He was charged with forgery of an official document and its use (Article 325 of the Criminal Code of the Republic of Kazakhstan) and of conferring the title of representative of the authorities (Article 328 of the Criminal Code of the Republic of Kazakhstan).

An investigation went on for a long time, after which the investigator sent the criminal case to court. But recently, the regional prosecutor’s office refused to support the prosecution in this case. The supervisor decided that the student did not commit crimes. And all his antics are the result of the negligence of traffic police officials. The regional prosecutor's office concluded that the young man did not forge the document, but simply invented it.

Реальная история произошла не так давно в Караганде. Житель Темиртау, студент КарГУ имени Букетова сделал на компьютере удостоверение сотрудника службы охраны президента и придумал спецсообщение, написав в нем, будто его направили из администрации президента проверять, как госслужащие соблюдают правила дорожного движения.
Начальство управления дорожной полиции поверило липовым бумагам, и в течение 5 дней студент проверял работу личного состава и лично срывал тонировку со стекол машин, принадлежащих далеко не последним людям в финполе и других госструктурах.
"Он вел себя очень уверенно, поэтому сомнений в том, что он вовсе не сотрудник службы охраны президента, не возникло", – так написали в своих объяснительных сотрудники департамента финансовой полиции, с машин которых на территории финпола студент лично срывал тонировку со стекол.
Таким же образом оправдалось и руководство управления дорожной полиции, наделившее студента третьего курса исторического факультета КарГУ особыми правами – выдав ему форму сотрудника дорожной полиции и спецмашину.
Дело было вечером, делать было нечего 20-летний студент из Темиртау в декабре 2008 года, заскучав вечером дома, решил поразвлечься. Он нашел в
Интернете образец служебного удостоверения сотрудника службы охраны президента (СОП), вставил туда свои анкетные данные и вывел его на принтере. Затем набрал на компьютере слово "Спецсообщение". А ниже текст: "Направляем в управление дорожной полиции департамента внутренних дел Карагандинской области нашего сотрудника для проведения мероприятий, направленных на пресечение нарушений правил дорожного движения". И подпись: "начальник АП службы охраны президента SK4 майор Б. Е.
Коктебаев".
Студент придумал эту должность и фамилию, после чего вывел текст на обычный лист бумаги и сам расписался.
С этим липовым спецсообщением и удостоверением сотрудника СОПа студент пришел в областное управление дорожной полиции и, показав дежурному документы, попросил проводить его к начальнику. Его тут же проводили в кабинет к Болату Ахимбекову.

Надзорный орган решил, что студент не совершал преступлений. А все его выходки – результат халатности должностных лиц дорожной полиции. Областная прокуратура пришла к выводу, что молодой человек не подделывал документ, а просто придумал его.
"…Бланк документа удостоверения сотрудника СОП за № 0000501, изъятого у задержанного жителя Темиртау М. , не соответствует специальному образцу удостоверения", – сказано в заключении судебно-технической экспертизы.
Кроме того, прокуратура не согласилась со следователем и по статье
"Присвоение звания представителя власти". Ведь студент лично не оформлял протоколы, а значит, не брал на себя чужих полномочий. А то, что он требовал от госслужащих не ездить с тонированными стеклами, – это правильно! Требовать соблюдения правил дорожного движения вправе каждый гражданин Казахстана.
Недавно прокуратура вынесла постановление о прекращении уголовного дела за отсутствием в действиях студента состава преступления.
Хорошо, что студент оказался не злым, а добрым шутником и выдвигал законные требования снять тонировку, а не вымогал деньги с водителей-нарушителей или не сотворил другое преступление. А правоохранительным органам впредь следовало бы быть внимательнее и не верить первому встречному и его документам, сделанным на ксероксе.
