PATIENTS OF MEDICAL INSTITUTIONS MAY BE GIVEN THE RIGHT TO CARRY OUT VIDEO RECORDING OF OPERATIONS

Patients of medical institutions may be granted the right to conduct video recording of operations; Additional measures have been developed to protect the interests of patients and doctors. The corresponding bill was developed by the deputy Valery Seleznev and today is submitted to the State Duma.
It is proposed to provide patients with the right to record video recording any medical intervention in relation to the patient in a medical organization. It is assumed that the recording will be carried out on a personal technical device (device) of the patient.
At the same time, with the written consent of the patient, the doctor will also be able to carry out a video recording of his medical intervention.
The author of the document notes that the video process should not in any way distract the doctor from his work. The data of the videos made will constitute medical confidentiality.
As noted in the explanatory note to the document, its adoption will contribute to the disclosure of medical errors made by doctors, will enable the patient to receive compensation in case of damage to his life and health. The results of the practice of video documenting the work of surgeons can also be disseminated for the purposes of training young specialists, analyzing the work of doctors, developing professional skills, preserving unique experience, and creating educational films.
Recall that Valery Seleznev already put forward a similar idea at the beginning of the last code, providing patients with the right to receive video recordings, and medical organizations - with the obligation to ensure the possibility of its implementation (with the consent of the patient). At the same time, the recording should have been made at the expense of the medical organization. The corresponding bill was withdrawn from consideration by the State Duma in connection with the withdrawal of the legislative initiative by the subject of law.

ПАЦИЕНТАМ МЕДУЧРЕЖДЕНИЙ МОГУТ ПРЕДОСТАВИТЬ ПРАВО ПРОВОДИТЬ ВИДЕОЗАПИСЬ ОПЕРАЦИЙ

Пациентам медучреждений могут предоставить право проводить видеозапись операцийРазработаны дополнительные меры защиты интересов пациентов и врачей. Соответствующий законопроект разработан депутатом Bалерием Селезневым и сегодня внесен в Госдуму.
Предлагается предоставить пациентам право осуществлять видеозапись, фиксирующую любое медицинское вмешательство по отношению к пациенту в медицинской организации. Предполагается, что запись будет осуществляться на личное техническое средство (устройство) пациента.
При этом, с письменного согласия пациента врач также сможет осуществлять видеозапись, фиксирующую проводимое им медицинское вмешательство.
Автор документа отмечает, что процесс видеосъемки не должен никаким образом отвлекать врача от выполнения его работы. Данные произведенных видеозаписей будут составлять врачебную тайну.
Как отмечается в пояснительной записке к документу, его принятие будет способствовать раскрытию совершаемых врачами медицинских ошибок, даст возможность пациенту получить возмещение в случае причинения ущерба его жизни и здоровью. Также результаты практика видеодокументирования работы хирургов может получить распространение для целей обучения молодых специалистов, анализа работы врачей, отработки профессиональных навыков, сохранения уникального опыта, создания обучающих фильмов.
Напомним, что аналогичную идею Валерий Селезнев уже выдвигал в начале прошлого кода, предусматривая наделение пациентов правом на получение видеозаписи, а медицинские организации – обязанностью обеспечить возможность ее проведения (с согласия пациента). При этом, запись должна была производиться за счет средств медицинской организации. Соответствующий законопроект был снят с рассмотрения Госдумы в связи с отзывом субъектом права законодательной инициативы.
