Meanwhile, registering an application in the register has the same consequences as a decision to institute criminal proceedings ... The new CCP is political cheating. As for the experts of Europe, they all measure through the legal life in their own state, that’s why they don’t see our realities.

Удивляюсь безграничной наивности наших коллег. Новый проект КПК нужен. Но защитить права человека можно и в рамках действующего КПК при условии наличия свободы судейской совести. Проект КПК значительно ухудшает положение обвиняемого и его адвоката. Для этого достаточно поставить себя на место адвоката и попробовать обжаловать регистрацию заявления о преступлении. В действующем кодексе постановление о возбуждении дела по крайней мере можно обжаловать в суд. Между тем регистрации заявления в реестре тянет за собой те же последствия, что и постановление о возбуждении уголовного дела... Новый КПК - политическое шулерство. Что же касается экспертов Европы, то они все меряют через правовую жизнь в собственном государстве, вот и не видят наши реалии.
