In a market economy, security tasks, in addition to state law enforcement agencies, are also solved by private detective and security structures that offer the following types of services on the market: detective, security, as well as the development, installation and operation of special security equipment. BC offers a brief overview of the private detective services market in the Baltic countries and Poland. Its uniqueness lies in the fact that there is no information on any research in the Baltic countries on this issue.
The far from exhaustive overview of the private detective and security services market in the Baltic countries and, in comparison with Poland, is based on an analysis of materials from the Latvian Federation of Detectives and Security Services (LDDDF), information from the Confederation of European Security Services and expert assessments of leading experts in the field of business security and personality.
Latvia first passed detective law
In 2006, 310 private security companies and 80 private detectives operated on the territory of the Republic of Latvia. Thus, the Latvian market currently offers security services, detective and mixed - detective and security. The regulatory framework for the activities of private security structures is the Laws of the Republic of Lithuania: “On Security Activities”, “On Detective Activities”, “On Circulation of Arms”, “On the Protection of Personal Data of Individuals”, etc.
It should be noted that only in the Republic of Latvia there is a law "On Detective Activity" (entered into force on November 1, 2001). There is no such regulatory act either in Lithuania or in Estonia.
Latvia's accession to the European Union created the conditions for the emergence of new players in the private security services market. So, in accordance with the amendments to the "Law on Detective Activities", which entered into force on May 1, 2004, "certificates (of private detectives) are entitled to receive a citizen of a member state of the European Union or a citizen of the European Economic Area ..." In other words, private detectives from EU countries got the opportunity to engage in detective activities in Latvia. Whether citizens, as well as non-citizens of the Republic of Latvia, who have certificates, can conduct private investigations in the EU space, EU law is still silent.
With the entry of Latvia into the EU, there has been a tendency for the outflow of personnel from security structures, for example, to Ireland. The shortage of personnel in the security structures necessitates a shift in emphasis in security activities, namely: the expansion of the use of engineering and technical security equipment, the further development of remote monitoring systems for the status of protected objects and the use of mobile quick response teams. There is also a tendency to hire unskilled personnel who do not have certificates to work in private security structures.
Apparently, one should be prepared to continue the expansion of foreign security structures in the Latvian market, which have financial potential incomparable with "local" companies and the ability to lobby their interests in the process of competition for objects. Under these conditions, not being able to withstand competition, small firms are either bought up by "foreigners" or transferred to the shadow business.
Monopolization of the market is not threatened in Lithuania
According to available expert estimates, the level of monopolization of the market of private detective and security services in this country is low. The total number of private companies in the field of security is about 70-80, of which large companies (with more than 500 employees) do not even have ten.
Departments controlling relations in the market of security structures in Lithuania are the Ministry of Internal Affairs of the Republic, the Police Directorate at the Ministry of Internal Affairs and the territorial police commissariats.
The special legislation governing the activities of private security structures was initiated by the Decree of the Government of Lithuania No. 160 of December 3, 1993, Law No. IX-2327 adopted by the Seimas of the Republic "On Personal and Property Security", which entered into force on January 12, 2005. The Law of the Republic of Lithuania “On Legal Protection of Personal Data”, as well as the laws of the Republic of Lithuania “On Security Activities” and “On Weapons” are in the same series.
As for private detective work, as already mentioned above, there is no law in Lithuania that would regulate this activity. At the same time, the "Code of types of activities permitted in Lithuania", published annually by the Department of Statistics, contains activities such as "searching for missing people" and "investigation of theft." The indicated directions, being officially authorized, are, in essence, types of private detective activity.
The Ministry of Internal Affairs of Lithuania carries out compulsory licensing of security structures. Three-year licenses are issued only to companies from Lithuania and the EU, EEC and NATO member states. A license is not required for companies licensed by EU or EEC countries to protect persons entering and leaving the Republic of Lithuania for a period of not more than three months a year.
Private search in Estonia is not specified by law
The scope of security by private entities in Estonia is regulated by the following regulations: Security Act of 08.10.2003 (entered into force May 1, 2004), Government Decree “On Collection”, Professional Qualifications Act, Weapons Act, Security Law , Law on the protection of personal data and other regulatory documents.
The legislation covers the following areas of activity: consulting in the field of security, protection of movable and immovable property, collection, personal protection, maintenance of order at events or guarded facilities, maintenance of a surveillance center, planning, installation and operation of safety equipment. The supervisory structure is the National Police Department.
In private security institutions it is forbidden to work for people who have limited legal capacity, are serving a term in a criminal case, with an outstanding criminal record, are bankrupt, are private detectives. The latter restriction sounds, at least, strange, since in Estonia a private investigation does not have a regulatory framework.
Employers of the security services sector are united in the Confederation of Estonian employers' organizations. There is also a trade union.
Poland: private investigators in the civil service
Public organizations in the field of security in Poland: Polish Chamber of Personal Protection and Property Protection, Polish Association of Employers "Ohron", National Association of Manufacturers and Installers of Alarms Polalarm, Polish Chamber of Alarm Systems.
The scope of security in Poland is regulated by the following regulations: the Law "On Economic Activities" of December 23, 1988, the Law "On Personal Protection and Protection of Property with Regulation of Execution" of August 22, 1997, and the Law "On Detective Services with Regulation of Execution" from July 6, 2001 The control functions are carried out by the Ministry of Internal Affairs and the administration after receiving information from the chief of police of the corresponding voivodship.
The legislation allows the following activities: property protection, personal protection, surveillance, collection, installation and maintenance of alarm systems, detective services.
25% of orders for security services are given by a government contract, 8% by a corporate contract, and the rest by private contract.
The market for consumers of Polish security technology can be divided into three sectors: 30% falls on consumers who are very sensitive to prices - for them, the cheaper the better. 30% of consumers prefer integrated solutions, which, in turn, are quite expensive. 40% of consumers do not know what they want and where they can purchase security services. This is due to a lack of information.
Considering that in Poland, like in the Baltic countries, the formation of private security structures began almost simultaneously with the collapse of the USSR and the social camp, it can be assumed that the consumer market in the Baltic countries consists of the same sectors as in Poland. Another thing is that the percentage of consumers by sector may vary. By the way, there is no information about any research in the Baltic countries on this issue.
The situation on the Polish security market is estimated by experts as rather favorable. With the entry of Poland into the European Union, it has to be guided (as, however, by Latvia, Lithuania and Estonia) to common European standards, which means the mandatory equipping of protection facilities with appropriate safety equipment. The Polish government is investing in the safety of its citizens (which cannot yet be said about the Baltic countries).

В условиях рыночной экономики задачи обеспечения безопасности, кроме государственных правоохранительных органов, решают также и частные детективно-охранные структуры, которые предлагают на рынке следующие виды услуг: детективные, охранные, а также по разработке, монтажу и эксплуатации специальных технических средств охраны. БК предлагает краткий обзор рынка частных детективных услуг в странах Балтии и Польше. Уникальность его состоит в том, что сведений о каких-либо исследованиях в странах Балтии по этой проблематике нет.
Далеко не исчерпывающий обзор рынка частных детективно-охранных услуг стран Балтии и, в сравнении с ними, Польши, основан на анализе материалов Латвийской федерации детективов и служб безопасности (LDDDF), информации Конфедерации европейских служб безопасности и экспертных оценках ведущих специалистов в области обеспечения безопасности предпринимательства и личности.
Латвия первой приняла закон о детективах
На территории Латвийской Республики в 2006 году осуществляли свою деятельность 310 частных охранных предприятий и 80 частных детективов. Таким образом, на рынке Латвии в настоящее время представлены охранные услуги, детективные и смешанные - детективно-охранные. Нормативной базой деятельности частных структур безопасности являются Законы ЛР: "Об охранной деятельности", "О детективной деятельности", "Об обращении оружия", "О защите личных данных физических лиц" и др.
Следует отметить, что только в Латвийской Республике имеется закон "О детективной деятельности" (вступил в силу 1 ноября 2001г.). Такого нормативного акта ни в Литве, ни в Эстонии пока нет.
Вступление Латвии в Евросоюз создало условия для появления новых игроков на рынке частных услуг безопасности. Так, в соответствии с внесенными изменениями в "Закон о детективной деятельности", вступившими в силу 1 мая 2004 г., "сертификаты (частных детективов) вправе получить гражданин страны-члена Европейского Союза или гражданин Европейской экономической зоны..." Другими словами, частные сыщики из стран Евросоюза получили возможность заниматься детективной деятельностью на территории Латвии. Могут ли в пространстве Евросоюза вести частно-сыскную деятельность граждане, а также неграждане Латвийской Республики, имеющие сертификаты, законодательство ЕС пока умалчивает.
Со вступлением Латвии в ЕС наметилась тенденция оттока кадров из охранных структур, например, в Ирландию. Дефицит личного состава в охранных структурах диктует необходимость смещения акцентов в охранной деятельности, а именно: расширение использования инженерно-технических средств охраны, дальнейшее развитие систем дистанционного контроля за состоянием охраняемых объектов и использование мобильных групп быстрого реагирования. Отмечается также тенденция приема на работу в частные охранные структуры неквалифицированных кадров, не имеющих сертификатов.
По-видимому, следует быть готовым к продолжению экспансии иностранных охранных структур на латвийском рынке, обладающих несопоставимым с "местными" фирмами финансовым потенциалом, возможностями лоббирования их интересов в процессе конкурентной борьбы за объекты. В этих условиях, не выдерживая конкурентной борьбы, мелкие фирмы либо скупаются "иностранцами", либо переходят в теневой бизнес.
Литве монополизация рынка не грозит
Согласно имеющимся экспертным оценкам, уровень монополизации рынка частных детективно-охранных услуг в этой стране невысок. Общее количество частных компаний в области безопасности - около 70-80, из них крупных компаний (со штатом более 500 человек) не наберется и десяти.
Ведомства, контролирующие отношения на рынке охранных структур Литвы, - это МВД республики, Полицейское управление при МВД и территориальные полицейские комиссариаты.
Начало специального законодательства, регулирующего деятельность частных охранных структур, положили Решение правительства Литвы № 160 от 03.12.1993 г., Закон № IX-2327, принятый Сеймом Республики "О личной безопасности и безопасности собственности", вступивший в силу 12 января 2005 года. В этом же ряду и Закон Литовской Республики "О правовой охране личных данных", а также законы Литовской Республики "Об охранной деятельности" и "Об оружии".
Что касается частной детективной деятельности, то, как уже указывалось выше, закона, который регулировал бы эту деятельность, в Литве нет. Вместе с тем в "Кодификаторе видов деятельности, разрешенных на территории Литвы", ежегодно издаваемом Департаментом статистики, содержатся такие виды деятельности, как "поиск пропавших людей" и "расследование хищений". Указанные направления, будучи официально разрешенными, являются, по существу, видами частно-сыскной деятельности.
МВД Литвы осуществляет обязательное лицензирование охранных структур. Лицензии на три года выдаются только компаниям из Литвы и стран-членов ЕС, ЕЭС и НАТО. Лицензия не требуется для компаний, имеющих лицензию стран ЕС или ЕЭС на охрану лиц, въезжающих и выезжающих из Литовской Республики на срок не более чем на три месяца в году.
В Эстонии частный сыск не оговорен законом
Сфера обеспечения безопасности частными структурами в Эстонии регулируется следующими нормативными актами: Законом о безопасности от 08.10.2003 года (вступил в силу 1 мая 2004 года), Указом правительства "Об инкассации", Законом о профессиональной квалификации, Законом об оружии, Законом об охранной деятельности, Законом о защите личных данных и другими нормативными документами.
Законодательство охватывает следующие области деятельности: консалтинг в области безопасности, охрана движимого и недвижимого имущества, инкассация, личная защита, поддержка порядка на мероприятиях или охраняемом объекте, обслуживание центра наблюдения, планирование, установка и эксплуатация оборудования для обеспечения безопасности. Контролирующей структурой является Национальный департамент полиции.
В частных структурах безопасности запрещено работать лицам, которые имеют ограниченную дееспособность, отбывают срок по уголовному делу, с непогашенной судимостью, являются банкротами, являются частными детективами. Последнее ограничение звучит, по меньшей мере, странно, так как в Эстонии частный сыск не имеет нормативно-правовой базы.
Работодатели сферы охранных услуг объединены в Конфедерацию эстонских организаций работодателей. Также действует профессиональный союз.
Польша: частные сыщики на госслужбе
Общественные организации в области безопасности в Польше: Польская палата личной защиты и защиты собственности, Польская ассоциация работодателей "Охрона", Национальная ассоциация производителей и инсталляторов сигнализации Polalarm, Польская палата систем охранной сигнализации.
Сфера обеспечения безопасности в Польше регулируется следующими нормативными актами: законом "Об экономической деятельности" от 23 декабря 1988 г., законом "О личной защите и защите собственности с регламентацией исполнения" от 22 августа 1997 года и законом "О детективных услугах с регламентацией исполнения" от 6 июля 2001 года Контрольные функции осуществляют МВД и администрация после получения информации от шефа полиции соответствующего воеводства.
Законодательством разрешены следующие виды деятельности: защита собственности, личная защита, наблюдение, инкассация, монтаж и обслуживание систем сигнализации, детективные услуги.
25% заказов для охранных услуг дает государственный подряд, 8% - корпоративный, остальные - частный подряд.
Рынок потребителей технологии безопасности Польши можно разделить на три сектора: 30% приходится на потребителей, которые очень чувствительны к ценам, - для них, чем дешевле, тем лучше. 30% потребителей предпочитают комплексные решения, которые, в свою очередь, стоят довольно дорого. 40% потребителей не знают, что они хотят и где можно приобрести услуги безопасности. Это происходит из-за недостатка информации.
Учитывая, что в Польше, как и странах Балтии, формирование частных структур безопасности началось почти одновременно с развалом СССР и соцлагеря, можно полагать, что рынок потребителей в странах Балтии состоит из тех же секторов, что и в Польше. Другое дело, что процентное соотношение потребителей по секторам может разниться. Кстати, сведений о каких-либо исследованиях в странах Балтии по этой проблематике нет.
Ситуация на польском рынке безопасности оценивается экспертами как довольно благоприятная. Со вступлением Польши в Европейский Союз ей приходится ориентироваться (как, впрочем, Латвии, Литве и Эстонии) на единые европейские стандарты, а это значит обязательное оборудование объектов защиты соответствующими средствами безопасности. Правительство Польши инвестирует в безопасность своих граждан (чего пока нельзя сказать о странах Балтии).
По оценкам экспертов, в ближайшее время могут появиться польские компании-производители технологий безопасности
