В последнее время все чаще и чаще страдают должники банковских организаций страдают от действий коллекторских агентств, натравливаемых на них банком. Всем понятно, что долги отдавать прейдется и от этого никуда не деться. Однако те кто сталктивался с так называемым "наездом" коллекторов знают какую "головную боль" они доставляют. Должники не знают куда от них деваться, не могут самостоятельно решить данную проблему, которая становиться для них сущим адом. Конечно некоторые могут обратиться к юристу и он может помочь разобраться в данной ситуации. Однако многие так не поступают и не решив проблему самостоятельно не знают к кому обратиться за помощью. Учитывая все возрастающую задолженность перед банками коллекторские агенства все больше и больше оказывают давление на должников и не могут умерить свои аппетиты в "выбивании" с должников денег порой переходя черту закона и считая себя безнаказанными порой начинают открыто угрожать должникам. Исходя из своей небольшой практики по обращениями с данной проблемой ко мне могу смело сделать вывод, что данная проблема может стать ещё одним "небольшим кусочком хлеба" и для детективов. Тем более встречая у себя на пути поддержку на стороне должника в ввиде Детектива, местные коллекторы из городов и так называемой "коллекторской КНАПКА" и их заказчики в виде банка резко теряют весь свой пыл и забывают об угрозах должнику, а резко переходят на общение в рамках закона, а сами "Заказчики-банки" начинают открещиваться от своих верных "псов" коллекторов и переносят всю ответственность за незаконные действия на них. При этом у должника появляется реальная возможность решить вопрос о погашении своей задолженности в сумму равную половине своего долга при условии если долг продан коллекторами. Если уважаемые коллеги эта тема интересена то можно будет уже и конкретно поговорить о том какие конкретно действия необходимо производить для реализации данного вида деятельности.

На данный момент коллекторские агенства при сотрудничестве с банками используют три вида договоров:
1. Договор цессии (уступки права требования) - данный вид договора подразумевает факт продажи долга банком коллекторскому агентству.
2. Агентский договор - по данному виду договора коллекторское агенство (агент) от имени банка и за его счёт обязано произвести определённые действия, обычно они подразумеваются как юридические и иные действия.
3. Договор-поручение - на данный момент используется менее реже предыдущих, и подразумевает что за счёт "Заказчика" "Поверенный" производит определённые действия в пользу "Доверителя".
Методов борьбы с коллекторами должниками в виде советов в интернете дано не мало, однако они даны не полностью или нет конкретной поэтапной расписки пошаговой.
Итак самое первое что необходимо сделать при данной работе по этой проблеме:
1. Необходимо узнать какое коллекторское агенство занимается должником.
2. Необходимо уточнить на каком основании данное коллекторское агенство предъявляет претензии к должнику (в данном случае стоит напомнить им, что договор заключен между должником и банком и третьи лица в соответствии с договором стороной договора не являются и претензии выставлять не имеют права)
3. Необходимо затребовать копию договора ( все требования лиц без доказательств не имеют юридической силы и являются незаконными и должник в праве затребовать подтверждающие документы и не вести никаких переговоров до представления доказательств, при этом его действия не будут расценены как уклонение от выполнения обязательств)
4. Изучить договор (следует помнить, что каждый из описанных выше договоров имеет свои особенности и имеет дополнительный пакет документов необходимых для него в виде приложения)

Последнее время пошла тенденция звонков коллекторских агентств размещенных в Москве и других городов расположенных ближе к Москве например таких как Тверь и пр. в отдаленные регионы страны. Такими коллекторскими агентствами являются ООО "ЭОС", ООО "РусКоллектор", ООО "Национальная Служба Взыскания" и другие. Читая их сайты для ознакомления честно могу сказать перспективы по возврату долгов у них многообещающие, что однако не соответствует действительности. Основной расчет таких коллекторских агенств доставание должника засчет постоянных звонков, что с одной стороны является непротиворечащим законодательству, однако довольно таки частое нарушение данных коллекторских агенств нарушение установленного законом времени звонков которое составляет с 7 часов утра до 22 часов вечера в рабочие дни в выходные и праздничные дни так же как и судебным приставам коллекторским агенствам беспокоить должника им запрещено, причем стоит учесть, что данное время должно соответствовать тому региону в который звонят коллекторы, а не тому региону из которого производят звонки коллекторы. Данное нарушение коллекторами достаточно легко зафиксировать путем снятия распечатки звонков с телефона должника и записью телефонного разговора по телефону, благо сейчас техника позволяет произвести данные действия путём установки в телефон программы для записи разговоров и установки цифрового диктофона в стационарный телефон. Расчёт коллекторов тут довольно простой, данные действия попадая под статью "хулиганство" за которую банк ответственности не несёт, а коллекторы находятся в другом регионе и полиция по данному заявлению особо суетиться не будет, нервируют должника пытаясь заставить его заплатить долг с процентами максимально возможными для спокойного сна. Лучшая защита в таком случае выключение телефона на ночь.

Относительно звонков....Ко мне вот недавно клиент один обращался относительно навязчивости "коллекторов"....Посоветовал ему вежливо отвечать на звонок и не "вписываясь" в разговор,пожелать сразу звонившему всего хорошего....Только добрым голосом...И что бы вы думали....На том конце провода стали нервничать,ругаться....Но после 5 дня общения звонки вообще прекратились....Как то так....Это добрый совет должникам....Некоторые банки,да и коллекторы тоже,проводят специальные курсы обучения для своих сотрудников,которые "работают" с телефоном...Так на этих курсах "учат" вежливо разговаривать с потенциальным "клиентом"...При этом их учат реагировать на агрессию....А если агрессии со стороны должника нет-это их самих бесит...Что и нужно доказать....Так что желающие могут воспользоваться добрым советом-будьте вежливы с представителями кредиторов....И эта вежливость их "убьет"....Как то так....Существует еще масса советов,основанных на законах психологии общения...Но всего не расскажешь в коротком посте....А на "большой" пост просто нет времени....Желающие могут сами найти в интернете ответы на вопросы по поводу общения с "телефонными" домогателями от банков....При этом также следует учесть "вахтовый" метод работы коллекторов и сотрудников банков,занимающихся "выбиванием" долгов по телефону...Т.Е. они будут передавать ваш номер телефона "по смене" для ежедневного обзвона...Так что говорить придется с разными людьми....

По поводу обучения коллекторов общению абсолютно верное утверждение, но однако метода уж слишком устаревшая, я когда работал на банк в 2007 году по этой методе обучался и до сих пор пересекаясь с ними до сих пор вижу, что метода не изменилась и очень сильно устарела. Звонки даже при вежливом обращении должника с коллекторами прекращаются на незначительный срок, а потом начинаются с удвоённым усилием и не по одному разу за час. Поэтому клиента надо сразу предупреждать, что готовиться надо к звонкам надолго и этот факт не оспорим. Также как и тот факт что разговоры со стороны коллекторов будут вести разные люди. Тут речь идёт даже не о просрочке должником в месяц или два, при котором идёт названивание коллекторами с требованием оплатить задолженность, в таком случае хватает и действий описанных выше по поводу предоставить им пакет документов и они сразу снижают давление. А вот в ситуации когда клиент платит по мере возможности или не может сразу выплатить всю сумму долга по решению суда. А вот тут уже абсолютно другой разговор у коллекторов и доходит до действий реально не дающих человеку жить спокойно и порой порочащих его честь и достоинство. Для примера могу привести такие факты как расклейку объявлений о долге человека в подъезде, расклейка объявлений с просьбой о помощи ребёнку должника, попытке выбить сумму реально превышающую сумму долга должника. А эти данные примеры показывают реальное нарушение не только человеческих норм, но и всех законодательных актов, включая и Уголовный Кодекс, за что их довольно таки часто и привлекают по статьям:"превышение должностных полномочий" и "вымогательство". А банк можно, хотя и сложно привлечь по статье "мошенничество". Конкретный пример в моей личной практике когда Хабаровский филиал банка "ВТБ 24" после посещения его с клиентом предпочел отдать деньги должника в размере 54 тысяч, которые клиент ему выплачивал в качестве долга по кредиту, обратно не доводя дело до разберательств в органах полиции и судах, открестившись от коллекторов, нанятых им же. Скинув всю ответственность на них за дальнейшие незаконные действия и не беспокоя больше клиента дальнейшими притензиями.

It should be noted that collectors focus on the first half of this part of the article without paying attention to the second. The fact is that under the law "On the Protection of Consumer Rights", the provision of credit is a service provided by a bank to a debtor and does not provide for the transfer of rights to organizations and persons not licensed to carry out banking activities. But this already causes a controversial situation and in solving this situation directs to decisions of judicial practice on these issues. In this situation, there are two positions of arbitration courts. One position is on the side of the debtor, the second is on the side of the new creditor. But the jurisprudence of the Supreme Arbitration Court is not the ultimate authority. Therefore, the Supreme Court put an end to the solution of this issue in its decision N ° 17 of June 28, 2012 to resolve these issues by the courts, namely paragraph 51, which directly indicates that the "Law on the Protection of Consumer Rights" does not provide for the right to transfer requirements under a loan agreement with a consumer to persons who do not have a license to carry out banking activities, unless otherwise provided by law or agreement. Based on this position of the Supreme Court, it is worth paying attention to the Agreement between the bank and the debtor. If it contains a clause on the transfer of debt to third parties, then this action is legal; if not, then this transaction concluded between the collection organization and the bank is invalid.
Also, part 3 of this article indicates that without a written notification of the debtor about the transfer of rights of the creditor to another person, the new creditor bears the risk of adverse consequences resulting from it. The essence of this paragraph of the article is that when transferring a debt to a new creditor, the old creditor is obliged to notify the debtor in writing, and the written form of the notification must be confirmed by the client’s signature on receipt of this notice, i.e. in fact, it turns out that if the debtor did not sign the receipt of this notice, then he will be notified inappropriately, thus it turns out that the debtor must personally receive a registered letter with a notification, or the notification itself is a kind copy in the second copy. All other methods of notification through third parties or by simple correspondence are insufficient and in fact do not bear legal responsibility for the debtor, allowing him to refer to insufficient notification from the creditors.
Also important for the debtor and the Anti-collector is part 4 of Art. 382, which allows them to demand from the original creditor and from a new joint and several compensation for losses. The essence of the article is that if at the conclusion of the cession agreement between the bank and the collection agency violations are found in favor of the Debtor, he can claim compensation for losses incurred by him for appealing to lawyers, anti-collectors and to the courts. Thus, he can significantly reduce the amount of debt or receive an amount from the bank itself for transferring the debt to a collection agency, while it should be borne in mind that as soon as the Assignment agreement was concluded and entered into force, the bank lost the right to claim the debt and all costs for the bank are substantial and are made from the bank’s “own pocket”.
Article 384 of the Civil Code of the Russian Federation specifically sets out the scope of rights that passes to a new creditor.
Part 1 of this article suggests that claims are transferred to the new creditor in the volume and on the conditions that existed at the time of transfer of ownership. For collectors, this item is a tempting offer, which they throw at, forgetting that there are pitfalls here without further study of further articles of the Civil Code, they are tempted by the further demand for interest from the debtor for the use of funds. Those. literally, this part of the article tells us that if a part of the debt was paid for the debtor, then the new creditor is not entitled to demand from the debtor an amount exceeding this part. This gives the debtor the opportunity to pay the amount to collectors lower than they require. In my practice, there was an example when the VTB-24 bank transferred the amount of the claim in the amount of 140 thousand without taking into account the payments made under the contract, as a result of the calculations, the amount of the debt turned out to be 88 thousand rubles. The result for the bank was the compulsion from its own pocket to give money to the client in the amount of 54 thousand rubles for indicating the bank’s miscalculation and for the science that it’s not worth doing it anymore.

If the documents requested by the Debtor are not provided to him, the Debtor has the right not to fulfill his obligations to the new Lender, while he will not be able to charge him interest for evading these obligations. For an example of non-fulfillment of this paragraph, I want to give an example the collection agency LLC "EOS", which on this site boasts of being in the KNAPKA association. This agency as a proof of its rights sends a Notice of the transfer of the right of claim to it and the First sheet of the Assignment Claim Agreement, which, in addition to general terms, does not contain anything and the last page of the Agreement, which indicates the details of the parties, does not provide the Debtor with any evidence. Repeated judicial practice in which 90% of the cases I studied is a failure for this agency did not teach these collectors the correct provision of a package of documents. The exception in this case is the Notification sent by the original creditor, for him the requirement to provide transfer of documents is not required. Part 2 of this article is not essential for this topic.
Part 3 of this article obliges the Lender, when transferring to the new Lender, to transfer documents proving the right (requirement) and provide information relevant to the implementation of this requirement. But here the banks and collectors are in trouble. Faced personally and studying practice, I can say that the transfer of information does not occur in full. The bank does not provide accurate information about which a lot of supporting facts can be found, as a result of which many strangers suffer from the actions of the collectors, the fact is that the “lamb” from KNAPKA apologize to my colleagues, but I just can’t say otherwise, they are actually hooligan actions without realizing that the consequences for them can be deplorable actions. Or, when transferring debts for which there are court decisions, they don’t tell collectors that they need to redo the writ of execution, and the near-by collectors do not have enough of this “intelligence” for it. Thus, the Debtor has one more possibility of legal non-fulfillment of obligations without legal consequences for him, and for lenders by loss of time of legal influence on the debtor. And all other actions that go beyond the law lead “near-minded” collectors to the dock.

И так рассмотрим первый случай - Договор уступки права требования (Цессия)
Российское законодательство, а конкретно Гражданский кодекс РФ, даёт данное право кредитору в отношении должника. Т.е. кредитор вправе переуступить право требования долга третьему лицу, но тут стоит помнить, что данное право новый кредитор получает путем погашения долга Должника перед старым Кредитором, после чего старый Кредитор теряет все права в отношении Должника. Данному виду сделки посвящен параграф 1 главы 24 Гражданского кодекса.
В соответствии с ч. 1 ст. 382 позволяет переход долга на основании закона. А ч. 2. данной же статьи говорит о том, что письменное согласие должника не требуется, если иное не предусмотрено законом или договором.
Тут следует обратить внимание на то, что коллекторы делают упор на первую половину данной части статьи не обращая внимания на вторую. Дело в том что по закону "О защите прав потребителя" предоставление кредита является услугой предоставляемой банком должнику и не предусматривает передачу прав организациям и лицам не имеющим лицензию на осуществление банковской деятельности. А вот это уже вызывает спорную ситуацию и в решении данной ситуации направляет к решениям судебной практики по данным вопросам. По данной ситуации имеются две позиции арбитражных судов. Одна позиция является на стороне должника, вторая - на стороне нового кредитора. Но судебная практика Высшего Арбитражного суда не является конечной инстанцией. Поэтому точку в решении данного вопроса поставил Верховный суд в своём постановлении N° 17 от 28.06.2012 года для решения данных вопросов судами, а именно п. 51, который прямиком указывает на то, что "Законом о защите прав потребителей" не предусмотрено право передачи требования по кредитному договору с потребителем лицам, не имеющим лицензию на право осуществления банкоковской деятельности, если иное не установлено законом или договором. Исходя из данной позиции Верховного суда стоит обратить внимание на Договор между банком и должником. Если в нем есть пункт о передаче долга третьим лицам, то данное действие является законным, если нет, то данная сделка заключенная между коллекторской организацией и банком является недействительной.
Также часть 3-я данной статьи указывает на то что без уведомления в письменной форме должника о состоявшемся переходе прав кредитора к другому лицу, новый кредитор несет риск вызванных этим неблагоприятных для него последствий. Суть данного пункта статьи состоит в том, что при передачи долга новому кредитору, старый кредитор обязан уведомить об этом должника в письменной форме, а письменная форма уведомления должна быть подтверженна росписью клиента в получении данного уведомления, т.е. фактически получается, что если должник не расписался в получении данного уведомления то он будет уведомлен не надлежащим образом, таким образом получается что должнику должно быть лично должнику заказное письмо с уведомлением, либо само уведомление лично род роспись во втором экземпляре. Все остальные способы уведомления через третьих лиц либо простой корреспонденцией являются недостаточными и фактически не несут юридической ответственности для должника, позволив ему сослаться на недостаточное уведомление со стороны кредиторов.
Также важным для должника и Антиколлектора является часть 4-я ст. 382, которая позволяет им требовать от первоначального кредитора и от нового солидарного возмещения убытков. Суть статьи в том, что если при заключении договора цессии между банком и коллекторским агентством будут найдены нарушения в пользу Должника, то он может затребовать от них возмещение понесенных им убытков за обращения к юристам, антиколлекторам и в суды. Таким образом он может значительно снизить сумму долга или получить сумму от самого банка за передачу долга в коллекторское агенство, при этом стоит учитывать, что как только был заключен договор Цессии и вступил в силу, то банк потерял право на требование долга и все затраты для банка являются существенными и производятся из "собственного кармана" банка.
Статья 384 Гражданского кодекса РФ конкретно расписывает объём прав который переходит новому кредитору.
ч. 1-я данной статьи говорит о том, что права требования переходят к новому кредитору в том объёме и на тех условиях, которые существовали к моменту перехода права собственности. Для коллекторов этот пункт является заманчивым предложением, на который они кидаются, забывая о том что тут есть свои подводные камни без дальнейшего изучения дальнейших статей Гражданского кодекса, их прельщает дальнейшее требование о получении процентов с должника за пользование денежными средствами. Благодаря этому доблестная братия из КНАПКА кинулась покупать долги у банков за 2-10% от стоимости реальной суммы долга в надежде получить "барыши" превышающие сумму затрат. Поэтому если затребовать документ об уплате долга большая часть коллекторов отказывается его предоставить, ссылаясь на тайну договора, что фактически не является таковой и в суде они с большой неохотой его достают или особо "одаренные" отказываются предоставить его, тем самым решив дело не в свою пользу.
ч. 2-я говорит о том что требование по денежному обязательству может перейти в части. Т.е. дословно данная часть статьи говорит нам, что если за должника была оплачена часть суммы долга, то и новый кредитор не вправе требовать от должника сумму превышающую данную часть. Это как раз и даёт должнику возможность оплатить сумму коллекторам ниже чем они требуют. На моей практике был пример когда банк "ВТБ-24" передал сумму требования в размере 140 тысяч не учтя проплаты сделанные по договору, в результате расчётов оказалась сумма долга оказалась в размере 88 тысяч рублей. Итогом для банка стала вынужденность из собственного кармана отдать клиенту денежные средства в размере 54 тысяч рублей за указание на данный просчёт банка и за науку, что больше так делать не стоит.
ч. 3-я стал. 384 запрещает делать значительно более обреминительной для должника чем была первоначально. Трактовка данной часть думаю ясна всем, если будут условия ухудшающими положение должника, то данная сделка будет недействительной и должник вправе ее не исполнять.
Ст. 385 ГК РФ конкретно даёт объяснение как должно быть сделано уведомление должника о переходе прав требования.
ч. 1-я говорит о том что силу уведомление для должника имеет одинаковую силу не зависимо сделано оно новым Кредитором или старым, но есть одно "Но" на которое КНАПКА опять же не обращает никакого внимания. А суть в примечании, конкретно в том что если Должник получил Уведомление от нового Кредитора, то он обязан предоставить Должнику подтверждающие документы по требованию Должника. А вот тут Должник может затребовать от нового Кредитора весь переданный по ему долгу пакет документов для его изучения на законность. Если затребованные Должником документы не будут ему предоставлены, то Должник вправе не исполнять свои обязательства новому Кредитору, при этом он ему не сможет вменить проценты за уклонение от выполнения данных обязательств. Для примера неисполнения этого пункта я хочу привести в пример коллекторское агенство ООО "ЭОС", которое на сваем сайте кичется своим нахождением в ассоциации КНАПКА. Данное агенство в качестве доказательства своих прав высылает Уведомление о переходе им права требования и Первый лист Договора уступки права требования в котором кроме общих терминов ничего не прописано и последнюю страницу Договора, в котором указаны реквизиты сторон не предоставляет Должнику никаких доказательств. Многократная судебная практика в которой 90% дел изученных мной является для данного агенства проигрышной не научил данных коллекторов правильному предоставлению пакета документов. Исключением в данном случае является Уведомление высылаемое первоначальным кредитором, для него требование в предоставлении передачи документов не требуется. Часть 2-я данной статьи для этой темы не является существенной.
ч. 3-я данной статьи обязывает, Кредитора при передаче новому Кредитору, передать документы удостоверяющие право (требование) и сообщить сведения, имеющие значение для осуществления этого требования. А вот тут у банков и коллекторов прямо беда. Сталкиваясь лично и изучая практику могу сказать, что передача сведений происходит не в полном объёме. Банк передаёт не точные сведения о чем можно найти немало подтверждающих фактов, в результате чего от действий коллекторов страдают многие посторонние люди, дело в том что "баранины" из КНАПКА прошу прощения у коллег, но по другому я просто не могу назвать, совершают фактически хулиганские действия не понимая что последствия для них же могут быть плачевные действия. Либо при передаче долгов по которым имеются решения суда не говорят коллекторам о том, что им нужно переделать исполнительные листы, а у недалеких коллекторов на это не хватает своего "умишка". Таким образом у Должника имеется ещё одна возможность законного неисполнения обязательств без юридических последствий для него, а для кредиторов потерей времени правомерного воздействия на должника. А все другие действия, выходящие за рамки закона приводят "недалеких" коллекторов на скамью подсудимых.
