CHECK PURCHASE OF DRUGS AND PSYCHOTROPIC SUBSTANCES

Introduction


The judicial system of the Russian Federation has now finally approved the requirements for the procedure, as well as the conditions for the implementation and proper recording of the results of operational investigative activities (hereinafter - the ARD), the formation of which was greatly facilitated by the practice of handling complaints in criminal cases by the European Court of Human Rights person (hereinafter - the ECHR).

At the same time, this issue still remains relevant in the law enforcement practice of operational units, including during the Federal Drug Control Service of Russia and the Ministry of Internal Affairs of Russia, the test purchase of narcotic drugs and psychotropic substances (hereinafter - test purchase).

So, taking into account the tacit nature of the aforementioned operational-search measures (hereinafter - ORM), as well as the use of confidential sources of information, there are various interpretations of the concept of sufficiency of grounds for a test purchase, admissibility and the limits of use of its results. This circumstance often entails the recognition of unacceptable evidence at the stage of pre-trial proceedings and in criminal proceedings in court.

These shortcomings indicate the absence of a unified methodology and due effectiveness of prosecutorial supervision over the legality of the implementation of the ARD.

In this regard, special attention should be paid by supervising prosecutors to compliance with the requirements and conditions for the preparation and conduct of test purchases by the operational units of the Federal Drug Control Service of Russia and the Ministry of Internal Affairs of Russia.

Features of the organization and conduct of test purchases.

1. 1. The concept of test purchases


Article 6 of the Federal Law of 12.08.1995 No. 144-ФЗ On Operationally-Search Activities (hereinafter referred to as Federal Law No. 144) provides an exhaustive list of ORMs, which include a test purchase. At the same time, this federal law does not disclose its content and implementation procedure.

The concept of a test purchase is reflected in the Federal Law of 08.01.1998 No. 3-FZ (as amended on 02/03/2015) “On Narcotic Drugs and Psychotropic Substances”, which establishes that a test purchase is an operational-search measure, in which with knowledge and under the control of the bodies engaged in operational-search activities allows the purchase of narcotic drugs, psychotropic substances and their precursors, as well as tools or equipment (Article 49).


Currently under test purchase in departmental regulatory legal acts Federal Drug Control Service of Russia and the Ministry of Internal Affairs of Russia It means the creation of a situation controlled by the operational unit during which narcotic drugs and psychotropic substances are acquired through the conclusion of a reimbursable transaction with a person reasonably suspected of committing a crime, in order to obtain information about his probable criminal activity, as well as solving other tasks of the ARD (paragraph 23 of the Instructions [1] , paragraph 34 of the Manual [2] )

1.2. Grounds and conditions for conducting a calibration purchase

Subject to the requirements of Federal Law No. 144 and the prevailing law enforcement practice, the general basis for conducting a test purchase is the information that has become known to the authorities carrying out the ARD about the signs of the illegal act being prepared, committed or committed, as well as about the persons preparing it, committing or having committed, if not sufficient data to resolve the issue of criminal proceedings.

The specified basis is specified only in the Manual, paragraph 34.3 of which provides that Before making a test purchase, it is advisable to conduct other ORM confirming suspicions that the seller has sold items, substances, including drugs.

This legal provision is consistent with the position of the ECHR that “in cases in which the main evidence was obtained through a secret operation, such as a test purchase of drugs, the authorities must prove that they had sufficient grounds for organizing a secret event” [3] .

The sufficiency of data for a test purchase is a conditional category and is determined by the circumstances of each particular case, taking into account the established criteria of judicial practice.

For example, the elements characterizing the unlawful activity of a particular person or the intention to carry it out are, among other things, his awareness of the types of narcotic drugs, the prices acting on them, the ability to immediately get them, the material benefits of the transaction, which are recorded through special technical means during secret surveillance as well as records of telephone or other negotiations of the suspect with the drug supplier (complaints to the ECHR No. 18757/06 “Bannikova v. Russian Federation”, No. 67537/01 “Shannon v. the United Kingdom” and others).

At the same time, information that in the past a person was prosecuted, including for crimes in the field of drug trafficking, as well as a simple statement by operational staff about the availability of information indicating that the person involved in drug trafficking cannot be considered sufficient.

So, having examined the complaint Druzhinina AND.The. dated 12.11.2009 No. 556/10, the ECHR expressly stated that, having received only information from the informant and not having verified it, the law enforcement authorities did not have sufficient data to suspect the applicant of drug trafficking. Having organized a test purchase, they were quite aware that I. Druzhinin could sell drugs for the first time as a result of exposure to an informant buyer.

It should be borne in mind that any information regarding the current intention to commit a crime should be carried out by conducting such ORM, the results of which can subsequently be provided to the preliminary investigation body and verified at the hearing.

In addition, documented information should clearly indicate that the crime would have been committed without the intervention of law enforcement agencies.

Otherwise, we should talk about provocation of a crime, that is, a violation of Article 5 of Federal Law No. 144,

containing a categorical prohibition on incitement, inducement and inducement, directly or indirectly, to commit unlawful acts.

It must be taken into account that provocation or incitement to commit a crime includes any action that could be construed as putting pressure on a person to commit an offense. In particular, they include the initiative appeal of a person who secretly facilitates the operational unit to the seller with a repeated request for the sale of drugs, despite the initial refusal, persistent reminders, an increase in the price above the average, and references to the withdrawal syndrome of the buyer in order to arouse a feeling of compassion.

For example, during the consideration of the ECHR complaints of Zolotukhin MB dated 05.05.2007 No. 24009⁄07, the circumstances of the incitement of the applicant to the sale of drugs by the informant who called him several times, including in the presence of law enforcement officials, and offered to sell drugs, were investigated. These circumstances, as well as the facts of the repeated participation of the informant in other test purchases in relation to other persons, were revealed by the ECHR during the consideration of this complaint and were not subjected to proper analysis by the national judicial system.

When checking the legality of making a test purchase, it should be borne in mind that the active participation of law enforcement agencies in negotiations actually induces a person to sell drugs. Therefore, both before the test purchase, and in the process of its implementation, the marketer must inform himself about the availability of the opportunity to sell the drug and (or) offer it. In addition, such information should be documented (for example, recorded as a result of wiretapping or surveillance using unwritten audio recordings).

It should also be borne in mind that the ECtHR has formulated a categorical conclusion on the need a clear separation of the forms of use of persons confidentially assisting operational units as a source of information and their participation in secret events. It is separately emphasized that their role should remain strictly passive so as not to incite the commission of a crime, which is difficult to achieve when a test purchase is made by an informant acting as a buyer (complaint “Khudobin v. Russian Federation” dated 10.29.1999 No. 59696/00).

Taking into account the stated positions, an algorithm for documenting the facts of illegal sale of narcotic drugs and psychotropic substances is proposed to be differentiated into a number of basic interrelated stages in the preparation, conduct of test purchases and the use of its results.

Stage number 1. Verification of primary data on a person's possible involvement in drug trafficking

Base: receipt in the operational unit of the data provided for by subparagraph 1 of paragraph 2 of part 1 of Article 7 of Federal Law No. 144.

Purpose: preliminary verification of operational information received, necessary for making a decision on a test purchase.

The purpose of ensuring the subsequent use of the results of the ARD in proving the formation of intent for an object, regardless of the intervention of law enforcement agencies, can be achieved by conducting the following ORM, not suggesting any impact on the inspected person:

- A survey with encryption of the purpose of persons from the environment of the person involved (neighbors, colleagues, acquaintances, etc.) with a view to establishing the facts of his contacts with citizens who use drugs, other suspicious behavior (in the absence of a threat of decryption of operational interest);

- listening to telephone conversations of the person involved, taking information from the technical communication channels used by him;

- monitoring, including that carried out by the operational search units, of the alleged drug dealer with documentation of the operatively significant actions and contacts. The use during the specified ORM of special technical means for recording conversations of the object with the environment or potential buyers, containing data on its initiative proposal to purchase drugs or participation in their systematic sale to an indefinite number of people.

At this stage, it is possible to use confidential assistance of persons who have operational approaches to the facility and (or) provided primary information (hereinafter referred to as primary confidants) when carrying out relevant operational and technical measures. Moreover, their line of conduct in relation to the defendant should be exclusively passive. Assistance is allowed in equipping the facility for carrying out an operational-technical event, as well as in the form of personal use of special technical means. Any active influence on the behavior of the object of operational verification, including the sale of drugs expressed in requests and persuasions, is prohibited.

Stage number 2. Preparation and conduct of ORM “test purchase”.

Base: documented results of ORM, which can be provided to the preliminary investigation body without prejudice to the interests of the ARD and verified in criminal procedure, directly or indirectly indicating the involvement of the person involved in drug trafficking.

Purpose: documentation of a possible fact of sale of drugs; suppression of the criminal activity of the defendant (when deciding on his detention).

At this stage, the operations officer selects a person to participate as a buyer during the test purchase (hereinafter - the buyer). The indicated person should not be the primary confidential. Consent of a citizen to participate in ORM as a buyer must be drawn up in the form of a written statement reflecting his familiarization with the signs of unacceptable provocative actions.

It should be noted that in the presence of documented results of primary ORM that meet the specified requirements, an operational employee can also act as a buyer.

During the organization of test purchases in bodies Federal Drug Control Service of Russia the operational officer draws up a report on its implementation, which is submitted to the head of the operational unit. If necessary, the draft plan of the test purchase is attached to the report, as well as other necessary documents (memorandum of reference, extract from the secret service, etc.) (paragraph 9 of the Instruction) [4].

[4] The instruction on the organization and conduct of the operational-search measure “test purchase” by the bodies controlling the circulation of narcotic drugs and psychotropic substances, approved by order of the Federal Drug Control Service of Russia dated 06.22.2009 No. 0025 (hereinafter referred to as the instruction dated 22.06.2009).

The decision to conduct a test purchase is made by the operational officer of the Federal Drug Control Service, organizing its conduct, and consists of three parts: introductory, descriptive and resolutive.

The introductory part should include the name of the document, place and date of its issuance, last name, initials, position and special rank of the person who issued the decision.

The narrative of the decision must necessarily indicate the essence of the available operational information, when, where, during what period it is planned to conduct a test purchase, what is the subject of a test purchase and the specific purpose of the conducted ORM. The narrative of the decision should end with a link to articles 6 and 8 of Federal Law No. 144.

At the same time, it should be borne in mind that, by departmental order, it is forbidden to reflect the number and (or) the name of the operational accounting case, as well as any information on persons providing confidential assistance (including pseudonyms) in the narrative of the decision to conduct the ORM. These restrictions ensure compliance with the principle of conspiracy in connection with the subsequent direction of the decision to the investigator and familiarization with it of the participants in the criminal process.

The operative part of the decision sets out the decision to conduct the ORM, adopted by the person who issued the decision, indicates his position, special rank, last name, initials.

The decision on the test purchase is made in one copy and approved by the Federal Drug Control Service of Russia by the Director of the Federal Drug Control Service of Russia (his deputy in accordance with the distribution of duties); in the territorial authority of the Federal Drug Control Service of Russia - by the head of the territorial authority of the Federal Drug Control Service of Russia (his deputy in accordance with the distribution of duties).

It should be borne in mind that the heads of territorial bodies of the Federal Drug Control Service of Russia are allowed to provide the heads of inter-district (city) departments with the right to approve only decisions on conducting a test purchase of items, substances and products, the free sale of which is not prohibited or whose circulation is not limited (paragraph 10 of the Instructions of 22.06. 2009).

In system Ministry of Internal Affairs of Russia Before making a decision to conduct a test purchase of items, substances and products whose free sale is prohibited or whose circulation is limited, it is necessary to prepare operational and service documents containing the seller’s information, tasks solved by this ORM, and the calculation of the forces and means involved (paragraph 34.1 of the Manual ) The specified resolution is approved by the head authorized to carry out the MRA (the list of managers is determined by order of the Ministry of Internal Affairs of Russia dated 06/19/2012 No. 608 "On some issues of the organization of operational-search activities in the system of the Ministry of Internal Affairs of Russia"). In preparation for the test purchase, by the operational unit of the Ministry of Internal Affairs of Russia, in contrast to the requirements of the Federal Drug Control Service of Russia, each case a plan is drawn up indicating the positions provided for in paragraph 34.4 of the Manual.

When conducting a test purchase, audio recording and (or) video recording, and (or) filming, and (or) photography must be used,

and other technical and other means can be used that do not harm the life and health of people and do not harm the environment.

The authorized prosecutors should remember that if there are objective reasons that impede the use of technical means during the test purchase, the operational officer submits a motivated report to the head of the operational unit of the territorial drug control body before the indicated ORM is conducted.

The head of the operational unit makes a decision on the possibility of conducting an ORM without the use of technical means (paragraph 4 of the Instructions of 06.22.2009).

The order of the test purchase is regulated in detail only in the regulatory legal act of the Federal Drug Control Service of Russia and is as follows.

Before starting a test purchase, an operational officer in the presence of at least two eyewitnesses (an analogue of the institution understood in the criminal trial) should inspect a person who imitates the role of a “buyer” in order to record the absence of this person with him, in his clothes, the things that are with him, used vehicle of narcotic substances, psychotropic, potent and toxic substances, cash; other materials and items whose free circulation in the territory of the Russian Federation is limited or prohibited.

A person imitating the role of a “buyer” is given technical means (indicating information about the audio and video information media, as well as measures taken to ensure that it cannot be replaced, for example, by sealing the appropriate compartment) and money (items) intended for use in as means of payment during the test purchase, which are pre-copied and (or) photographed, and (or) their individual distinguishing features are described (type of currency, quantity, denomination, series and number of each bill), and (or) are marked with special means. If necessary, a specialist is involved. The result is drawn up by the relevant act.

After conducting a test purchase in the presence of at least two eyewitnesses, a person imitating the role of a “buyer” is obliged to give out to the operational officer the purchased drugs and the technical and financial means (if any) previously transferred to him, about which a corresponding act is drawn up.

In cases where the conduct of a test purchase is aimed at directly suppressing the criminal activity of the drug dealer, its detention is envisaged. In turn, during the detention of the person in respect of whom the test purchase was carried out, in accordance with paragraph 13 of the Instructions dated 06/22/2009, the operative officer should conduct an inspection of him, obtain samples from the detainee for a comparative study (washings from the palms of the hands, subungual contents or sections of nails) . If necessary, clothing and pockets are inspected for signs of a special substance or narcotic drug (other purchased substance), and appropriate samples are removed from clothing. The result is drawn up by the relevant act.

It should be noted that the current Federal Law No. 144 of the basis and procedure for the detention and search of detained persons during the implementation by the bodies of internal affairs and drug control of operational-search activities are not provided.

These issues, depending on specific circumstances, are regulated by Federal Law dated 07.02.2011 No. 3-FZ “On Police” (Clause 13 of Part 1 of Article 13 “Police Rights (for ATS), Article 14“ Detention ”), CAO RF (Article 27.3“ Administrative detention ”, Article 27.7“ Personal search, search of things held by an individual ”) and the Code of Criminal Procedure of the Russian Federation.

Moreover, given the existence of various types of physical restrictions on the freedom of persons in connection with the implementation of state coercion measures and the corresponding features of the procedural design, the actions of operational employees to seize items transferred by the buyer to the seller during the test purchase, in practice, it is advisable to document in the following legal regimes.

So, after receiving information about the drug purchase and sale transaction, the operative officers come into contact with the distributor, introduce themselves, announce the conduct of an ORM against him, explaining the respective rights and obligations. After that, he is invited to give out the items he has and explain their origin, presenting for inspection the contents of the pockets of clothing and hand luggage. In the case of the voluntary issue of funds and other items of operational interest, including drugs, the latter are seized in accordance with paragraph 1 of part 1 of Article 15 of Federal Law No. 144 with the preparation of a protocol in accordance with the requirements of the criminal procedure law.

To certify the indicated actions, subject to conditions determined by the operational situation, individuals may be involved with their consent, meeting the requirements for witnesses in criminal proceedings.

In cases requiring mandatory detention of the drug dealer, the relevant actions of operational officers are organized in cooperation with the preliminary investigation body and are carried out on the grounds and in the manner prescribed by the criminal procedure law.

As a rule, a series of test purchases is preceded by solving the tasks of stopping the functioning of organized criminal groups and criminal communities, identifying all their participants, drug supply channels and places of drug production, during which, according to the plan for operational development, “ordinary” marketers are not detained until a certain point at mandatory subject to documenting their actions and seizing drugs from illicit trafficking.

At the same time, based on the results of initial test purchases, taking into account the requirements of the Code of Criminal Procedure of the Russian Federation, criminal cases are instituted within a reasonable time frame during which, when deciding on the sale of materials, there is a criminal procedure for the arrest of the defendants and the criminal behavior of the defendants.

In this regard, the Supreme Court of the Russian Federation proposes to take into account that the conduct of the next test purchase from the same person should be justified and motivated, including new reasons and goals, and mandatory new resolution approved by the head of the body conducting operational investigative activities [five] .

It should be noted that, in addition to the specified operational and service documents, clause 14 of the Instructions of 06.22.2009 obliges operative employees to finalize the results of the test purchase by the act provided for in the relevant appendix. Documents confirming the transaction (if any), purchased (seized) items, substances and products, other necessary materials are attached to it.

In addition, the results of the test purchase operational officer must report to the person who approved the decision on its implementation.

The report sets out:

- The main results of the event;

- materials reflecting the progress and results of the test purchase, as well as the values, objects, substances, products purchased and seized during the course of its conduct. It is indicated where and for what purpose they were presented or should be sent;

- proposals for further use or a place of storage of documents that reflect the preparation and progress of the test purchase, purchased and seized during the course of its holding of values, items, substances, products;

- if necessary, proposals on measures to ensure the safety of those involved in the test purchase;

- other necessary information.

The report on the ORM “test purchase” and the act on the expenditures allocated for the test purchase of funds should be attached to the report (paragraph 15 of the Instructions dated 06.22.2009).

In system Ministry of Internal Affairs of Russia the results of the test purchase are also documented in an act (paragraph 34.8 of the Manual).

The proposed algorithm for documenting the progress and results of a test purchase does not contradict the requirements of the Manual and can be used in the operational-search activities of internal affairs bodies.

(The final stage) The use of the results of the operational search measures "test purchase"

The procedure for providing the results of the ARD to the preliminary investigation body or to the court is regulated in sufficient detail by the Instruction [6].

[6] Instruction on the procedure for presenting the results of operational investigative activities to the inquiry body, investigator or court, approved by order of the Ministry of Internal Affairs of Russia, the Ministry of Defense of Russia, the FSB of Russia, the FSO of Russia, the Federal Customs Service of Russia, the Foreign Intelligence Service of Russia, the Federal Penitentiary Service of Russia, the Federal Drug Control Service of Russia, and the Criminal Code of Russia No. 776/703/509 / 507/1820/42/535/398/68 from 09/27/2013 (hereinafter - the Instruction from 09/27/2013)

There are no significant features of the provision of ORM results “test purchase” in accordance with Article 11 of Federal Law No. 144, requiring a separate statement.

At the same time, in practice, they are often allowed the following violations in the activities of operational units to be considered when exercising supervisory powers:

- the results of the ARD are submitted to the preliminary investigation body simultaneously in the form of a report on the detection of evidence of a crime and a report on the results of the ARD;

- the prepared operational and service documents do not comply with the models provided for by the Instructions of 09/27/2013;

- the results of the ARD, provided to resolve the issue of instituting criminal proceedings and the subsequent generation of evidence, do not contain information about where, when, what signs and which particular crime was discovered; under what circumstances did they occur; there are no indications of ORM, during which alleged evidence was obtained (there are cases of reflection of only data on organizational and tactical forms of using special technical means: “NAZ”, “NVD”, “NSI”, etc.).

Summarizing the indicated requirements for evidence obtained as a result of the test purchase, one indispensable rule for documenting drug crimes should be indicated:

the results of the test purchase should not be the only and main evidence in criminal cases of crimes related to drug trafficking.

Conclusion

The massive use for criminal purposes of non-contact methods of transferring prohibited substances that make it difficult for the seller to identify (instant messaging services (ICQ), websites with a high degree of cryptographic protection of technical channels, electronic settlement systems, secret operations, etc.), as well as actual communication subjects of shadow sale exclusively in the virtual space level the effectiveness and often the expediency of pre-existing methods and methods of combating drug crime. In this regard, the current state of the operative-search activity of law enforcement agencies in the context of a dynamically developing information and technical infrastructure of the society, unprecedented activation of criminal structures in the market for the sale of new types of drugs requires a significant improvement in its organization and tactics.

Strict observance of the requirements of Russian legislation and universally recognized norms of the European Convention for the Protection of Human Rights and Fundamental Freedoms becomes the fundamental principle of effective counteraction to the drug threat, which contributes to the inevitability of punishment of participants in organized criminal groups. At the same time, the stereotyped nature of the organization and direct implementation of the ARD, the lack of a creative approach to solving its problems, coupled with the legal illiteracy of a number of operational employees, leads to a decrease in offensiveness in the elimination of drug trafficking. Only a clear understanding by the operational staff of the grounds and conditions for the legitimate exercise of their powers, focus on solving specific tasks of the ARD through the effective and integrated use of available forces and means will help strengthen the rule of law in this area.

When considering cases against the Russian Federation, the ECHR expressed an ambiguous position that the lack of a clear and predictable procedure for authorizing a test purchase, its resolution through a simple administrative decision of the same body makes it possible to conduct an event without any independent control and the need to justify its implementation . Making such a conclusion, the ECHR did not take into account the statutory powers of the prosecution authorities to oversee the implementation of laws by the authorities that carry out the ARD, including in the preparation and conduct of the test purchase.

At the same time, the emergence of such a court position is not accidental and is largely due to repeated violations of the law during the implementation of the ARD, not prevented by authorized prosecutors due to the lack of a system for implementing preventive mechanisms for supervisory activity.

Thus, the prosecutor's supervision undoubtedly plays a special role in ensuring the rule of law in the implementation of the ARD.

В судебной системе Российской Федерации в настоящее время окончательно утвердились требования, предъявляемые к порядку, а также условиям осуществления и надлежащей фиксации результатов оперативно-розыскной деятельности (далее — ОРД), формированию которых в значительной степени способствовала практика рассмотрения жалоб по уголовным делам Европейским Судом по правам человека (далее — ЕСПЧ).

Вместе с тем данный вопрос все еще остается актуальным в правоприменительной практике оперативных подразделений, в том числе при проведении ФСКН России и МВД России проверочной закупки наркотических средств и психотропных веществ (далее — проверочная закупка).

Так, с учетом негласного характера проведения названного оперативно-розыскного мероприятия (далее — ОРМ), а также использования конфиденциальных источников информации существуют различные трактовки понятия достаточности оснований для проверочной закупки, допустимости и пределов использования ее результатов. Это обстоятельство зачастую влечет признание недопустимыми доказательств на стадии досудебного производства и при рассмотрении уголовного дела в суде.

Указанные недостатки свидетельствуют об отсутствии единой методики и должной эффективности прокурорского надзора за законностью осуществления ОРД.

В этой связи следует обратить особое внимание надзирающих прокуроров на соблюдение требований и условий подготовки и проведения оперативными подразделениями ФСКН России и МВД России проверочной закупки.

Особенности порядка организации и проведения проверочной закупки.

1. 1. Понятие проверочной закупки


В статье 6 Федерального закона от 12.08.1995 №144-ФЗ «Об оперативно-розыскной деятельности» (далее — Федеральный закон №144) приведен исчерпывающий перечень ОРМ, к числу которых отнесена проверочная закупка. В то же время в данном федеральной законе не раскрываются ее содержание и порядок осуществления.

Понятие проверочной закупки отражено в Федеральном законе от 08.01.1998 № 3-ФЗ (ред. от 03.02.2015) «О наркотических средствах и психотропных веществах», которым установлено, что проверочной закупкой является оперативно-розыскное мероприятие, при котором с ведома и под контролем органов, осуществляющих оперативно-розыскную деятельность, допускается приобретение наркотических средств, психотропных веществ и их прекурсоров, а также инструментов или оборудования (статья49).


В настоящее время под проверочной закупкой в ведомственных нормативных правовых актах ФСКН России и МВД России понимается создание контролируемой оперативным подразделением ситуации, в ходе которой приобретаются наркотические средства и психотропные вещества путем заключения возмездной сделки с лицом, обоснованно подозреваемым в совершении преступления, с целью получения информации о его вероятной преступной деятельности, а также решения иных задач ОРД (пункт 23 Инструкции [1], пункт 34 Наставления [2]).

1.2.Основания и условия проведения поверочной закупки

С учетом требований Федерального закона № 144 и сложившейся правоприменительной практики общим основанием для проведения проверочной закупки являются ставшие известными органам, осуществляющим ОРД, сведения о признаках подготавливаемого, совершаемого или совершенного противоправного деяния, а также о лицах, его подготавливающих, совершающих или совершивших, если нет достаточных данных для решения вопроса о возбуждении уголовного дела.

Указанное основание конкретизировано лишь в Наставлении, пунктом 34.3 которого предусмотрено, что до осуществления проверочной закупки целесообразно проведение иных ОРМ, подтверждающих подозрения о реализации продавцом предметов, веществ, в том числе наркотических.

Данная правовая норма соответствует позиции ЕСПЧ о том, что «в делах, в которых основное доказательство получено за счет негласной операции, такой как проверочная закупка наркотиков, власти должны доказать, что они имели достаточные основания для организации негласного мероприятия» [3].

Достаточность данных для проведения проверочной закупки является условной категорией и определяется обстоятельствами каждого конкретного случая с учетом устоявшихся критериев судебной практики.

Например, элементами, характеризующими противоправную деятельность конкретного лица или намерение ее осуществить, являются в том числе его осведомленность о видах наркотических средств, действующих на них ценах, способность их незамедлительно достать, материальная выгода от сделки, которые зафиксированы посредством специальных технических средств в ходе негласного наблюдения, а также записи телефонных или иных переговоров подозреваемого лица с поставщиком наркотиков (жалобы в ЕСПЧ №18757/06 «Банникова против Российской Федерации», №67537/01 «Шаннон против Соединенного Королевства» и другие).

Вместе с тем сведения о том, что в прошлом лицо привлекалось к уголовной ответственности, в том числе за преступления в сфере незаконного оборота наркотических средств, а также простое утверждение оперативных сотрудников о наличии информации, свидетельствующей о причастности фигуранта к распространению наркотиков, нельзя признавать достаточными.

Так, рассмотрев жалобу Дружинина И.В. от 12.11.2009 №556/10, ЕСПЧ прямо указал, что, получив лишь сведения от информатора и не проверив их, правоохранительные органы не имели достаточных данных, позволяющих подозревать заявителя в сбыте наркотиков. Организовав проверочную закупку, они вполне осознавали, что Дружинин И.В. мог продать наркотики впервые в результате воздействия информатора-покупателя.

Следует иметь в виду, что любая информация, касающаяся существующего намерения совершать преступление, должна быть проведена путем проведения таких ОРМ, результаты которых в последующем возможно предоставить органу предварительного расследования и проверить в судебном заседании.

Кроме того, задокументированная информация должна однозначно свидетельствовать о том, что преступление было бы совершено без вмешательства правоохранительных органов.

В противном случае следует вести речь о провокации преступления, то есть о нарушении статьи 5 Федерального закона №144,

содержащей категорический запрет на подстрекательство, склонение и побуждение в прямой или косвенной форме к совершению противоправных действий.

Необходимо принимать во внимание, что к провокации или подстрекательству к совершению преступления относятся любые действия, которые могут быть истолкованы как оказание давления на человека с целью совершения им правонарушения. В частности, к ним можно отнести инициативное обращение лица, негласно содействующего оперативному подразделению, к сбытчику с повторной просьбой о продаже наркотиков, несмотря на первоначальный отказ, настойчивые напоминания, повышение цены сверх средней, ссылки на абстинентный синдром покупателя в целях возбуждения чувства сострадания.

Например, в ходе рассмотрения ЕСПЧ жалобы Золотухина М.Б. от 03.05.2007 № 24009⁄07 исследовались обстоятельства подстрекательства заявителя к сбыту наркотиков со стороны информатора, несколько раз звонившего ему, в том числе в присутствии представителей правоохранительных органов, и предлагавшего продать наркотики. Данные обстоятельства, как и факты неоднократного участия информатора в других проверочных закупках в отношении иных лиц, были выявлены ЕСПЧ в ходе рассмотрения указанной жалобы и не подвергались надлежащему анализу со стороны национальной судебной системы.

Проверяя законность производства проверочной закупки, следует учитывать, что активное участие правоохранительных органов в переговорах фактически побуждает лицо к реализации наркотиков. Поэтому как до проведения проверочной закупки, так и в процессе ее осуществления сбытчик должен сам сообщить о наличии у него возможности реализовать наркотическое средство и (или) предложить это. К тому же такие сведения должны быть документально подтверждены (например, зафиксированы в результате прослушивания телефонных переговоров или наблюдения с использованием негласной аудиозаписи).

Следует также иметь в виду, что ЕСПЧ сформулирован категорический вывод о необходимости четкого разделения форм использования лиц, конфиденциально содействующих оперативным подразделениям, в качестве источника информации и их участия в негласных мероприятиях. Отдельно подчеркнуто, что их роль должна оставаться строго пассивной, чтобы не подстрекать к совершению преступления, что труднодостижимо, когда проверочная закупка совершается информатором, действующим в качестве покупателя (жалоба «Худобин против Российской Федерации» от 29.10.1999 № 59696/00).

С учетом изложенных позиций предлагается алгоритм документирования фактов незаконного сбыта наркотических средств и психотропных веществ дифференцировать на ряд основных взаимосвязанных этапов по подготовке, проведению проверочной закупки и использованию ее результатов.

Этап №1. Проверка первичных данных о возможной причастности лица к незаконному сбыту наркотиков

Основание: поступление в оперативное подразделение данных, предусмотренных подпунктом 1 пункта 2 части 1 статьи 7 Федерального закона № 144.

Цель: предварительная проверка полученной оперативной информации, необходимая для принятия решения о проведении проверочной закупки.

Цель обеспечения последующего использования результатов ОРД в доказывании формирования умысла у объекта вне зависимости от вмешательства правоохранительных органов может быть достигнута путем проведения следующих ОРМ, не предполагающих какого-либо воздействия на проверяемое лицо:

— опрос с зашифровкой цели лиц из окружения фигуранта (соседей, сослуживцев, знакомых и др.) на предмет установления фактов его контактов с гражданами, употребляющими наркотические средства, иного подозрительного поведения (при отсутствии угрозы расшифровки оперативного интереса);

— прослушивание телефонных переговоров фигуранта, снятие информации с используемых им технических каналов связи;

— наблюдение, в том числе осуществляемое оперативно-поисковыми подразделениями, за предполагаемым сбытчиком наркотиков с документированием оперативно значимых действий и контактов. Применение в ходе указанного ОРМ специальных технических средств по фиксации разговоров объекта с окружением или возможными покупателями, содержащих данные о его инициативном предложении приобрести наркотики или участии в их систематическом сбыте неопределенному кругу лиц.

На данном этапе возможно использование конфиденциального содействия лиц, имеющих оперативные подходы к объекту и (или) предоставивших первичную информацию (далее – первичные конфиденты), при проведении соответствующих оперативно-технических мероприятий. При этом их линия поведения в отношении фигуранта должна носить исключительно пассивный характер. Допускается содействие в оборудовании объекта проведения оперативно-технического мероприятия, а также в форме личного использования специальных технических средств. Какое-либо активное воздействие на поведение объекта оперативной проверки, в том числе выражающееся в просьбах и уговорах сбыть наркотики, запрещается.

Этап №2. Подготовка и проведение ОРМ «проверочная закупка».

Основание: задокументированные результаты ОРМ, которые могут быть предоставлены органу предварительного расследования без ущерба интересам ОРД и проверены в уголовно-процессуальном порядке, прямо или косвенно свидетельствующие о причастности фигуранта к незаконному обороту наркотиков.

Цель: документирование возможного факта сбыта наркотических средств; пресечение пре6ступной деятельности фигуранта (при принятии решения о его задержании).

На данном этапе оперативный сотрудник подбирает лицо для участия в качестве покупателя при проведении проверочной закупки (далее – покупатель). Указанное лицо не должно являться первичным конфидентом. Согласие гражданина на участие в ОРМ в качестве покупателя в обязательном порядке должно быть оформлено в виде письменного заявления с отражением его ознакомления с признаками неприемлемых провокационных действий.

Следует отметить, что при наличии задокументированных результатов первичных ОРМ, отвечающих указанным требованиям, в качестве покупателя может выступать также и оперативный сотрудник.

В ходе организации проверочной закупки в органах ФСКН России оперативный сотрудник составляет рапорт на ее проведение, который представляет начальнику оперативного подразделения. При необходимости к рапорту прилагается проект плана проведения проверочной закупки, а также другие необходимые документы (справка-меморандум, выписка из агентурного сообщения и т.п.) (пункт 9 Инструкции) [4].

Постановление о проведении проверочной закупки выносится оперативным сотрудником ФСКН, организующим ее проведение, и состоит из трех частей: вводной, описательной и резолютивной.

Вводная часть должна включать в себя наименование документа, место и дату его вынесения, фамилию, инициалы, должность и специальное звание лица, вынесшего постановление.

В описательной части постановления в обязательном порядке должны быть указаны суть имеющейся оперативной информации, когда, где, в течение какого срока планируется провести проверочную закупку, что является предметом проверочной закупки и конкретная цель проводимого ОРМ. Описательная часть постановления должна заканчиваться ссылкой на статью 6 и 8 Федерального закона №144.

Одновременно необходимо учитывать, что ведомственным приказом запрещается отражать в описательной части постановления о проведении ОРМ номер и (или) наименование дела оперативного учета, а также любые данные о лицах, оказывающих конфиденциальное содействие (в том числе псевдонимы). Указанные ограничения обеспечивают соблюдение принципа конспирации в связи с последующим направлением постановления следователю и ознакомлением с ним участников уголовного процесса.

В резолютивной части постановления излагается решение о проведении ОРМ, принятое лицом, вынесшим постановление, указывается его должность, специальное звание, фамилия, инициалы.

Постановление о проведении проверочной закупки выносится в одном экземпляре и утверждается в ФСКН России директором ФСКН России (его заместителем в соответствии с распределением обязанностей); в территориальном органе ФСКН России – начальником территориального органа ФСКН России (его заместителем в соответствии с распределением обязанностей).

Следует иметь в виду, что начальникам территориальных органов ФСКН России разрешается предоставлять начальникам межрайонных (городских) отделов право утверждения лишь постановлений о проведении проверочной закупки предметов, веществ и продукции, свободная реализация которых не запрещена либо оборот которых не ограничен (пункт 10 Инструкции от 22.06.2009).

В системе МВД России перед вынесением постановления о проведении проверочной закупки предметов, веществ и продукции, свободная реализация которых запрещена либо оборот которых ограничен, предусматривается подготовка оперативно-служебных документов, содержащих имеющиеся сведения о продавце, задачах, решаемых данным ОРМ, расчет привлекаемых сил и средств (пункт 34.1 Наставления). Указанное постановление утверждается руководителем, правомочным на осуществление ОРД (перечень руководителей определен приказом МВД России от 19.06.2012 № 608 «О некоторых вопросах организации оперативно-розыскной деятельности в системе МВД России»). При подготовке оперативным подразделением МВД России проведения проверочной закупки, в отличие от требований ФСКН России, в каждом случае составляется план с указанием позиций, предусмотренных пунктом 34.4 Наставления.

При проведении проверочной закупки должны в обязательном порядке использоваться аудиозапись и (или) видеозапись, и(или) киносъемка, и (или) фотосъемка,

а также могут использоваться другие технические и иные средства, не наносящие ущерб жизни и здоровью людей и не причиняющие вред окружающей среде.

Уполномоченным прокурорам надлежит помнить, что при наличии объективных причин, препятствующих использованию технических средств при проведении проверочной закупки, оперативный сотрудник представляет до начала проведения указанного ОРМ начальнику оперативного подразделения территориального органа наркоконтроля мотивированный рапорт.

Начальник оперативного подразделения принимает решение о возможности проведения ОРМ без использования технических средств (пункт 4 Инструкции от 22.06.2009).

Порядок проведения проверочной закупки детально регламентирован лишь в нормативном правовом акте ФСКН России и заключается в следующем.

Перед началом проведения проверочной закупки оперативный сотрудник в присутствии не менее двух очевидцев (аналог института понятых в уголовном процессе) должен досмотреть лицо, имитирующее роль «покупателя», на предмет фиксации отсутствия у данного лица при себе, в его одежде, находящихся при нем вещах, используемом транспортном средстве наркотических веществ, психотропных, сильнодействующих и ядовитых веществ, денежных средств; иных материалов и предметов, свободный оборот которых на территории Российской Федерации ограничен или запрещен.

Лицу, имитирующему роль «покупателя», выдаются технические средства (с указанием сведений об аудио— и видеоносителе информации, а также применяемых мерах по обеспечению невозможности его подмены, например, путем опечатывания соответствующего отсека) и денежные средства (предметы), предназначенные для использования в качестве средств платежа в ходе проверочной закупки, которые предварительно копируются и (или) фотографируются, и (или) описываются их индивидуальные отличительные признаки (вид валюты, количество, номинал, серия и номер каждой купюры), и (или) помечаются специальными средствами. При необходимости привлекается специалист. Результат оформляется соответствующим актом.

После проведения проверочной закупки в присутствии не менее двух очевидцев лицо, имитирующее роль «покупателя», обязано выдать оперативному сотруднику закупленные наркотики и ранее переданные ему технические и денежные средства (при наличии таковых), о чем составляется соответствующий акт.

В случаях, когда проведение проверочной закупки направлено на непосредственное пресечение преступной деятельности сбытчика наркотиков, предусматривается его задержание. В свою очередь, при задержании лица, в отношении которого проводилась проверочная закупка, в соответствии с пунктом 13 Инструкции от 22.06.2009 оперативный сотрудник должен провести его досмотр, получить у задержанного образцы для сравнительного исследования (смывы с ладоней, подногтевое содержимое или срезы ногтей). При необходимости осматриваются одежда и карманы на предмет наличия следов специального вещества или наркотического средства (иного закупаемого вещества), производится изъятие соответствующих образцов с одежды. Результат оформляется соответствующим актом.

Следует отметить, что действующим Федеральным законом №144 основания и порядок проведения задержания и досмотра задержанных лиц в ходе осуществления органами внутренних дел и наркоконтроля оперативно-розыскной деятельности не предусмотрены.

Указанные вопросы в зависимости от конкретных обстоятельств регламентированы Федеральным законом от 07.02.2011 № 3-ФЗ «О полиции» (пункт 13 части 1 статьи 13 «Права полиции (для ОВД), статья 14 «Задержание»), КоАП РФ (статья 27.3 «Административное задержание», статья 27.7 «Личный досмотр, досмотр вещей, находящихся при физическом лице») и УПК РФ.

При этом, учитывая наличие различных видов физического ограничения свободы лиц в связи с осуществлением мер государственного принуждения и соответствующих им особенностей процессуального оформления, действия оперативных сотрудников по изъятию предметов, переданных покупателем сбытчику в ходе проверочной закупки, на практике целесообразно документировать в следующих правовых режимах.

Так, после получения данных о состоявшейся сделке по купле-продаже наркотиков оперативные сотрудники вступают в контакт со сбытчиком, представляются, объявляют о проведении в отношении его ОРМ, разъясняя соответствующие права и обязанности. После этого ему предлагается выдать имеющиеся у него предметы и пояснить их происхождение, предъявив для осмотра содержимое карманов одежды и ручной клади. В случае добровольной выдачи денежных средств и иных предметов, представляющих оперативный интерес, в том числе наркотиков, последние изымаются в порядке пункта 1 части 1 статьи 15 Федерального закона №144 с составлением протокола в соответствии с требованиями уголовно-процессуального законодательства.

Для удостоверения указанных действий, при наличии условий, определяемых оперативной обстановкой, могут быть привлечены с их согласия отдельные лица, отвечающие требованиям, предъявляемым к понятым в уголовном судопроизводстве.

В случаях, требующих обязательного проведения задержания сбытчика наркотиков, соответствующие действия оперативных сотрудников организуются во взаимодействии с органом предварительного следствия и осуществляются по основаниям и в порядке, которые предусмотрены уголовно-процессуальным законодательством.

Как правило, решению задач по пресечению функционирования организованных преступных групп и преступных сообществ, установлению всех их участников, каналов поступления и мест производства наркотиков предшествует проведение целой серии проверочных закупок, в ходе которых по замыслу оперативной разработки до определенного момента не производится задержание «рядовых» сбытчиков при обязательном условии документирования их действий и изъятия наркотиков из незаконного оборота.

При этом по результатам первоначальных проверочных закупок с учетом соблюдения требований УПК РФ в разумные сроки возбуждаются уголовные дела, в рамках которых при принятии решения о реализации материалов ОРД с одновременным пресечением криминального поведения фигурантов и производится их уголовно-процессуальное задержание.

Верховный Суд Российской Федерации в этой связи предлагает учитывать, что проведение очередной проверочной закупки у одного и того же лица должно быть обоснованно и мотивировано, в том числе новыми основаниями и целями, и с обязательным вынесением нового постановления, утвержденного руководителем органа, осуществляющего оперативно-розыскную деятельность [5].

Следует обратить внимание на то, что кроме указанных оперативно-служебных документов пункт 14 Инструкции от 22.06.2009 обязывает оперативных сотрудников окончательные результаты проверочной закупки оформлять предусмотренным соответствующим приложением актом. К нему прилагаются документы, подтверждающие совершение сделки (при их наличии), приобретенные (изъятые) предметы, вещества и продукция, другие необходимые материалы.

Кроме того, результаты проверочной закупки оперативный сотрудник должен доложить рапортом лицу, утвердившему постановление о ее проведении.

В рапорте излагаются:

— основные результаты проведенного мероприятия;

— материалы, отражающие ход и результаты проверочной закупки, а также закупленные и изъятые в ходе ее проведения ценности, предметы, вещества, продукция. Указывается, куда и в каких целях они были представлены или должны быть направлены;

— предложения по дальнейшему использованию или месту хранения документов, в которых отражены подготовка и ход проведения проверочной закупки, закупленных и изъятых в ходе ее проведения ценностей, предметов, веществ, продукции;

— при необходимости предложения по мерам обеспечения безопасности участвовавших проведенной проверочной закупке лиц;

— другие необходимые сведения.

К рапорту должен быть приложен акт проведения ОРМ «проверочная закупка» и акт о расходовании выделенных на проведение проверочной закупки денежных средств (пункт 15 Инструкции от 22.06.2009).

В системе МВД России результаты проверочной закупки также оформляются актом (пункт 34.8 Наставления).

Предложенный алгоритм документирования хода и результатов проведения проверочной закупки не противоречит требованиям Наставления и может использоваться в оперативно-розыскной деятельности органов внутренних дел.

(Заключительный этап) Использование результатов проведенного оперативно-розыскного мероприятия «проверочная закупка»

Порядок предоставления результатов ОРД органу предварительного расследования или в суд достаточно подробно регламентирован Инструкцией [6].

Каких-либо существенных особенностей предоставления результатов ОРМ «проверочная закупка» в порядке статьи 11 Федерального закона №144, требующих отдельного изложения, не имеется.

При этом на практике зачастую допускаются следующие нарушения в деятельности оперативных подразделений, которые следует учитывать при реализации надзорных полномочий:

— результаты ОРД предоставляются в орган предварительного следствия одновременно в виде рапорта об обнаружении признаков преступления и сообщения о результатах ОРД;

— подготавливаемые оперативно-служебные документы не соответствуют образцам, предусмотренным Инструкцией от 27.09.2013;

— результаты ОРД, предоставляемые для решения вопроса о возбуждении уголовного дела и последующего формирования доказательств, не содержит сведения о том, где, когда, какие признаки и какого именно преступления обнаружены; при каких обстоятельствах имело место их обнаружение; отсутствуют указания на ОРМ, при проведении которых получены предполагаемые доказательства (имеют место случаи отражения лишь данных об организационно-тактических формах применения специальных технических средств: «НАЗ», «НВД», «НСИ» и т.п.).

Резюмируя указанные требования к доказательствам, полученным в результате проведения проверочной закупки, следует указать одно непреложное правило документирования наркопреступлений:

результаты проверочной закупки не должны быть единственным и основным доказательством по уголовным делам о преступлениях, связанных с незаконным оборотом наркотиков.

Заключение

Массовое использование в преступных целях безконтактных способов передачи запрещенных веществ, затрудняющих идентификацию сбытчика (службы мгновенного обмена сообщениями (ICQ), интернет-сайты с высокой степенью криптозащиты технических каналов, электронные системы взаиморасчетов, тайниковые операции и т.п.), а также фактическое общение субъектов теневой купли-продажи исключительно в виртуальном пространстве нивелируют эффективность и зачастую целесообразность ранее существовавших приемов и методов противодействия наркопреступности. В этой связи современное состояние оперативно-розыскной деятельности правоохранительных органов в условиях динамично развивающейся информационно-технической инфраструктуры общества, беспрецедентной активизации криминальных структур на рынке реализации новых типов наркотиков требует существенного совершенствования ее организации и тактики.

Неукоснительное соблюдение требований российского законодательства и общепризнанных норм Европейской конвенции о защите прав человека и основных свобод становится фундаментальным принципом эффективного противодействия наркоугрозе, способствующем неотвратимости наказания участников организованных преступных формирований. При этом констатируемые в настоящее время шаблонность при организации и непосредственном осуществлении ОРД, отсутствие творческого подхода к решению ее задач в совокупности с юридической неграмотностью ряда оперативных сотрудников приводят к снижению наступательности в ликвидации наркотрафика. Лишь четкое понимание оперативным составом оснований и условий правомерной реализации своих полномочий, нацеленность на решение конкретных задач ОРД путем эффективного и комплексного использования имеющихся сил и средств будут способствовать укреплению законности в указанной сфере.

При рассмотрении дел против Российской Федерации ЕСПЧ высказана неоднозначная позиция о том, что отсутствие четкой и предсказуемой процедуры санкционирования проведения проверочной закупки, ее разрешение посредством простого административного решения одного и того же органа дает возможность проводить мероприятие без какого-либо независимого контроля и необходимости обосновывать его осуществление. Делая подобный вывод, ЕСПЧ не учел нормативно закрепленные полномочия органов прокуратуры по надзору за исполнением законов органами, осуществляющими ОРД, в том числе при подготовке и проведении проверочной закупки.

Вместе с тем возникновение подобной позиции суда неслучайно и во многом обусловлено неоднократными нарушениями закона при осуществлении ОРД, не пресекаемыми уполномоченными прокурорами из-за отсутствия системы реализации превентивных механизмов надзорной деятельности.

Таким образом, особая роль в обеспечении законности при осуществлении ОРД несомненно принадлежит прокурорскому надзору.
