Profession on the verge of a foul

Detective agencies in the country began to appear especially actively in the early 1990s. This is explained by the need to protect the rights and legitimate interests of participants in civil, criminal and administrative proceedings, to ensure safe conditions for the development of business and others. However, the legislation was soon amended, and officially private security and detective activities were liquidated.

Someone will say, they say, the concept of "the activity of private detectives, regardless of the type of clients or the purpose of the investigation," is in the National Classifier "Types of Economic Activities" (OKED), that is, there is such a profession. However, the classifier itself is a technical document, it does not establish rules, does not allow or forbid anything. There is no legislation regulating the work of private detectives in the country, he tells me Aleksey Tukalo, head of the department of operational investigative activities of the police department of the Academy of the Ministry of Internal Affairs:

- In some CIS countries, for example, in Russia, Kyrgyzstan, there are such laws, and they work. In Belarus, a private investigation is illegal, and the person who deals with it can be prosecuted under a number of articles of the Criminal Code. For example, for interference in the personal life of unauthorized persons, illegal collection or dissemination of information about private life, unlawful seizure of computer information, illegal production, acquisition or sale of funds for secretly obtaining information, commercial espionage. If private detectives use the means of secretly obtaining (fixing) information, this can be qualified as the development, use or distribution of malicious programs. If it turns out that these actions led to serious consequences, then the detective and the client run the risk of being sent to places of imprisonment for a period of 3 to 10 years.

Aleksey Tukalo recalled that legally only law enforcement agencies have the right to collect information about a person, his connections, monitor, control and so on.

In reality, the picture is different. In the ads, "detectives" are not modest, the range of services is wide. They offer “hidden photo and video filming of an object, its movements, contacts, meetings in order to obtain complete information about it and its lifestyle,” they promise the observation and analysis of calls, the study of a person’s social circle. Detectives, assure us, have access to various bases, including closed ones. Most of the “orders” are connected with adultery, and someone needs to check the employee and conduct business intelligence, infiltrate the company, establish relations with the object of surveillance, collect incriminating evidence, etc. There are known examples when detectives provided customers with special programs and secretly installed them on telephones and computers of those who were monitored. So we listened to calls, read correspondence. Through the efforts of a pseudo-detective in the room and the car, eavesdroppers and video devices were installed. There was a case when a Belarusian bought abroad for resale pens with integrated video cameras.

Search are scammers

The fact that the services of detective agencies are in demand is confirmed by the next lawsuit in Minsk. Now a person is being tried for fraud. Which is also indicative, because in most cases the "detectives" are ordinary crooks. The current defendant Andrei M. has been offering the services of a private investigator for almost 10 years, he created his own website. He claimed that he could collect information about housing and work, lifestyle and social circle, sources of income and other personal information about people. M. promised details of telephone connections, information from specialized departmental databases, which the accused actually did not have access to.

The issue with private investigation is not simple. However, is it time to regulate this area? Firstly, the prolonged uncertainty is a fertile ground for scammers and all kinds of amateur performances. Secondly, detectives could be very useful, for example, in private proceedings, in the search for debtors, witnesses and missing persons, in collecting information for business partners and more. Following the example of other countries, detective work can be professional, licensed and controlled, with certain rights and prohibitions. While the issue of legalization of detective agencies has not been raised, certainly before the deputies.

He is obliged to conclude with the customer a written contract for the provision of detective services, as a result, an act on the performance of work is drawn up.

Private detectives are prohibited from hiding from the law enforcement agencies the facts of impending, committed or committed crimes, impersonating law enforcement officers, collecting information related to their personal lives, political and religious beliefs of people, conducting video and audio recordings, photo and film shooting without the written consent of officials or individuals. В объявлениях предлагается уличить супруга в неверности, раздобыть компромат на бизнес-партнера, провести слежку, расследование и даже найти мошенников. Что стоит за всем этим и надо ли выводить частный сыск из тени?

Профессия на грани фола

Детективные агентства в стране стали особенно активно появляться в начале 1990‑х. Это объясняется потребностями в защите прав и законных интересов участников гражданского, уголовного и административного производства, в обеспечении безопасных условий развития бизнеса и прочим. Однако вскоре в законодательство внесли изменения и официально частную охранную и детективную деятельность ликвидировали.

Кто-то скажет, мол, понятие-то «деятельность частных детективов независимо от типа клиентов или целей расследования» есть в Общегосударственном классификаторе «Виды экономической деятельности» (ОКЭД), то есть такая профессия имеется. Однако сам классификатор — технический документ, он правил не устанавливает, ничего не разрешает и не запрещает. Законодательства, регулирующего работу частных детективов, в стране нет, говорит мне начальник кафедры оперативно-разыскной деятельности факультета милиции Академии МВД Алексей Тукало:

— В отдельных государствах СНГ, например, в России, Кыргызстане, такие законы есть, и они работают. В Беларуси же частный сыск нелегален, и человека, который им занимается, можно привлечь к ответственности по ряду статей Уголовного кодекса. К примеру, за вмешательство в личную жизнь неуполномоченными на то лицами, незаконный сбор либо распространение информации о частной жизни, неправомерное завладение компьютерной информацией, незаконное изготовление, приобретение либо сбыт средств для негласного получения информации, коммерческий шпионаж. В случае использования частными детективами средств негласного получения (фиксации) сведений это могут квалифицировать как разработку, использование либо распространение вредоносных программ. Если окажется, что эти действия привели к тяжелым последствиям, то детектив вместе с клиентом рискуют попасть в места лишения свободы на срок от 3 до 10 лет.


Алексей Тукало напомнил, что на законных основаниях собирать информацию о человеке, его связях, вести наблюдение, контроль и так далее имеют право только правоохранительные органы.

В реальности же картина другая. В объявлениях «детективы» не скромничают, спектр услуг широк. Предлагают «скрытую фото- и видеосъемку объекта, его передвижений, контактов, встреч с целью получения о нем и его образе жизни полной информации», обещают наблюдение и анализ звонков, изучение круга общения человека. Сыщики, уверяют нас, имеют доступ к различным базам, в том числе закрытым. Большинство «заказов» связано с супружескими изменами, а кому-то надо проверить работника и провести бизнес-разведку, внедриться в фирму, завязать отношения с объектом слежки, собрать компромат и т.д. Известны примеры, когда «сыщики» предоставляли клиентам спецпрограммы и их тайно устанавливали на телефоны, компьютеры тех, за кем велось наблюдение. Так прослушивали звонки, читали переписку. Стараниями псевдодетектива в помещении и авто устанавливались подслушивающие и видеоустройства. Был случай, когда белорус закупал за границей для перепродажи ручки со встроенными видеокамерами.

Поиск ведут аферисты

То, что услуги детективных агентств востребованы, подтверждает очередной судебный процесс в Минске. Сейчас человека судят за мошенничество. Что тоже показательно, ведь в большинстве случаев «детективы» — обычные жулики. Нынешний фигурант Андрей М. почти 10 лет предлагал услуги частного сыщика, создал свой сайт. Уверял, что может собирать информацию о жилье и работе, образе жизни и круге общения, источниках доходов и другие личные сведения о людях. М. обещал детализацию телефонных соединений, информацию из специализированных ведомственных баз данных, доступа к которым у обвиняемого на самом деле не было.

Что до жучков, то выяснилось вот что: М. покупал на радиорынке детские Smart-часы с функцией GPS-трекера, переделывал их под устройство слежения и передавал заказчице для установки в автомобиле супруга. Перемещение отслеживал с помощью программного обеспечения к часам. Такое устройство оперативники нашли дома у «детектива», а эксперты подтвердили: это специальное техсредство для негласного получения информации.

Кстати, сам «сыщик» о себе разглашения данных не желает, фото- и видеосъемку из суда просит не вести. Этот человек уже был судим за подобные аферы, последний раз в 2013 году. Прошлым летом «детектива» снова поймали с поличным. Знал ли о сомнительности предлагаемых услуг? Говорит, что в 2011 году интересовался этим вопросом: «Я посмотрел, что нет нормативных актов, которые это регулируют. То есть деятельность не разрешалась и не запрещалась. Ну я и решил, что могу».

Рассказывая о ситуациях, которые привели на скамью подсудимых, мужчина равнодушно описывал случаи, когда клиенты просили предоставить данные о телефонных соединениях, заказывали слежку за супругами и их любовницами, чужими людьми: «Одна клиентка заплатила за наблюдение за своей сестрой… Еще одна просила, чтобы я познакомился с девушкой, водил ее по ресторанам, собирал на нее компрометирующую информацию. Сама заказчица в это время налаживала отношения со своим молодым человеком...» Желая казаться человеком надежным, «сыщик» смело показывал клиентам паспорт и оставлял расписки: мол, деньги брал.

Вопрос с частным сыском непростой. Однако не пора ли урегулировать эту сферу? Во-первых, затянувшаяся неопределенность — благоприятная почва для аферистов и всякой самодеятельности. Во-вторых, детективы могли бы оказаться весьма полезны, к примеру, в разбирательствах в частном порядке, в поиске должников, свидетелей и без вести пропавших, в сборе информации для деловых партнеров и прочем. По примеру других стран детективная деятельность может быть профессиональной, лицензируемой и контролируемой, с определенными правами и запретами. Пока вопрос легализации детективных агентств не поднимался, перед депутатами уж точно.

КАК У НИХ?


Как этот вопрос решили наши партнеры по Союзному государству? Российский законодатель понятие «частный детектив» в правовой оборот ввел в 1992 году, наделяя его определенными правами. В России эта деятельность лицензируемая. Лицензия дается на пять лет, а вместе с ней — удостоверение детектива. Он обязан заключать с заказчиком письменный договор на оказание сыскных услуг, по итогу составляется акт о выполнении работ.

Частным детективам запрещается скрывать от правоохранительных органов ставшие им известными факты готовящихся, совершаемых или совершенных преступлений, выдавать себя за сотрудников правоохранительных органов, собирать сведения, связанные с личной жизнью, с политическими и религиозными убеждениями людей, вести видео- и аудиозапись, фото- и киносъемку без письменного согласия должностных или частных лиц. Запрещено делать что-либо в ущерб прав и свобод граждан, ставить под угрозу их жизнь, здоровье, честь, достоинство и имущество, получать и использовать информацию из специальных и информационно-аналитических баз данных органов, ведущих оперативно-разыскную деятельность, и т.д. Под запретом также сыскные действия, нарушающие тайну переписки, телефонных переговоров и сообщений. Что же разрешено? Устный опрос граждан и должностных лиц с их согласия, наведение справок, изучение предметов и документов — с письменного согласия их владельцев, внешний осмотр строений, помещений и других объектов, наблюдение для получения необходимой информации в целях оказания услуг и т.п.
