"The duel." How to behave during interrogation: the opinions of the investigator and the lawyer.

In reality, the mind does not always triumph, and practice shows that the investigator often defeats an educated person than a gang of average intellectual abilities. And today, the circumstances are such that every even the most law-abiding citizen can be interrogated, at least in the role of a witness. About how to behave in this unusual situation, experts say, for whom interrogations are everyday. Although usually they are on opposite sides of the barricades.

“Where do you usually start interrogation?”

At the same time, it is impossible to cross the border and give the enemy psychological advantages, otherwise the interrogation will turn against the investigator. Although the tension in which the accused is located gives the investigator a psychological advantage.
- What tactics does the investigator use?

During the interrogation of the accused, it is necessary to convince the person that it is beneficial for him to testify. To do this, it is necessary to create the impression that he has no other choice but to tell the truth on the basis that the investigation knows everything and the resistance is useless. The ideal case is to supplement the interrogation with a confrontation with the victim or witness. Plus - presenting the suspect with documents and names available to the investigation. Together, this can give a good result. The most effective interrogation immediately after committing a crime.
- They say that sincere recognition eases the soul, but lengthens the term?

No, that was before. Now I would not exaggerate the role of confession, especially under the new Code of Criminal Procedure. Recognition of guilt in itself is not as important as it was in Soviet times. Indeed, according to the new Code of Criminal Procedure, from a confession, if they were given without a lawyer, a person can refuse in court, and the court simply does not recognize them.
- But what about the notorious intellectual duel?

The classic interrogation itself, when the investigator is face to face with the criminal in his office under the light of a lamp and a psychological duel takes place between them, is becoming obsolete. Indeed, according to the new rules, a lawyer can be present during interrogation. Therefore, the role of techniques designed to achieve recognition is weakening - lawyers are doing everything to psychologically protect a person from recognition.

The tendency of the modern criminal process - the role of psychological influence is decreasing in order to obtain a confession. Especially if the accused is a person with a position in society. After all, he has a lawyer, and not one. Any attempt to put pressure even psychologically purely can end for the investigator removal from the case.
- What angers the investigator the most?

The easiest way to set up an investigator against yourself is not to appear for interrogation at all. From experience I can say that this is perceived unambiguously - as rudeness. Any lies, complaints to various authorities - are perceived as a means of protection. But failure to appear for interrogation is the best way to make the investigator work with maximum efficiency against himself. I will not describe the benefits of refusing to testify under Article 51. Constitution, they are obvious. But I want to note that the refusal forms a very specific position with the investigation and the prosecution, and the court evaluates this accordingly. Fragments of legal knowledge obtained from detective literature or bad cinema are also annoying. For example, a person somewhere heard about the 51st article - and understands it so that he should not say anything at all. Although he may turn out to testify only against himself and relatives.
- Who is the most difficult to work with?

With people who think that they are very smart and they all take 2 steps forward. Therefore, they begin to compose, thereby creating a mountain of paper work for the investigator, delaying the process. Trying to deceive the investigation, they put forward absurd and contradictory versions of events. Nevertheless, all this must be checked. In the end, the truth is clarified, but it takes time and a lot of effort to check nobody needs it. For example, I had a case of one district police officer who was accused of a bribe. During a search in his house, cartridges were found in a cassette box. Explaining this, the district police officer composed this version: he bought a video cassette in a stall, came home, opened the box and saw a drawing of Mickey Mouse there, after which it closed and never came up to it again. In order to refute this, he had to go around a bunch of storekeepers, interview them, arrange everything, etc. He still received a term for storing ammunition, but he dragged on the investigation. Such tactics always lead to the fact that the court recognizes the evidence as absurd, and thus a person seeks distrust of his words in court.
- In your experience, who is faster “splitting” - a primitive personality or an intellectual?

Of course, each person has his own psychological barrier. This determines the nature of work with him. Of course, it is believed that among people of intellectuals the psychological barrier is lower, the psyche is thinner, but here it is not the level of education that determines it, but the strength of character. Now a new type of accused has appeared, especially in the field of economic crimes - an educated person, but flint. As for drunkards and simply stupid people - this is not the best material for the investigator, their minus is the abundance of meaningless versions. Still, it is more pleasant to work with an appropriate level of intelligence.

- What tricks do investigators most often resort to during interrogation?

The most commonplace tricks are used. Very often, investigators, prompting a person to testify, play on the simplest human emotions - a feeling of resentment, for example. Often, when a person is detained as a suspect, but has not yet been arrested and no charges have been brought against him, he is told that "we don’t need you, you got anybody else, give evidence and go home." Believe me, such primitive tricks are very effective when a person is in a stressful situation. And interrogation is always a stress for any normal person, even if he is interrogated as a witness. A common interrogation technique is a demonstration of the investigator’s greater knowledge than it actually is.

All of these tricks are applied together. At first they will say that “we all know about you”, then that no one is going to bring you to criminal liability personally. Then they will be asked to testify against other persons who are allegedly actually interested in the investigation. And if it doesn’t work, they will rest on the fact that others have already testified against you, even wave some papers in front of their noses. In addition, people in uniform often exploits myths that exist in the minds of the layman: total wiretapping of phones, detailed dossiers available to every citizen. Hence the message: "we know everything about you, but we want to hear it from you personally."

And there are many such things. Funny as it may seem, even such a cinematic device as a good and bad investigator works during interrogations. When a person is in an atmosphere of psychological pressure, the most primitive signs of location on the opposite side act on him - for example, invitations to drink tea, smoke, talk heart to heart - it is still better than sitting in a cell.

But you must always remember that from a witness, any person can turn into an accused.
- What prohibited tricks do the investigating authorities use?

Most often - intimidation by possible imprisonment: a cell with rapists, beatings, etc. Such provocations, in general, should not be succumbed to. For all my law practice, not one of my clients, who was not a representative of the organized crime group, did not encounter similar problems in the cell. If a person is trained in normal behavioral skills in society, does not lie, does not ascribe non-existent advantages to himself - as a rule, he does not have any special problems in the cell.
“But a person without legal training can recognize all these little things.”

But there are tricks that a professional investigator can catch anyone without special training. For example, defending Foreign Ministry diplomat Valentin Moiseev, whom the FSB accused of espionage, I came across such a case. During interrogation, the investigator asked Moiseyev if he knew the Korean diplomat Cho Song U. Moiseev answered in the affirmative. And the investigator wrote in the report that Moiseyev was familiar with South Korean intelligence officer Cho Sung U. It seems to be a small addition, but fundamentally changes the matter: Moiseyev did not know this and spoke with the Korean as a diplomat from the South Korean Embassy. And according to the protocol, it turned out that the Russian diplomat was talking with a scout from another country, knowingly aware of his illegal activities in Russia.

You’ll say, for example, that you’re familiar with Ivanov, because he’s a neighbor on the porch, and they can write down this way: he closely communicated with Ivanov, the leader of such a criminal group and then in the same spirit. The difference is obvious.
- Each of us, deep down in our hearts, thinks that he will outplay the investigator ...

- Oddly enough, but practice shows that the smarter and more educated a person is, the easier it is to split him during interrogation. After all, he himself is able to draw conclusions and complete logical chains. And when the investigator shows that he knows some details of the event, such a person begins to comprehend what is happening logically, and comes to the conclusion that the investigator knows everything. And speaks, thereby facilitating the investigation work. I know this from my past experience. In addition, an educated person often cannot show that he does not know something and will defend such an image with all his strength. It is psychologically difficult for him to say - I did not know about it, I did not know that.
- How not to become a defendant from a witness?

The main thing is not to say anything to the investigating authorities before meeting with a lawyer. Moreover, with a lawyer whom you yourself or your relatives will invite. You know, the lawyer provided to you from the outside is anyone else's lawyer, but not yours. Still, according to the agenda, it’s better to go to the investigating authorities (be it the district police department or the prosecutor’s office) with a lawyer, even if you are told that this is 5 minutes. This will help to avoid physical and psychological violence, and in the worst case scenario - your loved ones will know exactly where you were sent, and not to search for you throughout the city.

Remember the article of the 51st Constitution - you can refuse to testify, which can be used against you or your relatives. But your refusal to testify should not be provocative - it will anger the investigator and set him against you. Therefore, it is better to adhere to such formulations: I forgot, did not pay attention, because my head hurt. It is also not recommended to state aloud that you are going to complain about the investigator. Your threats will not work anyway, they will only aggravate the situation. All the comments that you had during the interrogation should be recorded in the protocol - and threats, if any, and attempts to exert pressure. After all, this will become a material confirmation of your complaints to higher authorities. Unfortunately, often the lack of complaints in the protocol allows investigating authorities to avoid liability for violations of the law. In any case, a visit to the investigator should be used as a way of obtaining information.

Считается, что допрос - это напряженная психологическая схватка опытного следователя и искушенного преступника. Дуэль умов и мировоззрений.

В литературе победа обычно достается умнейшему. В "Трех мушкетерах" Ришелье было достаточно пяти минут допроса галантерейщика Бонасье, чтобы сделать из него шпиона собственной жены. И "сколь ни ничтожно было торжество над таким жалким созданием, как Бонасье, кардинал все же один миг наслаждался им".

В действительности не всегда торжествует ум, и практика показывает, что следователь чаще обыгрывает образованного человека, чем бандюгу средних интеллектуальных способностей. А сегодня обстоятетельства складываются так, что каждый даже самый законопослушный гражданин может оказаться на допросе, хотя бы в роли свидетеля. О том, как вести себя в этой нестандартной ситуации, рассказывают специалисты, для которых допросы - повседневность. Хотя обычно они находятся по разные стороны баррикад.


Нападение

Михаил Вощинский, прокурор кассационного отдела Генпрокуратуры. До последнего времени работал старшим следователем столичной Симоновской межрайонной прокуратуры. Добился первого судебного приговора по делу о незаконной торговле спецтехникой. По долгу службы Вощинскому приходилось заниматься раскрытием бытовых убийств, должностными и финансовыми преступлениями.
- С чего ты обычно начинаешь допрос?

-Любой допрос - это прежде всего конфликтная, стрессовая ситуация, даже если перед тобой потерпевший или свидетель. Так что первый закон здесь - снять внутреннее напряжение человека и сделать все, чтобы его разговорить. Для подозреваемого или обвиняемого необходимо создать условия для свободного рассказа, избегая прямых вопросов. Для создания установки на общение необходимо что-то общее. А общее у обвиняемого и следователя всегда есть - в любом случае им придется провести много времени вместе. В то же время нельзя переходить границу и давать противнику психологического преимущества, а то допрос обратится против следователя. Хотя напряжение, в котором находится обвиняемый, дает следователю психологическое преимущество.
- Какие тактики использует следователь?

При допросе обвиняемого необходимо убедить человека в том, что ему выгодно дать показания. Для этого надо создать впечатление, что у него нет другого выхода, кроме как сказать правду на основании того, что следствию все известно и сопротивление бесполезно. Идеальный случай - дополнить допрос очной ставкой с потерпевшим или свидетелем. Плюс - предъявление подозреваемому документов и имен, имеющихся в распоряжении следствия. Все вместе это может дать хороший результат. Самый эффективный допрос сразу после совершения преступления.
- Говорят, чистосердечное признание облегчает душу, но удлиняет срок?

Нет, так было раньше. Сейчас я бы не стал преувеличивать роль признательных показаний, особенно при новом уголовно-процессуальном кодексе. Само по себе признание вины сейчас не так важно, как это было в советское время. Ведь по новому УПК, от признательных показаний, если они были даны без адвоката, человек может отказаться в суде, и суд их просто не признает.
- А как же пресловутая интеллектуальная дуэль?

Сам классический допрос, когда следователь находится один на один с преступником в кабинете при свете лампы и между ними происходит психологический поединок, устаревает. Ведь по новым правилам, на допросе может присутствовать адвокат. Поэтому роль приемов, рассчитанных на то, чтобы добиться признания, ослабевает - адвокаты делают все, чтобы оградить психологически человека от признания.

Тенденция современного уголовного процесса - снижается роль психологического воздействия с целью получения признательных показаний. Особенно, если обвиняемый человек с положением в обществе. Ведь он имеет адвоката, и не одного. Любая попытка надавить даже чисто психологически может закончиться для следователя отстранением от дела.
- Что больше всего злит следователя?

Самый простой способ настроить против себя следователя - не являться на допрос вообще. По опыту могу сказать, что это воспринимается однозначно - как хамство. Любое вранье, жалобы в разные инстанции - воспринимаются как средство защиты. Но неявка на допрос - это лучший способ заставить следователя работать с максимальной отдачей против себя. Я не буду расписывать преимуществ отказа от дачи показаний по 51-ой ст. Конституции, они очевидны. Но хочу заметить, что отказ формирует весьма определенную позицию у следствия и обвинения, и судом это оценивается соответственно. Еще раздражают обрывки юридических знаний, полученных из детективной литературы или плохого кино. Например, человек где-то слышал о 51-ой статье - и понимает это так, что он вообще не должен вообще ничего говорить. Хотя он может оказаться от показаний только против себя и родственников.
- C кем сложнее всего работать?

С людьми, которым кажется, что они очень умные и все просчитывают на 2 шага вперед. Поэтому они начинают сочинять, тем самым создают гору бумажной работы для следователя, затягивают процесс. Пытаясь обмануть следствие, они выдвигают абсурдные и противоречивые версии событий. Тем не менее все это надо проверять. В конце концов, истина выясняется, но уходит время и много усилий на никому не нужные проверки. Например, у меня было дело одного участкового, которого обвиняли во взятке. При обыске у него дома в коробке из-под кассеты обнаружили патроны. Объясняя это, участковый сочинил такую версию: он купил в ларьке видеокассету, пришел домой, приоткрыл коробку и увидел там рисунок Микки-Мауса, после чего ее закрыл и больше никогда к ней не подходил. Чтобы опровергнуть это пришлось обойти кучу ларечников, опросить их, все оформить и т. п. Срок за хранение боеприпасов он все равно получил, но затянул следствие. Такая тактика приводит всегда к тому, что суд признает показания абсурдными, и таким образом человек добивается недоверия к своим словами в суде.
- По твоему опыту, кто быстрее "раскалывается" - примитивная личность или интеллектуал?

Конечно, у каждого человека свой психологический барьер. Это и определяет характер работы с ним. Конечно, считается, что у людей интеллигентных барьер психологический ниже, психика тоньше, но определяет здесь все-таки не уровень образования, а твердость характера. Сейчас новый тип обвиняемого появился, особенно в сфере экономических преступлений- человек образованный, но кремень. Что касается пьяниц и просто тупых людей - это не лучший материал для следователя, их минус - обилие бессмысленных версий. Все-таки приятней работать с соответствующим уровнем интеллекта.

Защита

- К каким уловкам чаще всего прибегают следователи при допросе?

В ход идут самые банальные приемы. Очень часто следователи, побуждая человека к даче показаний, играют на простейших человеческих эмоциях - чувство обиды, например. Частенько, когда человек задержан в качестве подозреваемого, но еще не арестован и обвинение не предъявлено, ему говорят, что "ты-то нам не нужен, ты вообще за других попал, дай показания и пойдешь домой". Поверьте, такие примитивные приемы очень эффективны, когда человек находится в стрессовой ситуации. А допрос - всегда стресс для любого нормального человека, даже если его допрашивают в качестве свидетеля. Распространенный прием при допросе - демонстрация большей осведомленности следователя, чем есть на самом деле.

Все эти уловки применяются в совокупности. Сначала скажут, что "мы все про вас знаем", затем, что лично вас никто не собирается привлекать к уголовной ответственности. Потом попросят дать показания на других лиц, которые якобы на самом деле интересуют следствие. А если не подействует, будут упирать на то, что другие-то уже дали показания против вас, даже махать перед носом какими-то бумагами. Кроме того, люди в погонах частенько эксплуатирует мифы, бытующие в сознании обывателя: тотальная прослушка телефонов, подробные досье, имеющиеся на каждого гражданина. Отсюда посыл: "мы о вас все знаем, но хотим услышать это от вас лично".

И таких штучек множество. Как это ни смешно, но работает на допросах даже такой кинематографический прием, как хороший и плохой следователь. Когда человек находится в обстановке психологического давления на него действуют самые примитивные знаки расположения с противоположной стороны - например, приглашения попить чайку, покурить, поговорить по душам - все-таки лучше, чем в камере сидеть.

Но всегда надо помнить о том, что из свидетеля любой человек может превратиться в обвиняемого.
- Какие запрещенные приемчики используют органы следствия?

Чаще всего - запугивание возможным лишением свободы: камера с насильниками, избиения и т. п. На такие провокации, вообще, не стоит поддаваться. За всю свою адвокатскую практику ни один из моих подзащитных, не являвшийся представителем ОПГ, не столкнулся в камере с подобными проблемами. Если человек обучен нормальным навыкам поведения в обществе, не врет, не приписывает себе несуществующих достоинств - никаких особых проблем в камере у него, как правило, не возникает.
- Но все эти штучки и человек без юридической подготовки может распознать.

Но есть уловки, на которые профессиональный следователь может поймать любого человека без специальной подготовки. Например, защищая дипломата МИД Валентина Моисеева, которого ФСБ обвинило в шпионаже, я столкнулся с таким случаем. На допросе следователь спросил Моисеева, был ли он знаком с корейским дипломатом Чо Сон У. Моисеев ответил утвердительно. А в протоколе следователь записал, что Моисеев был знаком с южнокорейским разведчиком Чо Сон У. Вроде бы небольшое добавление, но в корне меняет дело: Моисеев этого не знал и общался с корейцем как с дипломатом из посольства Южной Кореи. А по протоколу получалось, что российский дипломат общался с разведчиком из другой страны, заведомо зная о его незаконной деятельности на территории России.

Вот вы скажете, к примеру, что знакомы с Ивановым, потому что он сосед по подъезду, а записать могут так: тесно общался с Ивановым, лидером такой-то преступной группировки и далее в таком же духе. Разница очевидна.
- Каждый из нас в глубине души думает, что уж он-то следователя переиграет…

- Как ни странно, но практика показывает, что чем умней и образованней человек, тем его проще расколоть на допросе. Ведь он сам в состоянии делать выводы и достраивать логические цепочки. И когда следователь показывает, что ему известны какие-то детали события, такой человек начинает осмысливать происходящее логически, и приходит к выводу, что следователю известно все. И проговаривается, тем самым облегчая следствию работу. Это я еще по своему прошлому опыту знаю. Кроме того, образованный человек часто не может показать, что он чего-то не знает и будет отстаивать такой имидж из последних сил. Ему психологически трудно сказать - я об этом не догадывался, того не знал.
- Как из свидетеля не стать обвиняемым?

Главное - не говорить ничего следственным органам до встречи с адвокатом. Причем с адвокатом, которого пригласите вы сами или ваши родственники. Знайте, адвокат, предоставленный вам со стороны - это чей угодно адвокат, но не ваш. Все-таки по повестке лучше являться в органы следствия (будь то районный ОВД или прокуратура)с адвокатом, даже если вам говорят, что это на 5 минут. Это поможет избежать физического и психологического насилия, а при худшем исходе событий - ваши близкие будут точно знать, куда вас отправили, а не разыскивать вас по всему городу.

Помните о статье 51-ой Конституции - вы можете отказаться от дачи показаний, которые могут быть использованы против вас или ваших родственников. Но ваш отказ от дачи показаний не должен быть вызывающим - это обозлит следователя и настроит его против вас. Поэтому лучше придерживаться таких формулировок: забыл, не обратил внимания, так как болела голова. Также не рекомендуется вслух заявлять о том, что вы собираетесь жаловаться на следователя. Ваши угрозы все равно не подействуют, только обострят обстановку. Все замечания, которые у вас возникли по ходу допроса, необходимо внести в протокол - и угрозы, если они были, и попытки оказывать давление. Ведь это станет материальным подтверждением ваши жалоб в вышестоящие инстанции. К сожалению, частенько отсутствие жалоб в протоколе позволяет органам следствия избегать ответственности за нарушения закона. В любом случае визит к следователю надо использовать как способ получения информации.

Если и вашему адвокату откажутся представлять подробности допроса, необходимо обсудить с ним тактику поведения. Как следователь может ввести в заблуждение? Как поступать в случаях очевидных провокаций?

Подвергайте сомнениям все, о чем говорят вам следователи и оперативники. Не стоит соглашаться давать показания, если вам сулят скорое освобождение.
