Just ten years ago in Russia it was rarely possible to meet high-profile lawyer's investigations. Whereas now they are rapidly gaining momentum. It is enough to recall, at least, the recent case of Judge Elena Khakhaleva from the Krasnodar Territory, who did not have a law degree. Despite the resistance of the judicial community, lawyer Aleksey Salmin, who led the investigation on his own initiative, brought the judge out of education. He traveled to Georgia, to Sukhumi and found a book of orders for admission to a branch of Tbilisi State University, where, according to legend, Elena Khakhaleva studied. In the 1985 section of this book, not a word was found about the judge.
And this is just one example of a successful lawyer's investigation. And how many such consequences end without wide publicity. This happens when a lawyer conducts an investigation in the interests of his applicants and is bound by lawyer secrets. At the same time, few citizens know that lawyers can, are able, and most importantly have the right to conduct investigations. For most, the consequence is the prerogative of law enforcement agencies and private detectives (which in Russia are virtually nonexistent). A private investigation comes down to tracking husbands and wives, as well as tracing for missing dogs. Whereas, as part of a lawyer's investigation, you can check the integrity of business partners or company employees, find witnesses to an event, collect evidence in a criminal case or civil dispute. Буквально еще десять лет назад в России редко можно было встретить громкие адвокатские расследования. Тогда как сейчас они стремительно набирают обороты. Достаточно вспомнить, хотя бы, недавнее дело судьи Елены Хахалевой из Краснодарского края, у которой не оказалось диплома юриста. Несмотря на сопротивление судейского сообщества, судью без образования вывел адвокат Алексей Салмин, который провел расследование по собственной инициативе. Он съездил в Грузию, в Сухуми и нашел книгу приказов о зачислении филиала Тбилисского государственного университета, где по легенде училась Елена Хахалева. В разделе 1985 года этой книги не нашлось ни слова о судье.
И это только один пример успешного адвокатского расследования. А сколько таких следствий заканчиваются без широкой огласки. Это происходит, когда адвокат проводит расследование в интересах своих заявителей и связан адвокатской тайной. При этом, о том, что адвокаты могут, умеют, а главное имеют право проводить расследования знают немногие граждане. Для большинства следствие это прерогатива правоохранительных органов и частных детективов (которых в России практически нет). А частный сыск сводится к слежке за мужьями и женами, а также розыску пропавших собак. Тогда как в рамках адвокатского расследования можно проверить добропорядочность партнеров по бизнесу или сотрудников компании, найти свидетелей какого-либо события, собрать доказательства по уголовному делу или гражданскому спору. Помогает в этом защитникам такой инструмент, как адвокатский запрос. С некоторых пор закон обязывает государственные органы и учреждения отвечать адвокатам в течение 30 дней. Если ответа нет, адресата запроса можно привлечь к административной ответственности по статье 5.39 КоАП РФ. И хотя размер штрафа составляет всего от 5000 до 10 000 рублей для должностных лиц, это все равно важная мера воздействия. Кроме того отказ предоставлять сведения адвокат может обжаловать в судебном порядке.
