Private detective getting legal access to privacy of correspondence and telephone conversations.
Dear Colleagues! In continuation of the topic of the scope of a detective crime, I propose to read my new article:

Considering the category of secrets of private and personal life, one should not miss such a crucial issue as how a detective obtains legal access to the secrecy of correspondence, telephone conversations, postal, telegraphic and other messages in the conditions of not exceeding his authority in conducting a private investigation

Part 2 of Article 23 of the Constitution of the Russian Federation states that everyone has the right to confidentiality of correspondence, telephone conversations, postal, telegraphic and other communications. At the same time, the criminal liability for the Detective comes for abuse of authority during the investigation that entailed a significant violation of the rights of citizens and organizations of art. 203 of the Criminal Code. It follows that the victims may be citizens of the Russian Federation, as well as legal entities registered in Russia - as part of the detective’s private search activities.
You must understand that all the ways in which messaging is prohibited are listed in Art. 138 of the Criminal Code. Among them are named: correspondence, telephone conversations, mail messages, electronic messages.
Printouts are also included in the list of prohibited methods of transmitting information (see Sentence of the Almetyevsk City Court of the Republic of Tatarstan in Case No. 1-218/2016).
We also made this conclusion on the basis of the interpretation by the Constitutional Court of the concept of “secrecy” - “Information constituting the secret of telephone conversations protected by the Constitution of the Russian Federation and laws in force on the territory of the Russian Federation” is any information transmitted, stored and established using telephone equipment, including data about incoming and outgoing connection signals of telephone sets of specific communication users ”.
The objective side of the "detective" crime is characterized by violation of the secrecy of correspondence, telephone conversations, as well as familiarization with information received by fax and other communications.
The crime should be considered completed from the moment the Detective was illegally acquainted with the contents of a telephone conversation, letter, telegraph, postal or other message (when receiving information illegally), as well as from the moment the detective reported the information to other persons who became known to him legally.
Subject of this crime is a Private Investigator acting under a license.
The subjective side of the crime characterized by the intent of the Detective.
An analysis of detective practice allows us to assume that not always a violation of the secrecy of correspondence, negotiations and other messages occurs when the printout becomes the property of the Detective without the consent of the Addressee.
In our opinion, legal cases of acquaintance of a detective with the correspondence of citizens are cases where correspondence (printout) is transmitted to the Detective with the written consent of at least one of the parties (mainly from the customer), in order to conduct a private investigation.
Such a transfer must be documented, for example, by writing in the section “Responsibilities of the customer” in the Agreement “On the provision of private detective services” a special provision where the Customer undertakes to transmit to the Detective the details of the telephone calls of a mobile or landline telephone. In this case, the detective takes all reasonable measures in order to verify the relevance and veracity of the documents attached to the contract by the Customer.
Detective’s actions cannot be qualified as violating the secrecy of correspondence even in the case when, on the one hand, the Customer cannot give consent, and it is not possible to establish the identity of the anonymous phone user. In our opinion, the only way out in such cases may be a written notice to the owner of the telephone number that the Detective is conducting private search activities in his regard.
As an example, the following case is indicative. An unknown phone number was determined on the screen of K.'s smartphone, in connection with which he turned to the Detective for help. During the search, the Detective found out that the owner of the phone number is a telecommunication company that distributes SIM cards in crowded places (clothing markets, large shopping centers, train stations). Thus, the circumstances did not allow identifying the initiator of the phone call on time, and since without the written consent of the owner of the phone number a further investigation would be difficult and even impossible, the Detective prepared and sent a letter to the registration address of the telecommunications company asking him to assist in conducting investigations.
Examples like the above are increasingly found in detective practice. Mostly, the purpose of the investigation is to identify the caller, establish the circle of his constant communication, as well as the place of primary residence.
So, Detective K., carrying out an investigation of a civil case using the Internet resource Avito, found the mobile phone of citizen P., a wholesale seller of self-published copies of books. During electronic correspondence with the seller, the Detective found out that the subscriber number, which was in the actual use of P., was registered in S. - a citizen of Tajikistan. Since P. refused to provide the address of her office, and due to the fact that the investigation was urgent, the detective wrote in writing to the owner of S.'s phone about the need to interview him in the case under investigation.
We add that the Detective does not have the right to transmit to the Customer information about the private life of persons who use the phone, except for the information that in aggregate does not allow to specifically identify the person.
Summing up the above, it should be noted that the secret of communications is an incredibly complex and unstable legal institution. On the one hand, embodying the exercise of the right of nominal persons to commit unlawful acts with impunity, and on the other, the realization of the constitutional right of a Russian citizen to privacy in the conditions of inadmissibility of abuse of authority by a private detective in the course of his investigation.

Получение частным детективом законного доступа к тайне переписки и телефонных переговоров.
Уважаемые, Коллеги! В продолжение темы о пределах детективного преступления предлагаю к прочтению свою новую статью:
Раскрытие протокола соединений телефонного номера
Рассматривая категорию тайны частной и личной жизни нельзя пропустить такой важнейший вопрос, как получение сыщиком законного доступа к тайне переписки, телефонных переговоров, почтовых, телеграфных и иных сообщений в условиях не превышения им полномочий при осуществлении частного расследования
Информация может быть доверена детективу для проверки при осуществлении им своих профессиональных обязанностей. Она также может Передаваться, а может быть Собрана детективом самостоятельно. Принципиальное отличие двух способов получения свидетельств состоит в том, что в первом случае Детектив не проявляет никакой инициативы для их получения. В остальных же случаях, Детектив побуждает вероятный источник передать ему добровольно факты и иные свидетельства имеющие отношение к расследуемому делу.
Главным способом передачи информации является беседа Детектива со своим Заказчиком, и происходит это, как правило, на преддоговорной стадии частного расследования - во время консультирования до подписания договора услуг.

Ниже мы будем говорить, пожалуй, о самом закрытом и информативном источнике сведений к которым относим Протокол (детализацию) соединений за определённый период времени по абонентскому номеру.
В ч.2 ст 23 Конституции РФ говорится, что каждый имеет право на тайну переписки, телефонных переговоров, почтовых, телеграфных и иных сообщений. В то же время уголовная ответственность для Детектива наступает за превышение полномочий при осуществлении расследования повлекшее существенное нарушение прав граждан и организаций ст. 203 УК. Отсюда следует, что потерпевшими могут выступать граждане Российской Федерации, а также юридические лица, зарегистрированные на территории России - в рамках проведения детективом частно-поисковых мероприятий.
Надо понимать, что все способы, посредством которых передача сообщений запрещена перечислены в ст. 138 УК. В их числе названы: переписка, телефонные переговоры, почтовые сообщения, электронные сообщения.
Распечатки также входят в указанный перечень запрещённых способов передачи информации (см. Приговор Альметьевского городского суда Республики Татарстан по Делу №1-218/2016).
Этот вывод мы сделали и на основании толкования Конституционным Судом понятия «тайны» - «Информацией, составляющей охраняемую Конституцией Российской Федерации и действующим на территории Российской Федерации законами тайну телефонных переговоров, считаются любые сведения, передаваемые, сохраняемые и устанавливаемые с помощью телефонной аппаратуры, включая данные о входящих и исходящих сигналах соединения телефонных аппаратов конкретных пользователей связи».
Объективная сторона "детективного" преступления характеризуется нарушением тайны переписки, телефонных переговоров, а также ознакомлением с информацией, поступившей по факсу и другим коммуникациям.
Преступление следует считать оконченным с момента незаконного ознакомления Детектива с содержанием телефонного разговора, письма, телеграфного, почтового или иного сообщения (при получении информации незаконным способом), а также с момента сообщения детективом сведений другим лицам, ставших ему известными законным путём.
Субъектом этого преступления является Частный Сыщик, действующий на основании лицензии.
Субъективная сторона преступления характеризуется умыслом Детектива.
Анализ детективной практики позволяет нам предположить, что не всегда нарушение тайны переписки, переговоров и иных сообщений имеет место в случае, когда распечатка становится достоянием Детектива без согласия на то Адресата.
На наш взгляд, законными случаями ознакомления детектива с перепиской граждан являются случаи, когда корреспонденция (распечатка) передаётся Детективу с письменного согласия хотя бы одной из сторон, (преимущественно, от заказчика), в целях осуществления частного расследования.
Такую передачу необходимо закрепить документально, например, записав в разделе «Обязанности заказчика» в Договоре "О предоставлении частных сыскных услуг" специального положения, где Заказчик обязуется передать Детективу детализацию телефонных вызовов мобильного или стационарного телефона. При этом, детектив принимает все разумные меры для того, чтобы удостовериться в актуальности и правдивости прилагаемых Заказчиком к договору документов.
Не могут квалифицироваться действия Детектива, как нарушение тайны переписки и в случае, когда с одной стороны Заказчик не может дать согласие, при этом, личность анонимного пользователя телефона установить не представляется возможным. На наш взгляд, единственным выходом в подобных случаях может являться письменное уведомление владельца телефонного номера о том, что в его отношении Детективом осуществляются частные поисковые мероприятия.
Как пример, показателен следующий случай. На экране смартфона К. определился номер неизвестного телефона, в связи с чем тот обратился за помощью к Детективу. В ходе поисковых мероприятий Детектив выяснил, что владельцем телефонного номера является телекоммуникационная компания, распространяющая SIM-карты в местах массового скопления людей (вещевые рынки, крупные торговые центры, вокзалы). Таким образом, обстоятельства не позволяли вовремя идентифицировать инициатора телефонного вызова, а поскольку без письменного согласия владельца телефонного номера дальнейшее расследование было бы затруднительным и даже невозможным, то Детектив подготовил и отправил по юридическому адресу регистрации телекоммуникационной компании письмо, в котором попросил её руководителя содействовать в проведении расследования.
Примеры, подобные вышеприведённому, все чаще и чаще встречаются в детективной практике. Преимущественно, цель расследования направлена на идентификацию личности звонящего, установление круга его постоянного общения, а также места преимущественного пребывания.
Так, Детектив К., осуществляя расследование по гражданскому делу с помощью Интернет-ресурса Avito нашёл мобильный телефон гражданки П. - оптового продавца самиздатовских копий книг. В ходе электронной переписки с продавцом, Детектив выяснил, что абонентский номер, который находился в фактическом пользовании П. был зарегистрирован на С. - гражданина Таджикистана. Так как П. отказалась сообщить адрес своего офиса, и в связи с тем, что расследование не терпело дальнейших отлагательств, то детектив письменно уведомил владельца телефона С. о необходимости опросить его по расследуемому делу.
Добавим, что Детектив не имеет права передавать Заказчику сведения о частной жизни лиц - пользователей телефона, за исключением тех сведений, которые в своей совокупности не позволяют определённо идентифицировать лицо.
Подводя итог вышеизложенному, следует отметить, что тайна связи является невероятно сложным и неустойчивым правовым институтом. С одной стороны, воплощая в себе реализацию права номинальных лиц совершать противозаконные деяния безнаказанно, а с другой - реализацией конституционного права гражданина России на неприкосновенность частной жизни в условиях недопустимости превышения полномочий частным детективом при осуществлении им расследований.

Так как П. отказалась сообщить адрес своего офиса, и в связи с тем, что расследование не терпело дальнейших отлагательств, то детектив письменно уведомил владельца телефона С. о необходимости опросить его по расследуемому делу.
Добавим, что Детектив не имеет права передавать Заказчику сведения о частной жизни лиц - пользователей телефона, за исключением тех сведений, которые в своей совокупности не позволяют определённо идентифицировать лицо.
Подводя итог вышеизложенному, следует отметить, что тайна связи является невероятно сложным и неустойчивым правовым институтом. С одной стороны, воплощая в себе реализацию права номинальных лиц совершать противозаконные деяния безнаказанно, а с другой - реализацией конституционного права гражданина России на неприкосновенность частной жизни в условиях недопустимости превышения полномочий частным детективом при осуществлении им расследований.

Позволю прокомментировать очередной пост нашего детективного аудитора-графомана.
1. На настоящий момент, по Законодательству Российской Федерации, тайна почтовых отправлений и телефонных переговоров может быть нарушена ТОЛЬКО субъектом оперативно-розыскной деятельности в РФ и ТОЛЬКО по решению Суда.
Частный детектив (с лицензией или без оной) НЕ ЯВЛЯЕТСЯ субъектом оперативно-розыскной деятельности в РФ.
Следовательно выдать ему соответствующее разрешение может только НЕВМЕНЯЕМЫЙ судья.

Юридическая глупость несусветная. Поскольку напрашивается вывод: - Если детектив не является субъектом ОРД, то он не может нарушить тайну почтовых отправлений и телефонных переговоров.
Согласен, Но! в статье идет речь о получении распечатки. При выяснении биографических и других характеризующих личность данных пользователя телефона детектив использует сведения из открытых источников в совокупности с методами социальной инженерии.
