Article 138 of the Criminal Code . Violation of confidentiality of correspondence, telephone conversations, postal, telegraphic or other messages
1. Violation of the secrecy of correspondence, telephone conversations, mail, telegraph or other messages of citizens -
shall be punishable by a fine in the amount of up to eighty thousand rubles or in the amount of the convict's salary or other income for a period of up to six months, or by compulsory labor for a period of one hundred twenty to one hundred and eighty hours, or by corrective labor for a term of up to one year.
2. The same act committed by a person using his official position or special technical means intended for the tacit receipt of information, -
shall be punishable by a fine in the amount of one hundred thousand to three hundred thousand rubles, or in the amount of the convict's salary or other income for a period of one year to two years, or by deprivation of the right to occupy certain positions or engage in certain activities for a period of two to five years, or compulsory work for a term of one hundred eighty to two hundred and forty hours, either by arrest for a term of two to four months, or by imprisonment for a term of one year to four years.
3. Illegal production, marketing or acquisition of special technical equipment intended for secretly obtaining information , -
shall be punishable by a fine in the amount of up to two hundred thousand rubles or in the amount of the convict's salary or other income for a period of up to eighteen months, or by restriction of liberty for a term of up to three years, or imprisonment for a term of up to three years with deprivation of the right to hold certain posts or engage in certain activities for up to three years.
