In modern conditions, the activities of law enforcement agencies to protect the rights and legitimate interests of citizens are not always effective, which forces citizens to use other means and methods of such protection. One of these means is the appeal to private detective services, which can successfully solve important problems in the human rights sphere. The most important condition for the successful implementation of the activities of private detectives is their observance of professional secrecy. Professional secrecy is important in the work of a private detective and is a prerequisite for the effective solution of many tasks for the practical implementation of the powers of private detectives. The demand for the services of private detectives among the population is largely due to the fact that in their activities they are guided by the requirements of ensuring the confidentiality of information and its careful use for professional purposes. Violation of these requirements creates a misconception about the essence and nature of private detective activity among citizens wishing to use the services of private detectives, reduces its authority and significance.From the standpoint of ensuring the confidentiality of information, the activities of private detectives require close attention and deep analysis. It is necessary to comprehensively evaluate the already used methods and means of ensuring the confidentiality of information in the work of private detectives, improve them in case of insufficient efficiency, as well as develop new means and methods aimed at creating an optimal regime for maintaining private detective secrets.
The aim of the work is a theoretical study and legal analysis of the problems associated with the regulation and practical implementation of the conditions and means of ensuring the confidentiality of private detective activities.
A prerequisite for private detective activity is the observance of the confidentiality regime. A private detective, in carrying out his activities, is obliged to protect information characterizing the personal life and material well-being of the principal. In other words, keeping secrets provides the necessary confidentiality in the work of private detectives. Within the framework of this activity, a professional secrecy regime operates. The content of the concept of "professional secret" is not always sufficiently clear and fully covered by researchers in the legal literature, is not always fixed in regulatory legal acts, etc. Professional secrecy in the scientific literature is defined as the preservation by an authorized person of information entrusted to him within the framework of the law, in the event of its dissemination, it can cause certain harm to the principal and be punished for this.

Professional secret in private detective activity has some peculiarities:
- the requirement to ensure confidentiality in the implementation of private detective activities is enshrined in Russian legislation;
- the regime of protection of confidential information should always take into account the interests of citizens and organizations;
- the legal relationship that has arisen between the principal and the private detective is of a private law nature;
- when protecting confidential information, a private detective must take into account the requirements of ethical standards

В современных условиях деятельность правоохранительных органов по защите прав и законных интересов граждан не всегда бывает результативной, что вынуждает граждан использовать иные средства и способы такой защиты. Одним из таких средств выступает обращение к частным детективным службам, которые могут успешно решать важные задачи в правозащитной сфере. Важнейшим условием успешного осуществления деятельности частных детективов является соблюдение ими профессиональной тайны. Профессиональная тайна имеет важное значение в работе частного детектива и выступает предпосылкой эффективного решения многих задач по практической реализации полномочий частных детективов. Востребованность услуг частных детективов у населения объясняется во многом именно тем, что они в своей деятельности руководствуются требованиями обеспечения конфиденциальности информации и осторожного применения её в профессиональных целях. Нарушение данных требований создает у граждан, желающих воспользоваться услугами частных детективов, неправильное представление о сущности и характере частной детективной деятельности, уменьшает её авторитет и значимость.С позиции обеспечения конфиденциальности информации деятельность частных детективов требует к себе пристального внимания и глубокого анализа. Необходимо комплексно оценить уже использующиеся методы и средства обеспечения конфиденциальности информации в работе частных детективов, усовершенствовать их в случае недостаточной эффективности, а также разработать новые средства и методы, направленные на создание оптимального режима сохранения частной детективной тайны.
Целью работы является теоретическое исследование и юридический анализ проблем, связанных с регламентацией и практической реализаций условий и средств обеспечения конфиденциальности частной детективной деятельности.
Обязательным условием частной детективной деятельности является соблюдение режима конфиденциальности. Частный детектив при осуществлении своей деятельности обязан защищать информацию, характеризующую личную жизнь и материальное благосостояние доверителя. Иными словами, сохранение тайны обеспечивает необходимую конфиденциальность в работе частных детективов. В рамках данной деятельности действует режим профессиональной тайны. Содержание понятия «профессиональная тайна» не всегда достаточно четко и в полном объёме освещается исследователями в юридической литературе, не всегда закрепляется в нормативно-правовых актах и т.д. Профессиональная тайна в научной литературе определяется как сохранение уполномоченным лицом доверенной ему информации в рамках закона, в случае её распространения может причинить определённый вред доверителю и понести за это наказание.

Профессиональная тайна в частной детективной деятельности обладает некоторыми особенностями:
– требование об обеспечении конфиденциальности при осуществлении частной детективной деятельности закрепляется в российском законодательстве;
– режим охраны конфиденциальных сведений должен всегда учитывать интересы граждан и организаций;
– возникшие правоотношения между доверителем и частным детективом имеют частноправовой характер;
– при охране конфиденциальных сведений частный детектив должен учитывать требования этических норм.
