Such a product is a direct fall under the articles of the Constitution of the Russian Federation on the right to privacy and personal secrets. Госдума работает над принятием законопроекта об уточнении статьи "о шпионских гаджетах", что должно избавить правоприменительную практику от необоснованных наказаний по статье 138.1 УК РФ, но суды и силовики в регионах продолжают привлекать граждан к ответственности за покупку и продажу таких устройств в интернете.

Госдума в первой половине апреля текущего года приняла в первом чтении законопроекты №641656-7 и №641166-7, которые должны разъяснить правоприменение статьи 138.1 УК РФ (Незаконный оборот специальных технических средств, предназначенных для негласного получения информации), чтоб больше не возникало случаев привлечения к ответственности простых граждан, использующих устройства с видео-, аудиозаписью или функцией слежения в бытовых целях. Поводом для этого, напомним, стало дело фермера из села Лопатки Евгения Васильева, купившего GPS-трекер, чтоб следить за скотиной, но вместо этого стал фигурантом уголовного дела, попав в поле зрения ФСБ.

Казалось бы, здесь ситуация должна работать как в случае с частичной декриминализацией «экстремистской» статьи 282 УК РФ, когда ещё до официального принятия закона уже начали закрывать дела против тех, кто в своё время резко высказался в интернете или перепостил «крамольную» картинку, но нет — дела по 138.1 по прежнему заводят, причем география таких случаев достаточно обширна. Даже несмотря на озвученные в декабре прошлого года Верховным судом РФ разъяснения.

В начале марта текущего года стало известно о деле жителя Томска, который продал в интернете видеорегистратор в виде смайлика, позволяющий осуществлять скрытое видеонаблюдение. Этот факт был выявлен спецслужбами и теперь продавцу придется отвечать за продажу такой спецтехники.

Речь идет о видеорегистраторе марки «KS-IS Smirer KS-079», он действительно замаскирован под «смайлик». Объявление о продаже было размещено им на интернет-сайте «Юла». Поскольку томич не имел лицензии на реализацию специальных технических средств, предназначенных для негласного получения информации, то против него возбудили уголовное дело. В ходе предварительного расследования обвиняемый свою вину полностью признал. Уголовное дело уже расследовано и направлено для рассмотрения в Октябрьский районный суд.

В том же месяце в Киселевске (Кузбасс) попала под следствие местная жительница, которая хотела подзаработать. Так, 33-летняя горожанка нашла предмет, похожий на флеш-карту, и забрала себе. С помощью интернета гражданка выяснила, что устройство предназначено для скрытой звукозаписи.

Женщине прибор был ненужен, и она разместила на популярном сайте объявление о продаже. Публикацией заинтересовались стражи порядка. Оперативники под видом покупателя связались с продавцом и назначили встречу, в ходе которой даму задержали.

В отношении киселевчанки возбудили уголовное дело по 138.1 УК РФ (Незаконный оборот специальных технических средств, предназначенных для негласного получения информации). Фигурантке грозит до четырех лет колонии или штраф до 200 тысяч рублей.

В начале апреля в Курске осужден 30-летний житель областного центра, обвинявшийся по статье 138.1 УК РФ («Незаконный сбыт специального технического средства, предназначенного для негласного получения информации»). Как сообщила пресс-служба УФСБ России по Курской области, его противоправная деятельность была пресечена совместными усилиями с сотрудниками регионального УМВД. Установлено, что курянин занимался продажей через Интернет-магазин скрытых видеокамер, закамуфлированных под датчик движения «IP Камера 2 mp (1080p) скрытая», подпадающих под категорию специального технического средства, предназначенного для негласного получения информации (СТС НПИ).

На основании представленных материалов УФСБ в отношении жителя Курска были возбуждены два уголовных дела. Ленинским районным судом он признан виновным по статье 138.1 УК РФ. Курянину назначено наказание в виде штрафа в 15 тысяч рублей. Приговор суда вступил в законную силу.

На кировчанина завели уголовное дело за продажу спортивных очков «с сюрпризом». Как сообщили в СК, в октября 2018 года, кировчанин продавал очки со встроенной видеокамерой. Правоохранительные органы начали проверку в связи с этим фактом. В итоге исследование показало, что электронные «очки спорт» со встроенной видеокамерой соответствуют категории специальных технических средств для негласного получения информации, а именно «специальные технические средства для негласного визуального наблюдения и документирования».

«Указанные материалы, — говорится в пресс-релизе УМВД России по Кировской области, — были переданы в следственные органы для принятия процессуального решения. По данному факту следователями регионального Следственного комитета возбуждено уголовное дело по ст. 138.1 УК РФ. В настоящее время следователи проводят необходимые следственные действия, молодой человек вину в совершенном преступлении признал. Расследование продолжается».

Но есть и случаи, когда суды и следствие неожиданно занимало либеральную позицию. Так, в Ингушетии СК закрыл уголовное дело против бывшего полицейского Магомеда Берсанова, которого обвиняли в приобретении так называемого шпионского устройства — GPS-трекера со встроенным микрофоном. По словам адвоката Берсанова Адама Ужахова, следователи не обнаружили состава преступления. Впрочем, теперь экс-полицейский намерен обжаловать решение СК и добиваться закрытия дела по другой причине — из-за отсутствия события преступления. Это даст Берсанову право на реабилитацию и возможность вновь работать в правоохранительных органах.

Недавно житель Барнаула был осужден за реализацию запрещенных в России технических средств. Как сообщает краевая прокуратура, он продавал их под видом обычной флешки. Эти специальные технические средства предназначены для негласного получения информации с помощью функции записи аудиосигнала со встроенного микрофона. Осужденный знал данный факт, но его это не остановило. Он продавал спецфлешки через интернет. Такой товар – прямое попадание под статьи Конституции РФ о праве на неприкосновенность частной жизни и личную тайну. Суд приговорил подсудимого по ст. 138.1 УК РФ к штрафу в размере 20 000 рублей.

Напомним, законопроекты об уточнении понятия «специального технического средства, предназначенного для негласного получения информации» и О внесении изменения в статью 20.23 Кодекса Российской Федерации об административных правонарушениях (в части уточнения понятия «специальные технические средства, предназначенные для негласного получения информации»)» были приняты в первом чтении Госдумой в первой половине апреля текущего года. Срок предоставления поправок ко второму чтению предоставлен до 9 мая 2019 года.
