A criminal case has been opened regarding the murder of a robber in a Moscow apartment. Investigators of the UK verify the circumstances of the robbery, during which an attacker armed with a pistol received a rebuff and died from a blow to the head. Law enforcement officers intend to establish how adequate the threat was the actions of the defenders. Muscovites face up to two years in prison.
A criminal case into the murder was instituted after the attack on an apartment in Moscow, Interfax reports on Thursday, citing a source in law enforcement.
“A criminal case has been instituted under Article 108 of the Criminal Code of the Russian Federation (murder committed when exceeding the limits of necessary defense),” the agency said. Sanctions of this wording (part 1 of article 108 of the Criminal Code of the Russian Federation) imply punishment from correctional labor to imprisonment for up to two years.
Recall that on Wednesday in the north of Moscow there was an armed attack on the family of the late rock musician of the Black Coffee group Andrei Girnyk. The incident occurred at about 11.00 in the house number 74 in the passage of the Cherepanovs. In the apartment lived a 47-year-old widow of Girnyk and their two sons - 27 and 28 years old.
“Young people were waiting for guests at that time and calmly opened the door to a stranger,” a representative of the Internal Affairs Directorate of the Northern District of Moscow told the newspaper VZGLYAD.
After that, a man armed with a pistol and a knife burst into the apartment. The attacker immediately opened fire, and then stabbed the hostess of the apartment and her eldest son with a knife. “The youngest son, having heard the noise of the fight, jumped out into the hallway and entered into a fight with the attacker. He hit him on the head several times, after which the attacker fell and died, ”the policeman said.
As a result of the attack, 27-year-old Nikita Girnyk was taken to intensive care with injuries in the back of the head, chest, and left shoulder; his 28-year-old brother, Andrei, was hospitalized with a gunshot wound in a Moscow hospital No. 36.
Together with the sons of the musician, his widow also suffered. 47-year-old Alla Girnyk is located in City Clinical Hospital No. 67. Doctors diagnosed Alla with a non-penetrating wound of the lumbar region, a cut wound of the left hand, and a hematoma of the abdomen.
According to a law enforcement source, Girnyk said in the police that it was she who hit the attacker in the head with a heavy object falling into her arm, after which he lost consciousness and died.
“Despite the fact that the woman claims that it was she who hit the robber, this version will be checked, as it raises doubts about the woman’s ability to strike such a force,” the law enforcer said.
Law enforcers suggested on Wednesday that the offender "may have been mistaken for the address." The police also noted that members of the attacked family were not related to any business and were fond of music.

После этого в квартиру ворвался мужчина, вооруженный пистолетом и ножом. Нападавший сразу открыл огонь, а затем ножом нанес несколько ранений хозяйке квартиры и ее старшему сыну. «Младший сын, услышав шум борьбы, выскочил в прихожую и вступил в драку с нападавшим. Он несколько раз ударил его по голове, после чего злоумышленник упал и скончался», – сказал полицейский.
В результате нападения 27-летний Никита Гирнык был доставлен в реанимацию с ранениями в затылок, грудь и левое плечо, его 28-летнего брата Андрея с огнестрельным ранением на вертолете госпитализировали в московскую клинику № 36.
Вместе с сыновьями музыканта пострадала и его вдова. 47-летняя Алла Гирнык находится в ГКБ № 67. Медики диагностировали у Аллы непроникающее ранение поясничной области, резаную рану левой кисти, гематому живота.
Как сообщил источник в правоохранительных органах, в полиции Гирнык заявила, что именно она ударила нападавшего по голове тяжелым предметом, попавшимся ей под руку, после чего тот потерял сознание и скончался.
