On September 8, 2011, the Supreme Council of Ukraine, by the votes of 247 people's deputies, adopted in second reading and in general the Law of Ukraine “On Security Activities” (No. 4824). The Act defines the organizational and legal principles of economic activity in the provision of services for the protection of property and citizens.
The law aims to create conditions for:
- protection of property, ensuring the rights and legitimate interests of business entities and individuals;
- ensuring state control over the implementation of measures to protect property and individuals;
- development and improvement of the scope of services for the protection of property and citizens.
The law applies to the legal relations of law enforcement bodies and military units in the process of providing them with services for the protection of property and citizens in a part that is not regulated by special laws regulating the activities of these bodies.
According to the law, “the state regulatory bodies in the field of security activities are the Cabinet of Ministers of Ukraine, as well as the central executive authority in the field of security activities”.
The law also provides for licensing of security activities carried out in accordance with the Law “On the licensing of certain types of economic activity”. In case of cancellation of the license of the subject of security activities, the issuance of a new license to him and new business entities created by him or his founder (founders) is allowed no earlier than one year from the date of cancellation of the license.
The legislative act defines the use of physical force, special means and the use of service dogs in security activities, the interaction of security agents with law enforcement agencies and the public is similar.

08.09.2011 г. Верховный Совет Украины голосами 247 народных депутатов принял во втором чтении и в целом Закон Украины «Об охранной деятельности» (№ 4824). Акт определяет организационно-правовые принципы осуществления хозяйственной деятельности в сфере предоставления услуг по охране собственности и граждан.
Закон направлен на создание условий для:
— защиты имущества, обеспечения прав и законных интересов субъектов хозяйствования и физических лиц;
— обеспечение государственного контроля за осуществлением мероприятий по охране имущества и физических лиц;
— развития и совершенствования сферы оказания услуг по охране собственности и граждан.
Действие закона распространяется на правоотношения правоохранительных органов и воинских формирований в процессе предоставления ими услуг по охране собственности и граждан в части, которая не регулируется специальными законами, регулирующими деятельность этих органов.
Согласно закону, «органами государственного регулирования в сфере охранной деятельности является Кабинет Министров Украины, а также центральный орган исполнительной власти в сфере охранной деятельности».
Законом также предусмотрено лицензирование охранной деятельности, осуществляемой в порядке, определенном Законом «О лицензировании определенных видов хозяйственной деятельности». В случае аннулирования лицензии субъекта охранной деятельности выдача новой лицензии ему и созданным им или его учредителем (учредителями) новым субъектам хозяйствования допускается не ранее чем через год со дня аннулирования лицензии.
Законодательный акт определяет применение в охранной деятельности физической силы, специальных средств и использования служебных собак, взаимодействие субъектов охранной деятельности с правоохранительными органами и общественностью подобное.
