The real estate market is pretty simple for anyone to understand. It is formed by two main parties: the seller - the buyer and the so-called layer of intermediaries. Often, the latter play the most important role in the process of real estate transactions.
First, let's figure out where buyers are looking for an apartment. Some home buyers are looking for suitable options with the help of intermediaries - realtors, other potential owners are looking for the apartment of their dreams on their own. According to one of the major real estate agencies, more than 70% of transactions in the Moscow secondary real estate market are conducted with the participation of intermediaries.
However, the seller in theory does not care if he finds directly the buyer or his representative. Therefore, in this case, we are interested in “habitats” of both of them. But since there are more realtors, we’ll start with them ...
What databases on the Internet are used by Moscow realtors is well known. In general, these are the three most popular sources - Winner’s professional classified ads database, real estate agency websites, and From Hand to Hand newspaper website,.
And now I will give out one of the important secrets: realtors try, first of all, to study options on the websites of large real estate agencies. Why? Because these sites are located objects to the maximum extent ready for sale. Namely, their price has already been adjusted by an agent who tried to convey to the owner of the market reality. If we are talking about Moscow, then most likely an exclusive agreement has been concluded with the owner and the latter is aimed at the deal, and not just asking the price. In large agencies, the legal audit service rejected the most dangerous from a criminal point of view options and assessed the risks for the buyer. And from this point of view, it makes sense for the seller to work with large real estate agencies: his apartment will go to the agency’s base, as well as to other major trading floors, if he signs an exclusive agreement with this company (but more on that later). The disadvantages of working with real estate agencies are the need to pay a significant agency commission (3-5% of the market value of housing), as well as the opportunity to get a negligent agent.
If we talk about realtors in Moscow, then they do not need to go around dozens of sites of real estate agencies, since most of the information agencies collected in a professional real estate system Winner. And generally speaking, the seller can easily submit a FREE advertisement for the sale of his apartment directly to this system. This is the second big secret. Рынок недвижимости довольно прост для понимания любого человека. Его образуют две основные стороны: продавец - покупатель и, так называемая, прослойка посредников. Зачастую последние играют самую важную роль в процессе сделки с недвижимостью.
Сначала разберемся, где покупатели ищут себе квартиру. Одни покупатели жилья ищут подходящие варианты с помощью посредников – риэлторов, другие потенциальные владельцы разыскивают квартиру своей мечты самостоятельно. По данным одного из крупных агентств недвижимости, более 70% сделок на рынке вторичной недвижимости Москвы проходит с участием посредников.
Впрочем, продавцу по идее все равно, найдет он непосредственно покупателя или его представителя. Поэтому в данном случае нас интересуют «места обитания» и тех, и других. Но поскольку риэлторов больше – с них и начнем…
Какими базами в Интернете пользуются московские риэлторы, достаточно хорошо известно. В целом это три наиболее популярных источника - профессиональная база объявлений Winner, сайты агентств недвижимости, а также сайт газеты «Из рук в руки», .
А теперь выдам один из важных секретов: риэлторы стараются, прежде всего, изучить варианты на сайтах крупных агентств недвижимости. Почему ? Потому что на этих сайтах расположены объекты в максимальной степени готовые к продаже. А именно, их цена уже прошла коррекцию агентом, который постарался донести до владельца реалии рынка. Если речь о Москве, то, скорее всего с владельцем заключен эксклюзивный договор и последний нацелен на сделку, а не просто приценивается. В крупных агентствах служба юридической проверки отбраковала наиболее опасные с криминальной точки зрения варианты и оценила риски для покупателя. И с этой точки зрения продавцу имеет смысл работать с крупными агентствами недвижимости: его квартира попадет в базу агентства, а также на другие крупнейшие торговые площадки, если он заключит с этой компанией эксклюзивный договор (но об этом чуть позже). Минусы работы с агентствами недвижимости – необходимость оплачивать значительную комиссию агентства (3-5 % от рыночной стоимости жилья), а также возможность получить нерадивого агента.
Если говорить о риэлторах Москвы, то им не нужно обходить десятки сайтов агентств недвижимости, поскольку бОльшая часть информации агентств собрана в профессиональной риэлторской системе Winner. И вообще говоря, продавец спокойно может подать БЕСПЛАТНОЕ объявление о продаже своей квартиры прямо в эту систему. Это второй большой секрет. Надо понимать, что при этом объявление увидят в основном риэлторы, т.е. вы, как продавец, будете обречены работать с посредником и явно или неявно потеряете на комиссии.
Третьим инструментом поиска для профессиональных риэлторов являются порталы по недвижимости, собирающие информацию по всему рынку. Самый популярный в столице - сайт газеты «Из рук в руки» – крупнейшей электронной доски объявлений России. Разместить на нем ваше объявление можно почти бесплатно – около 100 руб/неделю. Правда, по нашему опыту, объявления там работают хуже, поскольку очень велика доля людей, слабо ориентирующихся в рынке и ценах. Да, они интересуются недвижимостью, но хотели бы произвести обмен без доплаты или купить квартиру в центре Москвы до 5 млн. рублей.
Но это еще не все…
Есть еще хорошая рекомендация для продавцов – использовать максимальное количество площадок для размещения объявлений, и использовать новые возможности, такие, как электронные доски объявлений и социальные сети. And in the section “Dimensions and settlement procedure” it is indicated that the contractor does not return the money under any circumstances. I called the landlady's number two weeks several times a day, but no one answered. The agency offered to call this number yet, but no longer offered other housing options.

Today, entire organizations are engaged in deception of gullible citizens on the real estate market. As a result of housing fraud by companies such as Moszhilstroy or Unistroy, almost a thousand Muscovites were left without money and without housing. Then the imaginary realtors were exposed, but today there are many lovers of quick and easy money.

Recently, another large apartment scam was discovered by employees of the Moscow Office for the Suppression of Economic Crimes (UBEP). Its main organizer, 44-year-old Nikolai S., together with his friends, without a license to carry out real estate transactions, published newspaper advertisements for the sale of apartments at low prices. A lot of people who wanted to get apartments at a low price approached their office. False realtors even produced documents stating that they allegedly operate under the auspices of the International Public Fund for the Elimination of Consequences of Emergencies. This is why they explained preferential housing prices. Fraudsters went so far as to sell the same apartments several times. Clients paid a deposit of 20-30% of the cost of virtual apartments. In return, they received fake payment receipts and letters of guarantee. Scammers expected to earn $ 1 million in this way, but managed to get "only" about $ 120 thousand.

“Gave the money away? Free ... "
There are many firms one-day. For several months they collect money from unsuspecting citizens, and then disappear.

Unlike traditional real estate companies, such agencies work according to the following scheme: you pay a monthly rent for the apartment you found (agencies sell only information about the apartments that are supposedly for rent). Then, on your own, ring up the options offered to you. Usually, many agree to this, since it is cheaper. But then it turns out that the information you were given is false or outdated.

Everyone has long heard such scams, but many simpletons come across them today.

What to do?
* registering a contract through a company, check that it has a license for this activity. In no case do not leave your passport and certificate of privatization of the apartment with intermediaries and other persons (tenants, etc.).
* First of all, when concluding an agreement with a real estate company, reflect in as much detail as possible the parameters of the desired housing.
* concluding a contract, a realtor will require you to make some advance payment. This is normal practice: after all, the search for apartment options is associated with some material costs. Another thing is that the size of the advance should be reasonable.

Legal advice
Any contract concluded can theoretically be terminated in court. The realtor is only liable for errors made by his employees directly during the execution of the contract of sale, as well as for violation of his obligations.

In the case of the seller’s dishonesty, the responsibility of the realtor is more of a moral character: the mistakes made are a serious blow to the reputation of the company.

Compensation for the material damage caused to the buyer should be an insurance company with which a real estate company has a contract.

Я сразу ей позвонила, и мы договорились встретиться на следующий день, чтобы осмотреть квартиру. Я заключила договор с агентством, обрадованная быстрым разрешением моей проблемы, и заплатила 1300 рублей. И только потом уже увидела, что в договоре в разделе «Обязанности исполнителя» указан всего один пункт — обеспечивать заказчика (то есть меня) информацией. А в разделе «Размеры и порядок расчетов» указано, что деньги исполнитель не возвращает ни при каких обстоятельствах. По номеру хозяйки квартиры я звонила две недели несколько раз в день, но трубку никто не брал. В агентстве предлагали звонить по этому номеру ещё, а других вариантов жилья больше не предлагали.

Сегодня на рынке недвижимости обманом доверчивых граждан занимаются целые организации. В результате жилищных мошенничествё таких компаний, как «Мосжилстрой» или «Юнистрой», почти тысяча москвичей осталась без денег и без жилья. Тогда мнимых риэлторов разоблачили, но и сегодня находится немало любителей быстрой и легкой наживы.

Недавно очередную крупную квартирную аферу раскрыли сотрудники московского Управления по борьбе с экономическими преступлениями (УБЭП). Главный её организатор, 44-летний Николай С., вместе со своими друзьями, не имея лицензии на совершение операций с недвижимостью, опубликовали в газете объявления о продаже квартир по низким ценам. В их офис обратилось множество желающих получить квартиры по низкой цене. Лжериэлторы даже изготовили документы о том, что они якобы действуют под эгидой отделения Международного общественного фонда ликвидаций последствий аварий и чрезвычайных ситуаций. Этим они и объясняли льготные цены на жилье. Мошенники доходили до того, что продавали одни и те же квартиры несколько раз. Клиенты вносили задатком 20-30% стоимости виртуальных квартир. Взамен они получали поддельные платежные квитанции и гарантийные письма. Аферисты рассчитывали заработать таким образом $1 млн., но успели получить «всего лишь» около $120 тыс.

«Отдал деньги? Свободен…»
Существует множество фирм─однодневок. Они несколько месяцев собирают деньги с ничего не подозревающих граждан, а затем, исчезают.

В отличие от традиционных риэлтерских компаний, такие агентства работают по следующей схеме: вы платите за найденную вам квартиру гонорар в размере месячной аренды (агентства продают лишь сведения о квартирах, которые якобы сдаются). Затем уже самостоятельно обзваниваете предложенные вам варианты. Обычно на это многие соглашаются, так как выходит дешевле. Но потом оказывается, что сведения вам дали недостоверные или устаревшие.

Такого рода афёры у всех давно на слуху, но на них и сегодня попадается множество простаков.

Что делать?
* оформляя договор через фирму, проверьте у нее наличие лицензии на эту деятельность. Ни в коем случае не оставляйте свой паспорт и свидетельство о приватизации квартиры у посредников и иных лиц (арендаторов и т.п.).
* прежде всего, заключая договор с риэлторской компанией, максимально подробно отразите в нем параметры искомого жилья.
* заключая договор, риэлтор потребует от вас внести некоторый аванс. Это нормальная практика: ведь поиск вариантов квартир связан с некоторыми материальными затратами. Другое дело, что размер аванса должен быть разумным.

Юридическая консультация
Любой заключенный договор теоретически может быть расторгнут в суде. Риэлтор отвечает лишь за ошибки, допущенные его сотрудниками, непосредственно при оформлении договора купли-продажи, а также за нарушение своих обязательств.

В случае же недобросовестности продавца ответственность самого риэлтора носит скорее моральный характер: допущенные ошибки — это тяжелый удар по репутации фирмы.

Возмещать причиненный покупателю материальный ущерб должна страховая компания, с которой у риэлторской фирмы заключен договор.
