Among the services provided by private detectives, the service associated with the collection of information on the behavior of minor children is very popular. It is carried out on the basis of an agreement concluded with parents. This service is necessary when parents notice some abnormality in the behavior of their children and suggest that the children are “drawn into” something bad, which in the future may affect their future, however, as the fate of the parents themselves.
In connection with these, some questions arise related to the legality and legal justification of the activities of a private detective collecting information, carried out on the basis of a request from parents.
First of all, you should probably pay attention to the legal basis of the requirements of the parents of a minor child, resorting to the help of a private detective.
The legal grounds for such an appeal are expressly enshrined in applicable law, in particular, in the Family Code of the Russian Federation.
So, in article 63 of the IC of the Russian Federation it is said that parents have the right and are obliged to raise their children. Parents are responsible for the upbringing and development of their children. They must take care of their health, physical, mental, spiritual and moral. Parents have a pre-emptive right over all other persons to educate and raise their children.
Based on Article 64 of this Code, the protection of the rights and interests of children is vested in their parents. Parents are legal representatives of their children and advocate for their rights and interests in relations with any natural and legal persons, including in courts, without special powers.
As can be seen from Article 56 of the IC of the Russian Federation, the child has the right to protect his rights and legitimate interests. This function is carried out by parents (persons replacing them), and in the cases provided for by this Code, the guardianship authority, the prosecutor and the court.
For non-performance or improper performance by parents or others legal representatives juvenile responsibilities for the maintenance, upbringing, training, protection of the rights and interests of minors, administrative responsibility is provided for (Article 5.35 of the Administrative Code of the Russian Federation).
Following these tenets of rights, we can make an unambiguous conclusion that parents are not only entitled, but also obliged to monitor the behavior of their minor children, as prescribed by the Law.
Usually, parents turn to a private detective only if they notice any unusual behavior in the child. They had obvious suspicions that the child was “dragged” into some kind of antisocial actions, possibly, in the commission of any crimes. It was then that the help of a private detective in establishing the causes of these "unusual" in the behavior of the child is invaluable. Only a specialist can collect reliable information about the possible causes of this behavior. This, in turn, can facilitate the adoption by parents of the right decision on the application of possible measures aimed at preventing possible negative consequences.
These measures must be taken in relation to persons who may negatively affect the behavior of the child and, most likely, their actions may contain specific offenses, including crimes.
For example, such as those stipulated by Article 150 of the Criminal Code of the Russian Federation (“Involving a minor in committing a crime”), Article 151 of the Criminal Code of the Russian Federation (“Involving a minor in antisocial acts”), Article 240 of the Criminal Code of the Russian Federation (“Involving in prostitution”) as well as Article 6.10 of the Code of Administrative Offenses of the Russian Federation (“Involvement of a minor in the use of alcohol and alcohol-containing products, new potentially dangerous psychoactive substances or intoxicants”), and other offenses for which liability is provided for by the laws of the constituent entities of the Federation punishing for involving minors in antisocial activities.
Based on the foregoing, it can be concluded that parents, having established the fact of the commission of any offenses mentioned above committed by any persons in relation to their children, have the right to present certain claims to these persons, stipulated by civil law regarding compensation for any harm done to their children. These requirements may also be brought in civil proceedings.
Therefore, private detectives, providing a service to collect information regarding the behavior of minor children on the basis of an agreement with their parents, have the right to indicate in the service agreement that the collection of information is carried out in accordance with paragraph 1 of Part 1 of Article 3 of the Law of the Russian Federation "On Private detective and security activities in the Russian Federation "dated 11.03.1992 N 2487-1, i.e. as part of the collection of information on civil cases on a contractual basis with participants in the process, which may be the parents of a minor.
At the same time, it should also be borne in mind that in accordance with Article 1 of the above Law, private detective and security activities are defined as the provision on a fee-based contractual basis of services to individuals and legal entities that have a special permit (license) obtained in accordance with this Law, organizations and individual entrepreneurs in order to protect the legitimate rights and interests of their customers. And in this case, a private detective, collecting information regarding the child, just collects them in order to protect the legitimate rights and interests of his clients-parents.
When collecting information, a private detective has the right to resort to using all the methods of obtaining the necessary information provided for in Article 5 of the Law of the Russian Federation "On Private Detective and Security Activities in the Russian Federation" dated 11.03.1992 N 2487-1, namely: an oral survey of citizens and officials (with their consent), making inquiries, studying objects and documents (with the written consent of their owners), an external examination of buildings, premises and other objects, observation.
The presented opinion of the author is based on an analysis of the rule of law and a generalization of law enforcement practice on this issue.

Среди услуг, предоставляемых частными детективами, большой популярностью пользуется услуга, связанная с осуществлением сбора сведений относительно поведения несовершеннолетних детей. Осуществляется она на основании договора, заключенного с родителями. Эта услуга бывает необходима, когда родители замечают некоторую аномальность в поведении своих детей и предполагают, что дети «втянуты» во что-то нехорошее, что в дальнейшем может отразиться на их будущем, впрочем, как на судьбе и самих родителей.
В связи с этими возникают некоторые вопросы, связанные с законностью и правовой обоснованностью проведения мероприятий по сбору сведений частным детективом, осуществляемых на основании просьбы родителей.
Прежде всего, следует, видимо, обратить внимание на правовые основания требований родителей несовершеннолетнего ребенка, прибегающих к помощи частного детектива.
Правовые основания подобного обращения прямо закреплены в действующих нормах права, в частности, в Семейном Кодексе РФ.
Так,в ст.63 СК РФ сказано,что родители имеют право и обязаны воспитывать своих детей. Родители несут ответственность за воспитание и развитие своих детей. Они должны заботиться об их здоровье, физическом, психическом, духовном и нравственном. Родители имеют преимущественное право перед всеми другими лицами на обучение и воспитание своих детей.
Исходя из ст.64 данного Кодекса защита прав и интересов детей возлагается на их родителей. Родители являются законными представителями своих детей и выступают в защиту их прав и интересов в отношениях с любыми физическими и юридическими лицами, в том числе в судах, без специальных полномочий.
Как видно из ст.56 СК РФ, ребенок имеет право на защиту своих прав и законных интересов. Эта функция осуществляется родителями (лицами, их заменяющими), а в случаях, предусмотренных настоящим Кодексом, органом опеки и попечительства, прокурором и судом.
За неисполнение или ненадлежащее исполнение родителями или иными законными представителями несовершеннолетних обязанностей по содержанию, воспитанию, обучению, защите прав и интересов несовершеннолетних, предусмотрена административная ответственность (ст.5.35 КоАП РФ).
Следуя этим постулатам прав, можно сделать однозначный вывод о том,что родители не только имеют право, но и обязаны осуществлять контроль за поведением своих несовершеннолетних детей, как и предписывает Закон.
Обычно родители обращаются к частному детективу только в том случае, если они заметили какие-то необычности в поведении ребенка. У них возникли явные подозрения о том, что ребенок «втянут» в какие то антиобщественные действия, возможно, и в совершение каких- либо преступлений. Именно тогда помощь частного детектива в установлении причин возникновения этих «необычностей» в поведении ребенка является неоценимой. Только специалист может собрать достоверную информацию о возможных причинах такого поведения. Это в свою очередь, может способствовать принятию родителями правильного решения по применению возможных мер, направленных на предупреждению возможных негативных последствий.
Эти меры необходимо принимать в отношении лиц, которые возможно негативно влияют на поведение ребенка и,что вполне вероятно, в их действиях могут содержатся составы конкретных правонарушений, в том числе и преступлений.
Например, таких, как предусмотренные ст.150 УК РФ ("Вовлечение несовершеннолетнего в совершение преступления"), ст.151 УК РФ (" Вовлечение несовершеннолетнего в совершение антиобщественных действий"), ст.240 УК РФ ("Вовлечение в занятие проституцией"), а также ст.6.10 КоАП РФ ("Вовлечение несовершеннолетнего в употребление алкогольной и спиртосодержащей продукции, новых потенциально опасных психоактивных веществ или одурманивающих веществ"), и иные правонарушения, ответственность за которые предусмотрена Законами субъектов Федерации, наказывающих за вовлечение несовершеннолетних в антиобщественную деятельность.
На основании сказанного можно сделать вывод о том, что родители, установив факт совершения каких-либо правонарушений, указанных выше, совершенных в отношении их детей какими-либо лицами, имеют право предъявить этим лицам определенные требования, предусмотренные гражданским законодательством в части возмещения какого-либо вреда, причиненного их детям. Данные требования могут быть предъявлены и в порядке гражданского судопроизводства.
Следовательно, частные детективы, оказывая услугу по сбору сведений в отношении поведения несовершеннолетних детей на основании договора с их родителями, вправе указать в договоре оказания услуг, что сбор сведений осуществляется в соответствии с п.1 ч.1 ст.3 Закона РФ "О частной детективной и охранной деятельности в Российской Федерации" от 11.03.1992 N 2487-1 , т.е. в рамках сбора сведений по гражданским делам на договорной основе с участниками процесса, которыми могут быть родители несовершеннолетнего.
При этом, следует также иметь ввиду, что в соответствии со ст.1 вышеуказанного Закона, частная детективная и охранная деятельность определяется как оказание на возмездной договорной основе услуг физическим и юридическим лицам, имеющими специальное разрешение (лицензию), полученную в соответствии с настоящим Законом, организациями и индивидуальными предпринимателями в целях защиты законных прав и интересов своих клиентов. И в данном случае, частный детектив, осуществляя сбор сведений в отношении ребенка, как раз и осуществляет их сбор в целях защиты законных прав и интересов своих клиентов-родителей.
Осуществляя сбор сведений, частный детектив вправе прибегать к использованию всех предусмотренных ст.5 Закона РФ "О частной детективной и охранной деятельности в Российской Федерации" от 11.03.1992 N 2487-1 способов получения необходимой информации, а именно: устный опрос граждан и должностных лиц (с их согласия), наведение справок, изучение предметов и документов (с письменного согласия их владельцев), внешний осмотр строений, помещений и других объектов, наблюдение .
Представленное мнение автора основано на анализе норм права и обобщении правоприменительной практики по данному вопросу.

Wonderful article, with all the legal calculations. Andrey Valerievich, thanks! The only thing, maybe I would add a small paragraph here, on non-disclosure, that if during the work no data on the crimes committed are received, then all the information will be transmitted only to the customer and nowhere else. And parents themselves will make decisions on further steps in education and possibly in eliminating some shortcomings in the behavior of the child.

Замечательная статья, со всеми юридическими выкладками. Андрей Валерьевич, спасибо! Единственное, может я добавил бы сюда маленький абзац, о неразглашении, что если в ходе работы не будет получено данных о совершаемых преступлениях, то вся информация будет передана только заказчику и никуда более. И уже сами родители будут принимать решения о дальнейших шагах в воспитании и возможно в устранении каких-то недочетов в поведении ребенка.

Для меня очень полезная по содержанию статья, учитывая то, что еще не сталкивался с такой стороной деятельности. Очевидно, что если в перспективе полученные в результате проведения мероприятий сведения могут быть использованы в гражданском судопроизводстве, то в договорах об оказании детективных (сыскных) услуг целесообразно ссылаться на п.1 ч.1 ст.3 Закона РФ "О частной детективной и охранной деятельности в Российской Федерации" от 11.03.1992 N 2487-1.

And it is justifiable that parents turn to the detective for help if they can’t do it themselves. After all, it’s worth interfering in the life of a teenager, the sooner the better if you rolled downhill. Parents have their own ways of influencing: it may be worth talking heart to heart, take other measures, up to a change of residence. In my practice, there was one such case with a happy ending. The guy disappeared somewhere, hid something from his parents, but it turned out he just fell in love and met a girl. Learning even later became better.

Дети - наше будущее и каждый родитель мечтает, чтобы их ребёнок вырос полноценным гражданином. Вокруг и около этому мешает наш социум, ребёнок растёт и хочет быть как все, перенимая негативные привычки. И вполне оправданно, что родители обращаются за помощью к детективу, если сами не справляются. Ведь вмешаться в жизнь подростка стоит, чем раньше, тем лучше, если покатился по наклонной. У родителей есть свои способы влияния: может стоит поговорить по душам, принять другие меры, вплоть до смены места жительства. На моей практике был один такой случай со счастливым концом. Парень пропадал где-то, скрывал что-то от родителей, а оказалось просто влюбился и встречался с девушкой. Учиться даже потом стал лучше.
Проблема "отцов и детей" актуальна всегда и спасибо Андрею Валерьевичу за поднятую тему!

Осуществляя сбор сведений, частный детектив вправе прибегать к использованию всех предусмотренных ст.5 Закона РФ "О частной детективной и охранной деятельности в Российской Федерации" от 11.03.1992 N 2487-1 способов получения необходимой информации, а именно: устный опрос граждан и должностных лиц (с их согласия), наведение справок, изучение предметов и документов (с письменного согласия их владельцев), внешний осмотр строений, помещений и других объектов, наблюдение .
