Private detective enterprises in Russia.

The relevance of this research topic lies in the fact that with the development of the institutions of a market economy, and the creation of a wide class of owners and entrepreneurs, there is a need to ensure the safety of entrepreneurial activity and their personal life. The state grants the right to exercise some of these functions to non-state structures - legal entities and individuals that provide services for private investigation and protection. However, the growing social activity of participants in the market for security and detective services, cases of their violation of generally binding norms and rules provided for by law, problems of legal regulation of detective activity pose a threat to the rights and legitimate interests of citizens, the security of the state.Currently, about 25 thousand private detective enterprises and security services are engaged in private detective activity in the Russian Federation, providing, on contractual terms, services for protecting the life and health of citizens, protecting goods, consulting on protecting against criminal encroachments, installing alarm systems and protecting order at various events ... This group of enterprises should include firms that provide the production of software and hardware complexes for the protection of information systems, enterprises for the provision of information, commercial, fire and environmental safety. A significant number of non-state educational centers and schools specializing in the training of private detectives have been created. These data confirm the demand for private detective services.
In the current acute crime situation, private detective enterprises have become an integral part of the state's internal security system.
The activities of private detective enterprises should be understood as the activities of non-governmental organizations (detective agencies) and individual entrepreneurs (private detectives), who have a special permit (license) from the internal affairs bodies, to provide services on a reimbursable contractual basis to individuals and legal entities in order to protect their legal rights and interests, using the forms and methods of professional activity established by law.

Актуальность данной темы исследования заключается в том, что с развитием институтов рыночной экономики, и создании широкого по численности класса собственников и предпринимателей, появилась потребность в обеспечении безопасности предпринимательской деятельности и их личной жизни. Государство предоставляет право реализовывать часть этих функций негосударственным структурам - юридическим и физическим лицам, оказывающим услуги по частному сыску и охране. Однако возрастающая социальная активность участников рынка охранных и детективных услуг, случаи нарушения ими общеобязательных норм и правил, предусмотренных законодательством, проблемы правового регулирования детективной деятельности представляют угрозу правам и законным интересам граждан, безопасности государства.В настоящее время частной детективной деятельностью в РФ занимается около 25 тысяч частных детективных предприятий и служб безопасности, представляющих на договорных условиях услуги по защите жизни и здоровья граждан, охране грузов, консультации по защите от преступных посягательств, монтаж средств сигнализации и охрану порядка на различных мероприятиях. К этому же кругу предприятий необходимо отнести фирмы, обеспечивающие производство программно-технических комплексов защиты информационных систем, предприятия обеспечения информационной, коммерческой, пожарной и экологической безопасности. Создано значительное количество негосударственных учебных центров и школ, специализирующихся на подготовке частных детективов. Эти данные подтверждают востребованность частных детективных услуг.
В нынешней острой криминогенной ситуации частные детективные предприятия стали неотъемлемой частью системы внутренней безопасности государства.
Под деятельностью частных детективных предприятий следует понимать деятельность негосударственных организаций (детективных агентств) и индивидуальных предпринимателей (частных детективов), имеющих специальное разрешение (лицензию) органов внутренних дел, по оказанию на возмездной договорной основе услуг физическим и юридическим лицам, в целях защиты их законных прав и интересов, с применением форм и способов профессиональной деятельности, установленных законом.
