Participants in criminal trials will be allowed to use the services of private detectives; Participants in criminal trials may receive the right to use the services of private detectives to collect information on the case and protect their interests. The corresponding bill1 was submitted to the State Duma by a group of deputies.
Additions regarding the use of private detectives are proposed to be made to a number of articles of the Code of Criminal Procedure. The conclusion of the relevant agreement will be written in the list of rights of participants in the process, and the results of the detectives will be considered one of the types of evidence.
The explanatory note to the bill emphasizes that the right of private detectives to collect evidence in a criminal case is already mentioned in Art. 3 of the Law of the Russian Federation of March 11, 1992 No. 2487-I "On Private Detective and Security Activities in the Russian Federation" (hereinafter - Law No. 2487-I). However, due to the lack of necessary provisions in the Code of Criminal Procedure of the Russian Federation, detectives cannot fully develop this area of activity.
At the same time, the same authors submitted another bill2 to the State Duma, amending Law No. 2487-I itself. They suggest eliminating inaccuracies from the document. Now it allows private security guards to use weapons to protect property, but they can only use special equipment to protect the client’s life and health. Deputies indicate that a person’s life is more valuable than property, which means that it can be protected with at least the same means as property. According to the deputies, due to the imperfection of the law, bodyguards have been obliged to formally conclude contracts over the past 22 years not to protect the lives of clients, but to protect the property that is with them.

Участникам уголовных процессов разрешат пользоваться услугами частных детективовУчастники уголовных процессов, возможно, получат право пользоваться услугами частных детективов для сбора сведений по делу и защиты своих интересов. Соответствующий законопроект1 внесла в Госдуму группа депутатов.
Дополнения, касающиеся использования частных детективов, предлагается внести в ряд статей УПК РФ. Заключение соответствующего договора пропишут в перечне прав участников процесса, а результаты работы детективов будут считаться одним из видов доказательств.
В пояснительной записке к законопроекту подчеркивается, что право частных детективов на сбор доказательств по уголовному делу уже упомянуто в ст. 3 Закона РФ от 11 марта 1992 г. № 2487-I "О частной детективной и охранной деятельности в Российской Федерации" (далее – Закон № 2487-I). Однако из-за отсутствия необходимых положений в УПК РФ детективы не могут в полной мере развить это направление деятельности.
Одновременно те же авторы внесли в Госдуму другой законопроект2, вносящий поправки в сам Закон № 2487-I. Они предлагают устранить из документа неточность. Сейчас он позволяет частным охранникам использовать оружие при защите имущества, но при защите жизни и здоровья клиента они могут применять только спецсредства. Депутаты указывают, что жизнь человека ценнее имущества, а значит, ее можно защищать как минимум с теми же средствами, что и имущество. По информации депутатов, из-за несовершенства закона телохранители вынуждены в течение 22 последних лет формально заключать договоры не на защиту жизни клиентов, а на охрану находящегося при них имущества.

Наконец-то господа балбесы-чиновники, возможно стали чуть-чуть понимать о необходимости продвижения частного сыска, и его правильного юридического формирования !
