The government introduced two laws to the State Duma, developed by the FSB
The Government of the Russian Federation on Saturday introduced a bill to the State Duma that introduces administrative responsibility for disobeying the legal requirement or order of an FSB officer and preventing him from fulfilling official duties.
In addition, the draft law provides the FSB authorities with the right to issue official warnings to persons about the inadmissibility of their actions, creating the conditions for committing crimes, the inquiry and preliminary investigation of which are assigned by the federal security service to the legislation of the Russian Federation.
The relevant changes that were developed by the FSB of Russia are proposed to be introduced into the law "On the Federal Security Service" and the Code of Administrative Offenses of the Russian Federation.
As noted in the explanatory note, the bill is aimed at legislative consolidation of the institution of special prevention measures used by the FSB.
The government on Saturday introduced another bill to the State Duma, also developed by the FSB. This document is aimed at streamlining state regulation of activities in the field of state aviation and at creating two independent types within the framework of "state aviation" - "state military aviation" (Russian Ministry of Defense) and "state special aviation" (FSB of Russia, EMERCOM of Russia, Ministry of Internal Affairs of Russia , FCS of Russia).
"The procedure currently established by the Air Code of the Russian Federation for the creation and access to use of aviation equipment for the needs of state aviation suggests that new aviation equipment is primarily developed for the most part to solve the tasks of the defense of the Russian Federation, without properly taking into account the specifics of other federal activities executive authorities, "the explanatory note says.
The document notes that military aviation is part of the Russian Armed Forces, which are designed to repel aggression against Russia, to armedly protect the integrity and inviolability of the territory of the Russian Federation, and the use of state aviation units of the FSB of Russia, the Ministry of Internal Affairs of Russia, the Ministry of Emergencies of Russia and the Federal Customs Service of Russia, mainly in peacetime and requires the use of special-purpose aviation equipment with special equipment not intended for solving defense tasks.
In connection with this bill, it is proposed to amend the Air Code and the Law "On State Regulation of Aviation Development", which are aimed at legalizing the existing practice and at creating two separate types of aviation.
In addition, the draft law proposes that the definition of the procedure for admitting to operation of state aircraft to the competence of the government of the Russian Federation.

Правительство внесло в Госдуму два законопректа, разработанные ФСБ
Правительство РФ в субботу внесло на рассмотрение в Госдуму законопроект, которым вводится административная ответственность за неповиновение законному требованию или распоряжению сотрудника ФСБ и воспрепятствование исполнению им служебных обязанностей.
Кроме того, проектом закона органам ФСБ предоставляется право выносить официальные предостережения лицам о недопустимости их действий, создающих условия для совершения преступлений, дознание и предварительное следствие по которым отнесено законодательством РФ к ведению органов федеральной службы безопасности.
Соответствующие изменения, которые были разработаны ФСБ России, предлагается внести в закон "О федеральной службе безопасности" и в Кодекс Российской Федерации об административных правонарушениях.
Как отмечается в пояснительной записке, законопроект направлен на законодательное закрепление института мер специальной профилактики, применяемых органами ФСБ.

Этот документ направлен на упорядочение государственного регулирования деятельности в области государственной авиации и на создание в рамках "государственной авиации" двух самостоятельных видов - "государственная военная авиация" (Минобороны России) и "государственная авиация специального назначения" (ФСБ России, МЧС России, МВД России, ФТС России).
"Установленный в настоящее время Воздушным кодексом РФ порядок создания и допуска к эксплуатации авиационной техники для нужд государственной авиации предполагает, что новая авиационная техника в первую очередь и в основной своей массе разрабатывается для решения задач обороны Российской Федерации, без учета должным образом специфики деятельности других федеральных органов исполнительной власти", - говорится в пояснительной записке.
В документе отмечается, что военная авиация находится в составе ВС РФ, которые предназначены для отражения агрессии, направленной против России, для вооруженной защиты целостности и неприкосновенности территории РФ, а применение подразделений государственной авиации ФСБ России, МВД России, МЧС России и ФТС России осуществляется, в основном, в мирное время и требует использования авиационной техники специального назначения со специальным оборудованием, не предназначенным для решения задач в сфере обороны.
В связи с этим законопроектом предлагается внести в Воздушный кодекс и закон "О государственном регулировании развития авиации" изменения, которые направлены на правовое оформление сложившейся практики и на создание двух самостоятельных видов авиации.
Кроме того, проектом закона предлагается отнести определение порядка допуска к эксплуатации государственных воздушных судов к компетенции правительства РФ.
