Also, the State Duma is considering a project providing for the right of participants in criminal proceedings to use the services of private detectives.

Предлагается законодательно закрепить перечень прав частного детектива Правомочия частных детективов могут расширить. Соответствующий законопроект1, разработанный депутатами Bиталием Золочевским и Александром Кропачевым, внесен в Госдуму.
Предлагается закрепить в законе перечень прав частных детективов. Так, в число прав детективов при осуществлении сыскной деятельности планируется включить права:
опрашивать с их согласия лиц, предположительно владеющих информацией, относящейся к предмету оказываемой детективом услуги;
исследовать предметы и изучать документы с письменного согласия их владельцев;
осуществлять внешний осмотр зданий, сооружений, строений, помещений, участков местности, транспортных средств и других объектов для получения необходимой информации;
осуществлять наблюдение для получения информации в целях сыска, в том числе с использованием технических средств, за исключением специальных технических средств, предназначенных для негласного получения информации;
совершать действия по закреплению (фиксации) следов события;
собирать сведения, необходимые для выполнения оказываемой услуги, в том числе запрашивать справки, характеристики и иные документы из органов госвласти и местного самоуправления, общественных объединений, иных организаций. Указанные органы и организации планируется обязать выдавать детективу запрашиваемые им документы или их копии;
собирать и представлять предметы и документы, которые могут быть признаны вещественными и иными доказательствами;
привлекать на договорной основе специалистов для разъяснения вопросов, связанных с оказанием детективной услуги;
фиксировать (в том числе с помощью технических и иных средств) информацию, относящуюся к оказываемой детективной услуге, соблюдая при этом государственную и иную охраняемую законодательством РФ тайну;
использовать в случаях и порядке, установленных Правительством РФ, видео-и аудиозапись, кино- и фотосъемку, технические и иные средства, не причиняющие вреда жизни и здоровью граждан и окружающей среде.
Сейчас частным детективам разрешается в ходе сыскной деятельности устно опрашивать граждан и должностных лиц с их согласия, наводить справки, изучать предметы и документы, проводить внешний осмотр строений, помещений и других объектов, наблюдать для получения необходимой информации. Также при осуществлении частной сыскной деятельности допускается использование видео- и аудиозаписи, кино- и фотосъемки, технических и иных средств, не причиняющих вреда жизни и здоровью граждан и окружающей среде (ст. 5 Закона РФ от 11 марта 1992 г. № 2487-I "О частной детективной и охранной деятельности в Российской Федерации").
В законопроекте сохранены правомочия, содержащиеся в действующей редакции указанной статьи, а также учтены права сыщика, закрепленные в ст. 21 Модельного Закона "О негосударственной (частной) охранной деятельности и негосударственной (частной) сыскной деятельности", принятого 16 июня 2003 г. на Пленарном заседании Межпарламентской Ассамблеи государств-участников СНГ.
Необходимость внесения предлагаемых изменений авторы законопроекта обосновывают отсутствием в законодательстве в сфере сыска регламентации прав частного детектива. Такой пробел, по мнению депутатов, не позволяет четко разграничить частную детективную и оперативно-розыскную деятельность. "Это приводит на практике к нарушению прав и законных интересов граждан, создает трудности при оказании детективных услуг, создании цивилизованного рынка этих услуг, создает затруднения государственным органам для осуществления эффективного контроля (надзора) за данным видом деятельности, так как в сложившейся ситуации на практике нередко довольно трудно отграничить законные действия детектива от незаконных", – подчеркивают парламентарии.
Как отмечается в пояснительной записке к документу, его принятие в конечном итоге будет способствовать формированию цивилизованного, базирующегося на российском законодательстве, рынка детективных услуг.
Напомним, недавно авторы законопроекта разработали законопроект, направленный на расширение перечня услуг, осуществляемых частными детективами в целях сыска. Также на рассмотрении Госдумы находится проект, предусматривающий право участников уголовного процесса пользоваться услугами частных детективов.
