Поправки, отменяющие административный арест за неуплату штрафов, а также уменьшающие в два раза сумму штрафа при признании вины нарушителем и готовности оплатить его в кратчайшие сроки, в марте будет внесен в Госдуму, сообщил журналистам в четверг первый зампред комитета по конституционному законодательству и госстроительству, лидер движения автомобилистов "Свобода выбора" Вячеслав Лысаков.
Поправка, которая фактически подготовлена и будет внесена к заседанию комитета, об отмене административного ареста за неуплату штрафа в случае, если это произошло в первый раз, - сказал Лысаков.
Он пояснил, что в настоящее время Кодекс об административных правонарушениях (КоАП) РФ предусматривает за неуплату штрафа либо его удвоение, либо административный арест до 15 суток.
"Если человек не заплатил штраф, я предлагаю административному аресту не подвергать, оставить только удвоение штрафа, а во второй раз - либо увеличение штрафа в четыре раза, либо административный арест", - сказал Лысаков.
Я считаю, что административный арест - это очень жестокое наказание. Тем более что суммы, за которые сажают у нас в каталажку в регионах, минимальные. Это может быть 100 рублей. Такие случаи реально есть. Штрафы надо платить, но на 5-7 суток сесть и выйти оттуда с туберкулезом, на мой взгляд, не очень адекватное наказание, хотя по закону это именно так, - отметил депутат.
Кроме того, он предлагает уменьшить сумму штрафа ровно на 50%, если человек согласен с тем, что виноват, и заплатил штраф в течение 10 суток, не дожидаясь решения суда, что поможет, в том числе, упростить работу судей.
По словам депутата, законопроект может быть рассмотрен уже до конца весенней сессии.
