On August 23 last year, on the website of the Ministry of Internal Affairs of the Republic of Mordovia, there appeared official, in principle, news that a certain Kudashkin had been caught, in respect of whom as many as 29 criminal cases had been instituted under part 3 of Art. 159 of the Criminal Code (“Fraud”). It was reported: this citizen was engaged in the sale of used cars, not all of which came to him legally. The damage from his "business" was estimated at almost 60 million rubles.
Well, you never know what happens ... I didn’t pay much attention if Pavel K., a Muscovite, had once called me (the editor’s name is known) and didn’t tell an amazing story directly related to citizen Kudashkin and the Russian judicial and law enforcement system.
In the spring of 2011, Pavel bought a BMW X3 of 2009, and without any problems received registration marks in the traffic police. However, six months later, on October 29, employees of the Krasnodar Criminal Investigation Department came to visit his mother, accompanied by the precinct Babushkinsky district of the NEAD of Moscow. On November 2, the Bolotskikh operative officer, apparently, as part of an informal approach to the case, sent Pavel instead of some legal paper SMS, which explained: the detained fraudster was Sergey Mikhailovich Kudashkin, born in 1978 The one caught back in August.

And the next day - on the 10th - it became known that the very first person deceived by the Mordovian fraudster was moving along Krasnodar on a seized BMW.

No, of course, there is a violation of the law in the actions of Kudashkin: he never gave Judge Lysenko either money or a Mercedes ...
That is, it is quite obvious: federal judge Svetlana Lysenko became a victim of fraud. Of course, it’s a shame ... And, it seems that Svetlana Eduardovna shared the trouble with her husband - the current employee of the Krasnodar regional prosecutor's office. Well, and the local opera went to Moscow urgently, the investigation worked. And found the extreme - Paul. And Judge Lysenko found the lost BMW.

23 августа прошлого года на сайте МВД республики Мордовия появилась служебная, в принципе, новость о том, что был пойман некий Кудашкин, в отношении которого возбуждено целых 29 уголовных дел по ч. 3 ст. 159 УК РФ («Мошенничество»). Сообщалось: этот гражданин занимался продажей поддержанных автомобилей, не все из которых попадали к нему законным путем. Ущерб от его «бизнеса» оценили почти в 60 млн рублей.
Ну, мало ли, что бывает… Особого внимания не обратил, если бы мне однажды не позвонил москвич Павел К. (фамилия редакции известна) и не рассказал удивительную историю, имеющую непосредственное отношение к гражданину Кудашкину и российской судебно-правоохранительной системе.

Однако через полгода — 29 октября — домой к его маме пришли в гости сотрудники Краснодарского уголовного розыска в сопровождении участкового Бабушкинского района СВАО г. Москвы. О причине визита не говорили, ссылаясь на тайну следствия.
По телефону оперуполномоченный Алексей Михайлович Болотских сообщил Павлу, что 30 октября он должен явиться в ОВД Бабушкинского района и дать показания по некоему делу, подробностей которого не разъяснил. Павел прибыл, находясь в, мягко говоря, заинтригованном состоянии. Посетителя отвели в комнату для допросов и рассказали то, что способно потрясти любого автовладельца: его машина находится в розыске. Причина — мошенничество в отношении первого владельца. И Павла попросили добровольно отдать ПТС, ключи, талон техосмотра, ОСАГО и документы на BMW, а в случае отказа грозились изъять вышеперечисленное силой, так как ордер на обыск квартиры, выписанный судьей Каневского районного суда Краснодарского края Дауровой Т. Г., был в наличии. Павел отдал все, попросил лишь снять ксерокопии с изъятых бумаг. Однако в этом было отказано, и на руках оставили лишь акт выемки автомобиля.
А 1 ноября от краснодарского следователя, майора юстиции Важевой Татьяны Александровны, и стало известно о поимке в Мордовии мошенника, обманувшего первого владельца как раз на автомобиль Павла. Это все, что удалось узнать — следователь по-прежнему отказывалась выдавать копии документов и сообщать номер уголовного дела, солгав, что может это сделать только по адвокатскому запросу. Последнее — юридическая новость (впрочем, таких новостей в этом деле предостаточно). Но лучше обратить внимание не на это, а на фамилии и должности участников мероприятия с изъятием BMW. Чуть позже, станет понятно, почему.
2 ноября оперуполномоченный Болотских, очевидно, в рамках неформального подхода к делу, прислал Павлу вместо какой-либо юридической бумаги СМС, которым пояснил: задержанный мошенник — это Кудашкин Сергей Михайлович 1978 г.р. Тот самый, пойманный еще в августе.
3 ноября оперативник Болотских пообещал Павлу, что ксерокопии документов на машину он передаст вместе с проводником поезда, следующего из Адлера в Москву, но их подлинность не будет заверена, а копии постановления о выемке автомобиля и ордера на обыск квартиры не будет (6 ноября Павел эти документы получил). В то же 3 ноября заместитель начальника ОВД Бабушкинского района Вишняков Геннадий Тихонович сообщил лишившемуся автомобиля человеку, что оперативники из Краснодарского уголовного розыска действительно обращались к ним за содействием, но не оставили копию судебного постановления, заверенное печатью и подписью.
На следующий день Павел отправил запрос в Краснодарский край — просил все-таки отдать недостающие копии документов. А 7 ноября — заявление в межрайонную прокуратуру, к которому приложил все документы, подтверждающее его добросовестное право на владение автомобилем. Тем более что, по словам сотрудников ОВД Бабушкинского района, краснодарские оперативники изымать авто права не имели.
9 ноября ознаменовалось чудом. Павлу пришла штрафная квитанция на 2 тысячи рублей — от 31 октября, из Воронежской области. Оказывается, его машина превысила допустимую скорость на 95 км/ч. За рулем находились сотрудники Краснодарского уголовного розыска. А на следующий день — 10-го — стало известно, что по Краснодару на изъятом BMW передвигается тот самый первый, обманутый мордовским мошенником человек.
Первым владельцем машины, записанным в ПТС, была — Лысенко Светлана Эдуардовна, федеральный судья Каневского райсуда Краснодарского края, коллега судьи Дауровой — той, что выписала постановление о выемке автомобиля и ордер на обыск квартиры.
Оказывается, 9 марта 2011 года судья Светлана Лысенко сняла с учета в ГИБДД Каневского района BMW X3, на следующий день встретилась с будущим мошенником гражданином Кудашкиным во дворе собственного дома и, проявив какую-то близорукость — ну, затмение нашло — согласилась обменять BMW на Mercedes ML. Была оформлена нотариально заверенная генеральная доверенность с правом перепродажи, а вот какой-либо договор на обмен машин — нет. И 12 марта, уже в Одинцово Московской области, Кудашкин продал BMW по некоему гражданину Аксенову Г. Л., оформив договор купли-продажи от имени собственника автомобиля — судьи Лысенко. А уже потом автомобиль попал к Павлу, который сейчас и отдувается за чужие грехи и чужую доверчивость.
Кудашкину, с его 29-ю эпизодами, конечно, тоже досталось. Несмотря на законность продажи им машины предпоследнему владельцу, следователь Важева расценила его действия как самовольное распоряжение транспортным средством, собственником которого он не является. Странно — ведь у мордовского афериста на руках на тот момент была не отозванная нотариально заверенная генеральная доверенность. Нет, конечно, нарушение закона в действиях Кудашкина есть: он так и не отдал судье Лысенко ни денег, ни Мерседеса…
То есть, вполне очевидно: федеральный судья Светлана Лысенко стала жертвой мошенничества. Конечно, обидно… И, думается, что Светлана Эдуардовна поделилась бедой со своим мужем — действующим сотрудником краснодарской краевой прокуратуры. Ну, и поехали срочно в Москву местные опера, заработало следствие. И нашло крайнего — Павла. А судье Лысенко нашли утраченный BMW.
Павел, конечно, жаловался — писал заявления в Генеральную прокуратуру, Администрацию Президента и Службу собственной безопасности МВД, — все они были спущены в Управление по надзору за следствием, Следственный комитет и Главное управление МВД Краснодарского края, а потом — еще ниже, на местный уровень. И там, так сказать, остались «без движения».
А гражданином Кудашкиным, кстати, была обманута не только федеральный судья, но еще и несколько наивных полицейских чинов. Например, 1 ноября 2011 года следователь СЧ СУ МВД России по республике Мордовия капитан юстиции Щанкин С. А. изъял Toyota Yaris у Татьяны Д., которая приобрела ее по той же схеме, что и Павел. Автомобиль был так же возвращен первой владелице — Чекашкиной, жене сотрудника МВД Мордовии А. Чекашкина, который, по словам очевидцев, во время изъятия не роскоши, а средства передвижения, находился рядом со следователем, а потом тщательно следил за аккуратностью транспортировки.
8 июля 2011 года подобное приключилось и с Дмитрием З. из Пензы, чью Honda Accord вернули высокопоставленному чиновнику из Мордовии Ю. В. Кулямину.
В связи с этим со всем получается вот что: сложилась некая схема относительно честного отъема у добросовестных приобретателей автомобилей, которых проворонили их первые владельцы. Эту схему замечательно обустроили судьи, прокуроры и сотрудники полиции. Только, если даже отвлечься от бед фактически ограбленных последних собственников, то все равно ситуация выглядит как-то не очень. Последнее — юридическая новость (впрочем, таких новостей в этом деле предостаточно). Но лучше обратить внимание не на это, а на фамилии и должности участников мероприятия с изъятием BMW. Чуть позже, станет понятно, почему.
2 ноября оперуполномоченный Болотских, очевидно, в рамках неформального подхода к делу, прислал Павлу вместо какой-либо юридической бумаги СМС, которым пояснил: задержанный мошенник — это Кудашкин Сергей Михайлович 1978 г.р. Тот самый, пойманный еще в августе.
3 ноября оперативник Болотских пообещал Павлу, что ксерокопии документов на машину он передаст вместе с проводником поезда, следующего из Адлера в Москву, но их подлинность не будет заверена, а копии постановления о выемке автомобиля и ордера на обыск квартиры не будет (6 ноября Павел эти документы получил). В то же 3 ноября заместитель начальника ОВД Бабушкинского района Вишняков Геннадий Тихонович сообщил лишившемуся автомобиля человеку, что оперативники из Краснодарского уголовного розыска действительно обращались к ним за содействием, но не оставили копию судебного постановления, заверенное печатью и подписью.
На следующий день Павел отправил запрос в Краснодарский край — просил все-таки отдать недостающие копии документов. А 7 ноября — заявление в межрайонную прокуратуру, к которому приложил все документы, подтверждающее его добросовестное право на владение автомобилем. Тем более что, по словам сотрудников ОВД Бабушкинского района, краснодарские оперативники изымать авто права не имели.
9 ноября ознаменовалось чудом. Павлу пришла штрафная квитанция на 2 тысячи рублей — от 31 октября, из Воронежской области. Оказывается, его машина превысила допустимую скорость на 95 км/ч. За рулем находились сотрудники Краснодарского уголовного розыска. А на следующий день — 10-го — стало известно, что по Краснодару на изъятом BMW передвигается тот самый первый, обманутый мордовским мошенником человек.
Первым владельцем машины, записанным в ПТС, была — Лысенко Светлана Эдуардовна, федеральный судья Каневского райсуда Краснодарского края, коллега судьи Дауровой — той, что выписала постановление о выемке автомобиля и ордер на обыск квартиры.
Оказывается, 9 марта 2011 года судья Светлана Лысенко сняла с учета в ГИБДД Каневского района BMW X3, на следующий день встретилась с будущим мошенником гражданином Кудашкиным во дворе собственного дома и, проявив какую-то близорукость — ну, затмение нашло — согласилась обменять BMW на Mercedes ML. Была оформлена нотариально заверенная генеральная доверенность с правом перепродажи, а вот какой-либо договор на обмен машин — нет. И 12 марта, уже в Одинцово Московской области, Кудашкин продал BMW по некоему гражданину Аксенову Г. Л., оформив договор купли-продажи от имени собственника автомобиля — судьи Лысенко. А уже потом автомобиль попал к Павлу, который сейчас и отдувается за чужие грехи и чужую доверчивость.
Кудашкину, с его 29-ю эпизодами, конечно, тоже досталось. Несмотря на законность продажи им машины предпоследнему владельцу, следователь Важева расценила его действия как самовольное распоряжение транспортным средством, собственником которого он не является. Странно — ведь у мордовского афериста на руках на тот момент была не отозванная нотариально заверенная генеральная доверенность. Нет, конечно, нарушение закона в действиях Кудашкина есть: он так и не отдал судье Лысенко ни денег, ни Мерседеса…
То есть, вполне очевидно: федеральный судья Светлана Лысенко стала жертвой мошенничества. Конечно, обидно… И, думается, что Светлана Эдуардовна поделилась бедой со своим мужем — действующим сотрудником краснодарской краевой прокуратуры. Ну, и поехали срочно в Москву местные опера, заработало следствие. И нашло крайнего — Павла. А судье Лысенко нашли утраченный BMW.
Павел, конечно, жаловался — писал заявления в Генеральную прокуратуру, Администрацию Президента и Службу собственной безопасности МВД, — все они были спущены в Управление по надзору за следствием, Следственный комитет и Главное управление МВД Краснодарского края, а потом — еще ниже, на местный уровень. И там, так сказать, остались «без движения».
А гражданином Кудашкиным, кстати, была обманута не только федеральный судья, но еще и несколько наивных полицейских чинов. Например, 1 ноября 2011 года следователь СЧ СУ МВД России по республике Мордовия капитан юстиции Щанкин С. А. изъял Toyota Yaris у Татьяны Д., которая приобрела ее по той же схеме, что и Павел. Автомобиль был так же возвращен первой владелице — Чекашкиной, жене сотрудника МВД Мордовии А. Чекашкина, который, по словам очевидцев, во время изъятия не роскоши, а средства передвижения, находился рядом со следователем, а потом тщательно следил за аккуратностью транспортировки.
8 июля 2011 года подобное приключилось и с Дмитрием З. из Пензы, чью Honda Accord вернули высокопоставленному чиновнику из Мордовии Ю. В. Кулямину.
В связи с этим со всем получается вот что: сложилась некая схема относительно честного отъема у добросовестных приобретателей автомобилей, которых проворонили их первые владельцы. Эту схему замечательно обустроили судьи, прокуроры и сотрудники полиции. Только, если даже отвлечься от бед фактически ограбленных последних собственников, то все равно ситуация выглядит как-то не очень. Вот как вы ответите на вопрос: а если мошенник обидит обычного автовладельца, то эта схема сработает ли? Мне почему-то кажется, что я знаю ответ.
